If only these are taught in schools to our youngsters...so many incidents could be avoided. At least one can weigh the heavy consequences of getting pregnant out of wedlock...
I have 2 daughters from the same mother, I live in Europe, left the life of ignorance and Allah Subhan Wa'Tala Guided me to Islam again. I was not married. The mother is non-muslim, we seperated because I did not want to carry on living a life of sin. My daughters are very young, but they have said Shahadah, Alhumdulillah. They see me praying and fasting and recognize that their father is a Muslim. I am not proud of my past, but can't change it. Only hope I am holding on to is the Mercy of Allah Subhan Wa'Tala and that He accepts my Tauba. Please pray for me and my daughters, it is not easy to live in the middle of the enemies of my faith. But Allah Subhan Wa'Tala Is the best of Planners. I will never give up hope, and I will keep trying to be a good father for my daughters and a good Muslim. In'Sha'Allah.
@zach when you reverted to Islam, my understanding is that your taubah was defacto accepted by Allah (SWT) as you were not a Muslim before. As for your daughters, keep them close to you and let them befriend pious people. May Allah (SWT) help you and your daughters and make things easy for you. Ameen.
I'm sorry Sheikh, but the question was, is she mahram to him? And you didn't answer that. You said the father doesn't have any responsibility towards her, you said the father can't marry her. But you didn't answer if he's mahram or not???? Meaning does she have to observe hijab from him or not.
He said that she should cover in front of him and treat him as a non mahram. However, she cannot marry him due to the biological relation. So it is slightly different and a grey area.
What if the illegitimate son didn't suckle from his biological mother? What is the ruling in that scenario?
Like he said, it's a no brainer. She was born from him. End of story.

so the man gets the pleasure of sex than gets away scotch free of responsibility of taking care of his daughter or son .. there both equal in the sin if consensual
You forgot about the part where the man gets stoned, the woman too after 2 years. If they were unmarried virgins then they most likely will get married anyways if not then the father of the girl takes care of the child because the mother is still in the care of her father
A child is innocent, even though it sucks for the stepfather or grandfather to take financial responsibility, that child is innocent and deserves to be raised like any other kid
There is already a punishment prescribed for adultery so no he doesn't walk away scotch free. This is about legal issues as well. The illegitimate child will not inherit anything from the biological father. Its important to understand the wisdom behind this.

I thought Islam was a fair and just religion, the men will go unpunished and the children will suffer.
First, I believe the judgment of these men will be in the hereafter.
Second, don't go near zina, and these problems won't arise. This is the reason zina is high up in the ranks of sins.

We measure justice and fairness with divine revelation from Allah not by our whims and desires. A fornicator is punished by death in islam and the child who is born out of wedlock is sinless and free from blame. Islam prohibits fornication in the first place so such situations wouldn't happen.
What about the woman?
The men will be stoned ..they donot go unpunished
