      There’s usually a cap on how much can be awarded. The jury isn’t aware of this before hand.

    I would be so pissed if I did my job as a juror and spent all that time just for the judge to come and change it. What a big letdown to the jury 😡

      The jury was tampered with. The foreman decided it would be a huge settlement long before the trial began. Read his wife's social media posts.

      I think it should be reduced further based on the lack of evidence. It was a sympathy verdict.

      I also worry about the impact this has on mandated reporting. Clearly they had a reason to report her mother. Hospitals shouldn't fear being sued to protect a child. Giving a child Ketamine infusions which is risky even by admission of the doctor who administered it, is a reason to report her. She was also directing treatment which is outside the scope of an infusion nurse. They have literally no proof of anything else. False imprisonment for 2 days when they were trying to transfer her to another hospital which the mother refused isn't worth over 200 million. The person on the phone call wasn't Cathy B. They had still photographs of her. Didn't even show her being held down. Those were two key pieces of evidence which weren't even proven. The emails from the mum were more incriminating.

    This case is so sad. I am very familiar with RSD/CRPS. My mom was diagnosed in the early 2000. My mom says that it’s like putting her hand/arm in lava. It’s a horrible neurological condition. It’s life long. There is no cure.
    My mother has survived cancer twice had two children naturally. This is much worse.
    How DARE they remove the child.
    I can’t count how many times we have ended up at the hospital and the DRs have told us “your condition is above our pay grade”. This condition they are not familiar with.
    The hospital and drs caused my mothers disorder to spread when they don’t pay attention to notes that say “don’t touch right arm”.
    I’ve only met one other person that who was familiar with this disorder. Her husband had it.
    This issue not only affects the one diagnosed, but the family. I can’t tell my mom that it’s going to get better tomorrow.
    Shame on the hospital and cps. There actions caused so much damage and this poor family will already have so much to bear.

    I appreciate you continuing to follow up with the Maya case....It truly provides us a valuable opportunity to "see behind the curtain" and gain insight into the reality of what happens after a verdict & award is rendered by the jury in a Civil case. I found today's read through of Judge Carroll's "Order On Post Trial Motions" very educational from a procedural standpoint. If the hospital gets away with what they did to Maya, which was DISGUSTING….they will NEVER CHANGE ! They need to be hit where it hurts to even have a chance of changing their behaviour !     What the jury decides should stand. Dislike the reduction of financial compensation. This case was horrific and awarded monies should match. It’s an insult to the victims to have damages reduced after a jury decided on amounts.😮

    What is the point of having a jury reach a verdict if the judge is able to step in and change the compensatory and punitive damages awarded by the jury? If that is the case, then why even have a jury trial?

      I think the jury’s duty is to decide the verdict based on the facts of the case, whether the case has merit to be awarded; however, some states have maximum on punitive damages and the judge has the right to make changes to the damages but not change the verdict of the jury. Lol. Hopefully that makes sense.

      But telling juries there is a cap might affect the way they determine their judgement.

    We have learned so much during this trial. And still learning thank you, Peter I’m not sure how I feel about this I feel like they should’ve gotten all the money. I do understand some of the cuts, but I feel like for the most part they should’ve went with what the jury awarded I think it was fair and reasonable.

    Peter, a question came up for me while listening to your reading of Judge Carroll's rulings. The way this ruling is written it sounds like it was written with a specific audience in mind that would be reading it in the future. Is that audience that he is writing it for the Appellate Court? Also, thanks for the insightful coverage! I find solid legal analysis on cases like this absolutely fascinating.

    That pain discription including the nickname "suizide-syndrom" is already "Chronicle Clusterheadache", ICD44.2, or better call it "Bing-Horton-Syndrom" as it is in many cases not limited to the head area at all, as in mine 😢

    Maya and her family accomplished what they set out to do. Makemthis an international "show" and succeeded in punishing a very bad actor who has gotten away with doing these things to others, but this time they did not. I expect they will not reject any adjustments to their money award because they have received more than they probably will ever need. The point was to hit these bad actors so hard that they would have to think about ever doing it again to anyone else and to showmthe worldmwhat they did. It is absolutely amazing that their so-called diagnostics and treatments were not recorded on Maya's medical records. Butmwe all know why they weren't - because then these mistreatments would be even easier to prove. JAHACH should be happy that nobody was punished criminally. But they still can not admit they were wrong, which is highly bothersome. So the only other recourse is to make it too expensive to do this.

