    Mr. Dave has hit the nail on the head, when he said we have not been taught constitution in our schools. That is why we are unable to differentiate right from wrong.

      bs - we're taught civics and constitution is the base for that. that legalese cant be taught and no one stopped us from buyin a book and reading , we have no qualms throwing k's and l's of money for luxury but dont take our civic duty seriously, so the goons took charge. by the same token, we should all be taught law basics and ipc, crpc, etc in school. we cant stop a constable pull out the key from our bikes during their stop/extort routines.
      No one stopped these daves and other retired judges/lawyers/cops/ias to open small institutions in every district to train the young on the ways of the law and govt and prep them

      Majority well to do individuals pay their fair share of taxes. 18% gst and up to 30% income tax. The govt has to be scrutinised on how they spend them.

    Respected sirs very good discussions went on ,One old story in my mind .A bird in a cage saying freedom freedom freedom ,one day a trveller passing that way listened and open the gate and freed the bird but the bird did not come out , why because if it fly in the sky there many problems in the out side like big birds,hunters,no security in fetching food etc. The bird accustemed to take timely food from her owner and security from foes .people who want freedom should be brave enough to sacrifice .In those days people wre brave enough to sacrifice so only they brought indipendence.

I've always been amazed, overwhelmed by the erudition and wisdom of our founding fathers who drafted this incredible 'Constitution of India' which simultaneously catered to the needs of people at that time and provided for ways to address the future needs of the country as well. It's high time now that we recognise its importance and preserve its spirit.

    Excellent topic and very high standard discussion of all 4 heroic personalities.l entirely agree with the last comments of Sri Kalyan Banarjee made on Judiciary which is the naked truth in asmuch as the whole Democracy of our Republic and all the people of the country at large have yet abundant trust and high confidence on it, but to our bad luck it is not functioning upto that mark.l sincerely appeal to Mr.Kapil sibal sir to kindly bring an Episode on this concern.lf alone the Judiciary works with minimum strictness in every litigation before it ,all other Organs will be automatically sized and there would be no room for such discussions at all ie whether constitution has failed or we have failed the constitution.

    While Mr Dave is wonderful , but Karti's point of independence of thinking of Members of Parliament is the single most important point that reminds me of Tagore's "Where the mind is without fear".
    The fall in the quality of leaders lies squarely on the democracy which is at an all time low.

    There is no point of thinking that constitution has failed us . Failure comes from performance, thoughts ,actions, mission , vision etc. If there is failure it is because of us .     The opposition didn't go into public and fight on behalf of the people for the last ten years. Only at the time of elections, they come out to the people. But they should continually intouch with them fighting for them. This is the only thing left over for them now. If they start the fight, people will also join them without fail. Now people have understood about media, judiciary and election commission, ED and CBI. All these lost the faith of the people. The only thing the people are looking at is opposition. If opposition also fails to fulfill that gap, the people have no other option leftover except for looking to sky.

    Dushyant Dave and Karthi Chidambaram are spot on in pointing out the fact that Congress unlike BJP has little presence in grass root level. Congress seriously lacks committed workers who get involved with day to day needs of the people. They meet people during election time that too half heartedly to seek votes but often fail to follow up that by ensuring casting of votes atleast of their supporters on voting day. On the other hand workers of BJP and RSS are active on election or non election days. Kapil Sibal is not gracious enough to accept it. Neither he accepts the follies commmitted by Congress. He himself as minister tried to bring a bill gagging freedom of press but had to withdraw on the face of widespread protest. Though he talks eloquently on constituitional morality he was often falling short. Kalyan Bannerjee is a misfit in this discussion. He is a petty politician.

    Sibal is a very shrewd man, with great gift of voice, articulation,delivery and deft handling of anything that confronts him. However sometimes his discomfort with those who are absolutely upfront is palpable indicating that he would be happy if those chaps shut up.

      Given he regularly practices before the SC, the fact that he can speak out albeit while receiving a protective shield given that he has achieved it in the course of time, he is uncomfortable because nevertheless he has to appear before it everyday. It too might affect his career.

    I have a different point of view.
    Constitution was not a distilled version of the existing reality of the Indian society. It was a hope; a dream of a successful future nation that we wanted to build. The constitution has not failed us on most counts, but it couldn't carry us to our dreams in one single area and that is communal harmony. The two main communities are irreconcilable. Hindus do not proselytize and proselytizing is very high on the Muslim (and Christian) agenda. Muslims also dream of capturing political power. This naturally irks the Hindus and they express their resentment through their political choices. Their political choice goes beyond government formation and makes inroads into the working of constitutional bodies. If Muslims voluntarily abandon their desire to convert Hindus, eschew any idea of seizing political power and leave their isolationary habits (like the nakab), our constitution will survive and serve as the engine of progress. Otherwise we will be forever ruled by the Hindu fundamentalists and the cauldron of communal divide will be kept burning so that their regime can come back to power again and again. The responsibility rests on the Muslims and to a tiny extent on the Christians.

    Dave says Modi is projected everywhere and it happens in dictatorships or communist countries. What did the Gandhi dynasty do? 400+ institutions, roads, awards and many other facilities in their names. Thats not dictatorship. Art 356 was used by the dynasty about 80 times plus they also broke down govts by hook or crook using methods other than art 356. Judge Bahirul Islam was a HC judge, became a RS member of Congress and then became the SC judge. Kashmiri pandits genocide & exodus cases was not taken by the courts and neither was sikh genocide of Delhi taken by the courts. TN Seshan fought on Congress ticket after retirement. When Congress did all the wrongs and destroyed the constitution and these people take a moral high ground. They are not introspecting what wrongs they did. During UPA time, SC itself called CBI "caged parrots" during UPA. Sickening.

    Kapil excellent discussion unfortunately our democracy is in its greatest danger of collapse and the only way of revival according to me is level of Education & Jobs there is unfortunately no other substitute.
