What is Involved in the Texas Appeals Process After Conviction?

    Is there an appeals time frame? For example you can only appeal 2 years post conviction? Also what if you were denied parole what could an attorney do?

      There’s a direct appeals time frame. Following conviction, if a defendant hasn’t waived the right to appeal, s/he has 30 days to file a notice of appeal (longer in certain situations), but most of the time, 30 days. On direct appeal, a defendant can challenge issues that happened and were preserved at trial-on the record. An 11.07 writ of habeas corpus is not a direct appeal but is considered a collateral attack on and also challenges a conviction. With certain exceptions, there is no time limit associated with it. It’s best to file it as soon as possible once the direct appeal is final, though. To learn more about denied parole, you’d have to contact a parole attorney; that’s outside the scope of our post-conviction practice.
