DOT Warnings vs Violations

- This is a video trying to explain, in a rambling and semi-coherent manner, the difference between a warning and a violation. I am NOT an attorney, nor do I claim to be, therefore consult an attorney before attempting to take any issues to the courts. That being said...the point of the video is that even though the DOT officer gives you a warning, there are still CSA points given to the company and the violation is still placed on your driver PSP report and recorded with the FMCSA. A warning is basically the same as the citation, minus the points on your license and monetary fine.
The warning can not be appealed in court, as there isn't anything to appeal. No citation, no action to appeal. However...as I said about the CSA points and PSP report with the FMCSA, the violation is recorded and placed on your record in the system. You are able to appeal the violation that the warning was issued for through the FMCSA's DataQ system. However, you are unlikely to have the points removed as the original violation is normally correct and factual. This is why I say that if the violation is inaccurate, that it is much better to have the ticket written, as that is appealable in court, than to have the warning issued. This is not legal advice, however, this is simply my opinion. Once again...consult with an attorney before taking any legal action.
I got two tickets and took them to court and they were both dismissed. I went through data q and even called the fmcsa several times and spoke with them and sent them the dismissals and they STILL left them on my psp. They absolutely refused to take it off. So just cause you're in the right doesn't mean that the fmcsa is going to do the right thing. They are in the business to screw truckdrivers, and they do.
I got a hos violation ticket but didn’t have to go to court & I called them & they said I didn’t have to pay anything. What does that mean ?

@@saidabdulrahim6015 Usually with a warning you wont have any points on your license or a fine, but you and the company will receive hits to your federal scores. It will be on your record and the company record for a certain period of time, but you wont have a citation that affects your license. Just make certain that the warning doesnt require a signature from your company and needs returned to the jurisdiction. Checking with your company's HR or Safety Dept would be your best bet as they will know the legalities of the situation.
I got a warning for speeding in construction site no workers present and no miles recorded on warning. How do I beat this
If I get a violation and I fix the issue but the DOT still requires me to send a signed copy that shows I fixed the violation, is it only the company who can sign and send back to the DOT or as an Owner Operator you can sign and send back to the DOT after fixing the violation?
🤔 A couple days ago I got an inspection "warning" for having my cell phone in my right hand while driving my box truck. ×I have a chauffeur's license no CDL license needed to drive the box truck.. After doing my research and watching videos like this here I thought the cop was giving me a break, but now I'm realizing it was basically reaming me! 😡

I had a level one inspection where the officer had me throw on another strap and an he said that an 11 minute ELD driving violation was nominal. I got a level one sticker so he said it was a pass but do those non ticket violations show up to hurt me? The strap was fixed asap and he didn’t care about the moving of the truck violation when I was over my drive time and in the yard. Just wondering if I can even feel good about the level one stickers!
What if I was driving a company vehicle that wasn’t registered as a commercial vehicle and wasn’t current on registration? I got pulled over for a DOT inspection today in my Roll Off truck. Both thickets were issued to me? Will this go on as negotiable points
Got a level 2 inspection and my ELD was in offline mode but he checked the loafs and it was good but wanted to send it but I told him it’s in offline and I need to just switch my phone Wi-Fi on to connect it because it will eat up all the hotspot he didn’t want me to and gave me a violation 395.24D can I dispute this ?

Just a quick search told me that the violation stays on the company's record for 24 months and on your as a driver for 36 months. Unless it involves a crash, then it stays on record for 60 months. Hopefully this helps and thanks for watching.

@@joecrocket7873 I would assume the same amount of time, simply because FEDS don't distinguish between a warning and a citation. A warning just means they didn't write the ticket, therefore you don't get points on your license or a monetary fine. However, the violation still occurred and was reported to the Feds.
@@leroyyancer3930 so I'm guessing three years on my CSA. I just got a warning ticket for failure to stop at scale looks like my employer got the violation will that be a big hit for them?
@@joecrocket7873 From what I can gather it depends on the state, but it seems that it is the equivalent of failing to stop for a traffic signal. I couldn't really find an answer on how many points the company would receive.
Do you or your company still get fined even if its just a warning?
No. There isn't a monetary fine, but it still hits the CSA score, which can affect insurance rates and things like that.

The cop gave me a 10 over ticket I delayed it for 7 months the officer dropped but gave me a 15 over road side inspection being petty smh

Its something a lot of drivers don't know about. They think they are getting away with just a warning, but it still affects them and their company.
