kelan kaya exam?
I have a question regarding a Non Muslim man formerly marriage under civil code marriage and later he converted to Islam in order to marry another woman under Muslim marriage. , is that allowed under the provision of pd1083 which is Muslim personal law? if ever it is not allowed what punishment can be sanctioned or imposed for that man? Sukran
Even if he convert to Islam, he cannot contract subsequent marriage not unless his first wife will also convert to Islam and rectify their marriage to be govern by PD1083 through submitting a file to sharia court. Otherwise, he will be liable to bigamy if in case the first wife will file a case against him because under the provision of PD1083, if the first marriage was govern by civil code, the civil Law will apply to their marriage, not unless they will rectify it through what i have said awhile ago. On the other hand, if his first marriage under the civil Law was annulled and he convert to Islam and willing to contract a marriage under muslim rites, it is much better allowed for him because there will be no more impedements on his action. The important point here is he cannot contract subsequent marriage even though he converts to Islam because of his first marriage which govern by civil code. As a matter of fact, even the husband who is muslim in born cannot contract subsequent marriage if his first marriage was solemnized under civil Law.
Your second question is, it is allowed. Provided that he is a Muslim and there are no legal impediments in doing it(in case of the first paragraph is concern). Nothing is wrong with that, on a reason that PD1083 is concentrates to the legal action of a certain people and not on spiritual aspect in a sense that if he is a muslim, he is a muslim legally speaking and regardless of his intention because that intention is only between him and Allah. Therefore, he can do so. I said earlier that it is allowed provided that he is a muslim because the marriage of a non muslim husband and muslim wife is void ab initio under the Islamic Law.
I think it's not complete, what I know in sharia is it is the law of every aspect of life.
What do you mean by every aspect of life? You have to explain it. Because there is no shariah on how i swim or make a kite.
@@jasilhemd6813 there is, because you know sharia said find or consult to the expert when there is something that you want to do, learn or create something that you don't know.
@@aija9956 🤔 is that shariah? Are you kidding? So someone want to steal it is shariah to ask someone on how to steal?
@@jasilhemd6813 it seems like, you know whenever or whatever it is that you want it always had a creator, root, leader, Reason, system, guide, or an expert to ask for that makes you succeed in your journey.