    Although part of wishes the amount awarded had not been decreased it seems to me that it just makes it more likely to stand up to appeal. Still the total is over 200 million which I would hope the heads of John's Hopkins would take notice that they need to fix things in their house.

      A defendant acting as his own lawyer in a murder case that happened in the keys. Unlike Darryl Brooks he has done an ok job although sometimes annoying. The prosiding judge is the issue

      They lost a judgement for hundreds of millions, a few million here and there is nothing. And the hospital isn’t going to lose a dime of revenue, win, lose, or draw. It’s really shocking how clueless so many people are.

People like to hate on companies for “greed,” while they turn around and put money in savings, or buy nice stuff, or ask for a raise. Nobody is going in to their bosses office to ask for less money. Requests go one way.

      I hope that no matter what this judgment amount STAYS !Until the hospital is made to pay and hit them where it hurts they will NEVER change their behaviour …what they did to Maya was disgusting and disgraceful! They should be MADE to pay big time !
      With behaviour like this being allowed and considered acceptable by them and continuing to get away, it’s no wonder the health system in the US is so terrible for so many.
      We have it bad enough in Australia but the US system and the money they charge is disgusting! I feel for all AMERICANS, trying to navigate their system. I guy I know who died from a heart attack because he couldn’t afford to pay the dr bill to get checked, he was only 44. His employer was dodgey and didn’t give him health insurance and paid him a pittance. Snd yes he was born and in the US, not an immigrant. He was installing tech stuff in home for the weathly, just the boss took all the mega bucks and paid him a pittance. We found this out more after he passed away.

    Why have juries decide amounts when the judge can just change it on a whim?

      It's not changing it on a whim. Some of the amounts were larger than the statutory maximums.
      You allow the jury to decide because a judge is one person that can be bias or can be bought. Multiple jurors is harder to get at.
      Let the jurors make their amount determinations and then lower any to the maximums instead of having to teach the jurors about all the different statutory maximums.

      @@robkinney1974because it can affect the way they determine the amount. If they know in the beginning that the maximum for punitive damage is $1M, then they may simply default to that whereas they wouldn’t necessarily go that high.

    Something is wrong with our hospital, theres also this case when Providence Milwaukie hospital in Oregon that kick an dying addict from their ER by calling the cops and put him to jail, it gets so bad the cop aruge with the hospital and refuse to take him and transport him to another hospital, unfortunately he died before the new hospital can treat him..
    Does Hospital in the US have any standard of care anymore? Kind of scare to go to a hospital now

      What’s the point of having judges if jury verdicts are beyond reproach? This is nothing new, just a lot of arm chair experts who just started watching this guy and have no knowledge of anything other than his videos.

Of how being judged by a jury of your peers gets overturned by a judge, i thought the whole point was judge gives guidelines, jury decides on verdict. Sorry for my "arm chair expert" question

      If im not mistaken, i ubderstand thar once judgement is entered, the clock to calculate interest, on the modified judgement (per this remititure) of $213M (approx) , begins ticking.. and tocking. Hopefully interest payments are due on a prescribed schedule so that plaintiff's fees can be partially paid ... and that medical and psych treatments for this lovely family can resume.

    If you ask someone, like a jury in this case, to make a decision, you should accept it. They should get every cent the jury awarded. JHACH is proving over and over again that the judgement was to low.

    I’m angry that the judge reduced the awards! What is the point of having a jury if the judge can turn around and reduce the amount to whatever he/she feels!

      Because the award was totally ridiculous. Photos of her prior to and during the trial partying it up while looking so so sad in front of the jury. She is lucky I wasn't on that jury. Her mother was crazy. She's lucky if I would have agreed to a $1M award.

      @@joanalexander1942 I don’t want to undermine what Maya went through; however, I must admit I have thought the same thing. She looked pretty healthy to me at the trial?? 🤷‍♀️ So it makes me wonder but she did lose her mother regardless if she was crazy or not. So I think she deserves something for that. But not 263 million that’s for sure 👍
