Virginia is a very pro-deer/fox dog hunting and anti-property owner rights state. This video aims to show just how few rights private property owners have in the Commonwealth. Right to Retrieve (RTR), has been a serious issue for private property owners as it effectively legalizes unwanted encroachment onto the property of another, and has frequently been used by the dog-deer hunting community to hunt property they otherwise had no permission to hunt.
Due to the distances covered during deer chases, high visibility, and frequent interactions with landowners and other outdoor users, deer/fox hunting with dogs can be controversial at times says the Virginia DWR. The Department receives complaints from residents and other hunters about trespass, violation of privacy, and interference from deer hunters who use dogs. Changing land uses, demographics, and societal attitudes are exerting pressures on the sport not seen a generation ago. Under the pretext of other legal pursuits, some deer/fox hunters who use dogs may engage in activities that lead to conflicts with other citizens or that are viewed as objectionable by the public (VDGIF 2008a). For example, some hunters may chase game or disturb other citizens on prohibited lands under the guise of retrieving hunting dogs (Code of Virginia §18.2-136), chase deer out-of-season during year-round fox chase seasons (Code of Virginia §29.1-516), or road hunt under laws or ordinances which vary considerably by locality. A number of states permit retrieval of hunting dogs without landowner permission under certain conditions (e.g., on unposted properties), but Virginia appears to be one of only two states where hunters can lawfully retrieve dogs even when access has been expressly denied by the landowner. Of the two, Virginia is the only one which allows deer/fox hunting with hounds.

I own multiple parcels of land in several of the red problem counties. If I had a dash cam, I could routinely film everything depicted in this video. I can assure you it is real and happening everyday in Virginia. I am positive the gentleman opening the dog box with the sippy cup intends to jump back in the truck and follow the dogs ultimately catching them in the _ _ _ _. Johnny, we need a four letter word that starts with R. Sadly it takes years to realize there is nothing that can be done. The process: 1. Apparently you have to own the land more than four years to even have a voice, 2. Is your land clearly posted? 3. Have you told them to stay off? 4. Do you have pictures? 5. Do you have video? 6. Have you contacted your representative? 7. Are you a transplant from the city? While this process is playing out the sheriff, deputies, and other county officials are telling their brother-in-law, AKA the Hunt Club President, that you are a tax paying trouble maker. All of my land is improved for wildlife and conservation, not maximized timber production. It is good to know DWR labels us as trouble makers. A gentleman with 150 acres in a 30,000 acre sea or 50 square mile area had 30 negative encounters or roughly 1 a week last year. That math is only supported by intent. There are multiple private property rights groups forming right now on Facebook with hundreds of the exact stories. Many have proof but are scared to come forward because of all the bullying and intimidation, this video hopefully will bring some of their personal accounts into the light. As this video says, it is not about hunting it is about private property rights. If you want to continue hound hunting a simple yes mam and our dogs will never get on your private property again and take the necessary actions to make sure they stay off.

