The statement is not made by the girl herself. We need to hear it from her. The guy might have threaten her , we never know. I guess that this incident took place based on mutual consensus between the two. And It is pretty clear, the word 'rape' has surfaced only after few days when the victim started suffering from pain and under no relevant reason. Why not by that night itself if it is truly rape? Hence, why she lied to a wife of accuse and the latter found sitting together?
So the best way is this - the police should arrest all the gatherers who were being a part of party that night and do interrogation including her wife who allowed them to use alcohol in her house. If not I think there is not 100% consistent to consider the matter as rape for it has purely happened with consensus based.

The case seems to be a mattual and a consent act. The only issue is over action perpetrated by the culprit resulting in physical injuries to the victim. The victim too denied the foul action of Benjamin. The case is twisted and bears complete different story now.

According to the conversation I am just thinking if the assault was done by the wife and not by the husband for instance she said she saw her husband and the lady doing it and since the wife herself was also drunk may be out of anger she must have done that with the girl because I don't think the man had any intention to assault the girl in the case.
