Take away water companies immunity to private prosecution under 1991 water act where customers are forbidden to use courts to get there money back for services not provided and it would stop because the cost of lawsuits would force them to act

Well, this water problem is not exactly only a problem of the current Tory government. Rather, it is a problem that has been dragging on for decades and depends on several factors. Labour is certainly no innocent bystander in the past and present. It remains to be seen how things will look in the future if they win the next election. The completely outdated and dilapidated sewage system is to a large extent the problem of the public sector. It would have to be completely renovated, but if you are honest, this seems almost unaffordable.
In other European countries too, wastewater is sometimes discharged into bodies of water without being treated or inadequately treated, usually when the absorption capacity is overloaded due to excessive rainfall and there is a risk of it being pushed back onto the roads. In England, however, it has unfortunately become common practice for this to happen even when the system is not overloaded. In other words, it has become a habit. Politics could prevent this.
And that brings us to the problem of privatisation here: As far as I know, Thames Water is heavily indebted. Insolvency should probably be applied for here, if necessary by force, but the state seems to prefer to keep its hands off it. Of course... in view of the high costs that would be incurred if the water supply and purification were to fall back into public hands, people would rather shy away from it.
Well, there is no doubt that some of Thames Water's business practices in the past seem rather dodgy. The following undoubtedly takes the cake: at times, loans were taken out to pay out horrendous dividends to satisfy the shareholders. And this at a company that is heavily indebted. That alone is pure madness! And, by the way, in many countries it is definitely a case for the public prosecutor's office = keyword insolvency concealment, among others.
Conclusion: I doubt that Labour will be able to solve the water/wastewater problem completely. However, it would undoubtedly be very helpful to avoid the absolutely superfluous untreated wastewater and to bring the sewage treatment plants up to the latest standards, as should be the minimum requirement for a modern industrialised country in Europe.
Finally, a small comparison: In Germany, which the Brexiteers like to use as a prime example of blaming, to my knowledge around 90% of the waters are considered clean and harmless and usable for the general public. However, that is by no means the front-runner: I believe that is Greece with more than 97% (to the best of my knowledge). England is at just about 17%.😱😵‍💫 The question about the latter is: Is it still falling?

Like every scandal in the UK, there will be no one held accountable for this, and it will continue. Scandal after scandal, and the people being paid huge amounts of money to run these industry's, "badly or in some cases, criminally negligent, can walk away without any consequences. Until someone is jailed for their part in one of these scandal's, nothing will change.
The post office scandal is a case in point.

Another feature that we have had in Scotland for decades is Storm Bunds. Shallow ponds that rain water flows into and out of. During heavier rain or melting snow the ponds become deeper then slowly go back to shallow as the rain water flows into streams, burns or rivers. Rain water is separate from black water ( sewage etc )