As a landowner and as a hunter, I see that there is a growing tension between both landowners and hound hunting over the right to retrieve. In my opinion, you need to get perspective from all parties and do an unbiased article showing the challenges of both landowners and hunters. We are divided by rumors, misleading calls to action, negative interactions, lack of respect for landowners and inflammatory actions by a few individuals that disrespect other hunters and the landowners. They give hunting and hunters a bad image. We cannot continue to condone and protect those that trespass, disrespect landowners and give hunting a bad image.
There is a common misrepresentation by the hound hunters that landowners want to end the tradition of hound hunting. That is not entirely true and not all landowners want to end hunting of any type. We as landowners and hunters need to work together. Landowners want more accountability and stronger actions taken against those trespassing and breaking existing laws. Landowners want hunters to get permission to enter their property and show courtesy and respect. Landowners want their livestock and property protected from harassment, damage and intrusion.
We as hunters have been misleadingly told that hunting is under attack when the Right to Retrieve is challenged by landowners and preserving our heritage and tradition is the utmost priority and we need to fight . We need to realize that the reason the right to retrieve is being challenged is because the landowners are being disrespected, posted signs are ignored or damaged, livestock and pets are harassed, blocked driveways, hunters in the road and blocked roads because of a few negligent parties. The most important and relevant complaint by landowners is the altercations between trespassers and the landowners during encounters during hunting season. The trespassers are disrespectful, and use the right to retrieve as an excuse to enter property or other excuses such as I’ve been doing this for years. They post and boast on social media about the inability to read signs, doing what they want, insulting landowners and making fun of landowners and landowner’s rights. With all do respect in the aspect and intention of protecting hunting and our heritage hunters are not cooperating with landowners or representing hunting in a positive way. Hunters are dividing ourselves while protecting the few bad hunt clubs and hunters that are causing the issues with landowners.
It is the landowner that gives permission to hunt on their land. That should be respected and sought as it was in the past. We are all neighbors and are stewards of our land and of game. Without landowners' cooperation and giving permission to access their land hunting would be on public land, WMA’s and more challenging and possibly subjected to quota hunts. Good working relationships with landowners and ethical hunters are the future of hunting private land in Virginia.
We need to repair the damage done by those that abuse and harm our tradition, heritage and image while destroying our relationship with landowners.
I have had armed trespass and removal of game without permission.
I have had trespassing hunters not wearing blaze orange.
Dogs are run along and inside of my property lines and hunt club members position themselves along the property line to shoot deer run from my property to the area they are hunting. They essentially hunt your property and theirs.
By law the hunter must seek permission to recover game. They are also required to not be armed with a firearm, bow and arrow or weapon.
By law the hunter/retriever is required to identify themselves to landowners when asked.
There are sections in the Code concerning trespass with hounds yet it is the landowner’s word against the houndsman and if you don't have physical proof of them dropping the tailgate or walking the dogs to your property line and releasing them intentionally on your land then there's no proof or it is extremely hard to enforce

§ 18.2-133. Refusal of person on land, etc., of another to identify himself.
Any person who goes on the lands, waters, ponds, boats or blinds of another to hunt, fish, or trap and willfully refuses to identify himself when requested by the landowner or his agent so to do shall be deemed guilty of a Class 4 misdemeanor.

Thanks for highlighting the issue with hunting deer with the dogs.
I like you point out that your goal isn’t to ban hunting deer with dogs. Most people don’t care what you do on your land.
However, during rifle season in Virginia east of the blue ridge, there’s a huge problem with trespassing deer dogs and their owners.
These dogs create a safety issue and nuisance for neighbors. They have killed cats, chickens and chased other livestock. Not to mention that these dogs interfere with OTHER HUNTERS.

Most, if not all of the dog clubs do not pay taxes on the monies they collect from their members. The average hunt club member pays between $600-1000.00 per year to hunt state owned property (whitetail deer), and no one reports the income to the IRS. There is a method to report (the same as fire depts., animal welfare groups, school booster clubs), but the state and IRS ignore the failure to report by the hunting clubs. This is a real issue, that shouldn't be ignored. If the hunt clubs paid their fair share of taxes, the monies could be used to hire more conservation officers to contain the chaos, or the money could be put into a general fund for schools, hospitals, highways, etc. Instead, landowners who receive thousands in cash for large leases, go without a 1099, or other method of accountability to the IRS. If I ran a animal welfare group, community organization of any kind, I would be angry as hell to think I'm required to follow the law, but hunt clubs who raise money for personal enjoyment get a break from the state and federal government taxation. Think about it the next time you file taxes for your small business, daycare, or animal rescue organization...

We live in Courtland VA on a small piece of property with just under 8 acres. This is a continual thing YEAR round and daily. Whether it’s hunting season or not. We are completely tired of it and have exhausted all efforts. We have caught the dogs many times over the years and the hunters do come and get them (possibly several days later). We have asked for them to please keep the dogs off our land. We have left notes at their hunting yards on our road. We’ve even carried dogs back to the dog yards and just stuck them back in pens or tied them up on our own because we simply don’t feel like waiting until someone will eventually come to pick them up. Something needs to change to protect us and our property legislatively. I have horses and a breeding facility here. The dogs were chasing my horses yesterday. I am an animal lover, and do not have it in me to harm these dogs for chasing my livestock. I just wish the owners were held accountable for their animals, just as I am for my own dogs and horses. Dealing with this year after year, after year is truly irritating. Let’s make a change!!!!!! Make your voices heard !!!!!

