In Mexico the beach is public so many feet from the water at high tide. So you are correct in saying that the sand is like a sidewalk. Just because private companies put chairs and tables on public space it doesn't make it private. But they can charge you for it if you want to use those chairs and tables.
Hi, if this was really filmed July 2020 I´m shocked by seeing nobody is wearing a mask (cubrebocas) I was here Oct 2020 and a lot of the beaches were closed and everybody has to wear a mask all the time. I´m traveling there next month and as far as I know the Covid19 risk is still very high in Quintana Roo. As a matter of fact many states in Mexico are still at orange including Quintana Roo.

It was 2021. They are still required in a lot of places but cops are not enforcing them like last year.