A well done video that expressly conveys the concerns of landowners and of how their privacy and property rights are violated by dog hunters and their dogs.
I have hunted with clubs, and I know their tactics.
Tracts of posted lands off limits to them present refuges for game as the season progresses.
The thinking towards the end of the season is that they've essentially worn out their own lands and leased properties, either by killing or chasing away the bulk of the game (mostly deer). This creates a desire to sneak dogs onto the protected properties, either by direct drop offs in remote reaches of the properties or by allowing their dogs to keep going when they do cross boundaries.
While it is true that deer dogs, especially "green" ones that have fresh legs and haven't been run all day, are hard to stop and catch; as some people in the video eloquently expressed, "How and why is this my problem?" It shouldn't be. Current laws throw all inconvenience and burdens in the corner of the property owners, and give all benefits and conveniences to the hunters.
The property owner must, by law, allow strangers onto their private property.
The property owner must prove any and all damages incurred.
The property owner must be home or present to do this and be aware of the intrusions. This factor alone makes me not want to leave my place for the entirety of the season, because I know they'll take advantage of my absence.
The property owner must witness, and preferably document intrusions, damages, and incursions.
    The hunters responsibilities?
Do not take a firearm onto the private property while you and your dogs are trespassing.
Do not block the landowner's driveways or roads.
Do not shoot from ditch line to ditch line when parked in the right of way adjacent to the private property.
I will add that as soon as the cool nights start, hunters start releasing their dogs to run all night and until they choose to round them up.
They also train the dogs in the Spring, when fawns are vulnerable and when a peaceful morning of turkey hunting can be upended by a pack of hounds chasing deer.
Yes, deer. The fox hunting thing is a loophole. Dogs can't read posted signs, and dogs will chase deer, foxes, coyotes, bears, and bobcats indiscriminately.
Thank God they don't have fishing dogs!

We run dogs here in Arkansas, but not like this. My hunting club has thousands of continuous acres leased, so the dogs rarely get off the lease. We never shoot off the lease or across county roads. We certainly don't presume full access to private property.

This is absolute reality for Virginia landowners. The examples of malicious damage and verbal abuse to us and even our children is common. In many areas, the hounds are allowed to run all night so its not just a weekend here and there. In addition, still hunters routinely have their hunts ruined by the constant hound and retrieving hunter intrusion. It is also unsafe. The videos of road hunting could be taken anywhere in the eastern half of Virginia. Beyond dangerous. The video doesn't even talk about hound hunters routinely blocking roads for various reasons.
Those having problems with hound and hunter trespass are also invited to check out the Virginia Property Rights (VPR) and the Virginia Property Rights Coalition (VPRC)

I really like the video. I do wish it had included the problems we are facing with bear hunting with hounds. I was attacked by a bear that was chased by packs of hounds through my posted property. I was working on my farm minding my own business when this happened. The exhausted bear fought with the hounds in the creek injuring several dogs. The bear climbed the stream bank and charged me. I had been watching this horror show from the bridge where my tractor was parked. I went to the hospital where blood stop was used to control the bleeding. I had to undergo rabies shots. The CPO showed up the next day. Hunting bears with hounds is absolutely dangerous to people who are inadvertently in the path of a bear fleeing hounds.

Let’s tell the real truth here, The ONLY reason Cumberland va was so high in complaints is your parents made 80% of them and keep in mind, no tickets were issued on claims they made… I really wish the truth was told better in your video than what you put on there. Several videos from the Carolina’s were used while you were referencing Virginia in which different things in the videos are legal there. The last video you posted when you were hunting on your family farm that you grew up hunting(actually only bought just a few years ago) you came in from out of town and killed a target buck in just a couple sits that had been there for several years. Maybe the dog “trespassing” is not as bad as you make it seem?

Also the fact that law enforcement is finding no issue is a testament to the responsible actions of the hunters. As a Virginia property owner I can fully say that this video is a biased, one sided misrepresentation of a wonderful state and hunting community. The video is pure misinformation and should be removed.

Steven, that's what happens when the wild resource is managed by bureaucrats. Virginia DWR is pressured by special interest groups for opportunity vs quality. Virginia could boast both, great opportunity and world class animals, but instead they allow a 24/7 fox chase season during key nesting and fawning months. The wildlife is under high stress year round and many young bucks don't make it... As long as the Virginia DWR decision makers continue to allow abuse of private property it won't improve. Thanks for watching!

Chase I don’t personally know you but can see you have a passion for hunting big mature whitetails along with other hunting and that is what you love. You moved out west to do exactly that. But let’s be realistic I’ve never seen a fox dog break up a turkey nest or catch a fawn like you are claiming. Virginia is a great state that you can kill mature bucks in you showed that in your video hunting down here. This year the one buck I killed was a big old mature 6.5 year old deer. Yea a pile of young bucks get killed but it’s all in what each different hunter wants. A person doesn’t have to shoot them if they don’t want. You are doing exactly what the democrats do pushing narratives to fit your agenda and don’t care how many you hurt along the way. You definitely seem like you have sense than your parents, you moved because you saw an opportunity to go film and chase giant midwest whitetails they bought a 90 acre tract a few years ago(your family farm you supposedly grew up hunting) along with the other 40 or 50 or whatever it is that a dog hunting club was leasing. This is dead in the center of literally of 4 of the biggest hunting clubs around. We are talking, lets say yalls 150 acres in the center of 30000 if not more acres of dog hunting leases. Then they sit in the truck, hours on end watching and cant understand why they see dog hunters stopping to do what can be to keep dogs from going on the yalls property. On Christmas instead of trying to enjoy time with family they were sitting on a tailgate hoping for santa to drop a dog off they could catch and try to sue someone. For instance, The time you messed your dad’s car up down at the bridge, believe it was a local dog hunting member that took you up the road so you could make a call to get it straight. But yet you still make us all look bad. Everyone isn’t perfect and everyone has opinions and doesn’t agree on certain things even between bordering clubs. If you have problems try and talk it out set up a meeting with people to try and fix the situation before everytime the DNR is called and time and resources keep getting wasted on bogus calls.

As a landowner and hunter, I don't see a reason to maintain the right to retrieve. It has been abused by a few negligent clubs and individuals. I've had trespassers on my property and blocking my driveway. I've had them stand on my property and tell me "I've done this for x amount of years", I've had them make excuses about being a "guest member" for a club, "not seeing signs". I watched a guy just look at a sign and shrug and just walk on my property. I have pictures of them standing in the road facing the opposite side with firearms in hand. That doesn't even account for the ones impeding traffic on public roads. I've had dogs being run on my property on multiple occasions. They have run night and day chasing deer and left to run. I've called dog owners to say I've got your dog only for them to reply," turn em loose and they'll come back or we'll get em later. "

I own a large plot in south eastern Virginia. My husband and sons are huge hunters. They spend all year planning and prepping for hunting season. We have several children and every year I have the same concern. The dogs NEVER stay back in our woods requiring myself and daughters to address the impact they have on our daily lives. Every year, we have pictures of them on my deck, in my chicken coop, in my pasture with my animals. My dog always gets into a fight with them because they are inside my fence. But worst of all, the right to retrieve requires me to allow complete strangers (95% of the time grown men) on my property to retrieve their dogs. I have children, specifically teenage girls. I don't know you or your background. This law requires me to let complete strangers, potentially sex offenders, around my property and my children. So my question is. Would you let a complete stranger, that refuses to give you their name, with out proof their animal on your property, around your daughters. The first time one of my kids are attacked I hope the law gets to you before I do.

The use of tracking collars is simply a tool to the hunter. Yes most models are able to tone or shock to stop the chase. But there are lots of times when it just doesn't work. I have seen this not work in the ways it should. When I was young tracking collars was not a possibility for use. I ran dogs with my family and never had any problems with trespassing or retrieve. What changed. I currently hunt with a club that uses dogs to hunt with and not just for deer but other chase seasons as well. But yet all I have heard complaints about is the deer season.

    This video is dead on.
I was a third generation hound hunter. My father and myself quit because of all the abuse we were seeing on our land. Todays hound hunters can’t survive without a truck the road to hunt off of and a gps collar. The standers no longer try to stop the chase when the dogs are leaving the hunt clubs leases because of these collars. Hound hunting today is nothing like it was 20 years ago when I was young every stander had a leash and we tried to stop the chase.
We deal with it all year long. People know my stance and they come right up here and turn loose every chance they get. Spring Gobbler season being one of the worst times. If DWR cared to help at all they wouldn’t allow this out of season running all year long.
I have a pending civil suit with a hunt club. I could care less if I spend every dime I have .I will use my land in the end the way I want.. I would except these civil suits to increase with DWR refusal to help us. Eventually DWR will become liable. I look for the Agency to be sued by private landowners over hound trespassing and giving away our constitutional rights!

If that blip is there it means you have my dog. I’m going to call my dog as much as I can. And use recall. But ultimately if my dog is in peril and you refuse to help or allow me to get my dog… my dogs life could be in danger and I’m going to get it.

That doesn’t mean, oh go ahead and walk through my property. Should be consequences for not being able to control your dog. People buy a hunting license to hunt and the state is supposed to use that money to buy more public hunting areas for people to hunt on. These states take that money and waste it on other things? It leaves nowhere for hunting except near private land. There should be more land purchased for public hunting each year in each county to provide a place for hunters who are paying the state in order to hunt

Half cant hit the deer they shoot at to even stop it. It does really suck cause these hounds go in and end up running deer out then getting shot. I use to enjoy hound hunting but the road hunting and disrespect have just gotten out of hand. Gps has made hunters lazy. Constantly watching a screen. Instead of out the truck in the woods listening. Hound hunting back in the 80-90s is way different from now. Thats when it was actually hunting. Now its loke a video game for people that cant get out of a truck or want to shoot in middle of a road.

I believe he did let the other side present, he presented, "It's none of your fing business." By the way the dogger's boots appear to be merely slipped on, wouldn't that make venturing away from the truck or catching a dog difficult at best? This video is not a hunting video, it is about private property rights. It's not about interactions between people at a public park. It is about trespassing on posted private property either by person or the person's agent AKA the dog and the damage it is currently causing. Plus, you have to remember the elephant in the room, private property rights are a fundamental part of the US Constitution so the other side's position isn't really relevant. However, if you do want to take issue with only presenting one side or point to an argument, lets take a deep dive into dog ownership and the dog's contribution to its care. A dog tethered to a chain cannot provide its own shelter from the elements, get its own food or water, or provide its own vet care so constantly spouting a dog can't read is only presenting one shortcoming. In reality, all these items fall under the owner's responsibility including staying where the owner and dog have permission to be.

This video leaves out important facts about the right to retrieve law. I suspect intentionally to spread misinformation. You can not be in possession of a firearm while retrieving a dog and you can not drive a vehicle on to a property while retrieving a dog. A big issue in the state is that there are a lot of people moving to Virginia from states that do not have a deer dog hunting season. They do not understand the long standing traditions and laws to protect those traditions. Keep in mind that many of the founding fathers from Virginia including George Washington were avid dog hunters. Chase created a completely bias and one sides video to misinform and mislead viewers. If either were the case then law enforcement would intervene and this would be a non issue. But I guess that doesn’t help your narrative does it? Secondly as you challenge me to familiarize myself with the law, let’s discuss how your video completely contradicts the law as you claim that hunters who are exercising RtR are not required to identify themselves. Quote “Any person who goes on prohibited lands to retrieve his dogs, falcons, hawks, or owls pursuant to this section and who willfully refuses to identify himself when requested by the landowner or his agent to do so is guilty of a Class 4 misdemeanor.” Maybe you should familiarize yourself before trying to push such a false narrative. The hunting community as a whole needs to be united as all of our rights will be stripped away if we are not careful. Instead people like you want to shine a bad light on one group because you have a different view. Your video is a biased attempt to cancel something because it doesn’t suit you. How about how they don’t even have to prove the dogs are on your land? For a group that acts red nothing about using my land as communal property is red or having a lack of accountability for a group that pushes the dogs through 20 days of a 42 day season? Kirby is gonna love when the complaints go to over 5k at the end of January with the new complaint tracking system implemented. Once this case leaves the Virginia Supreme Court and goes federal it will get repealed. How about they put to to a vote at the state level next election and then we can get a grasp on the amount of people that think it’s acceptable since apparently it’s a small percentage that don’t. If you think a tree farmer is going to let you ammend the soil to a point food plots are in abundance for still hunting you are highly mistaken, so that leads to the legislationthat will follow using taxpayer dollars to cover those losses. The right to retrieve is there with strict restrictions on how you can retrieve your dogs and any hunter doing so will not be armed as per the rule.
