We just need to make sampling legal imo. If it's transformative in nature then there should be no good reason to say that a sound used in another song is claimed only to that song
Sampling is legal, but only in certain cases where everything has to be cleared

but then you have artists work hard for years in order to hone their ability to play instruments and compose music who are making songs, and then someone else can just take that work and use it in their own song, and make money off of it? That seems super unfair.
If you want a certain part in your song, why can't you just make it yourself? Why don't you just go play the guitar, keyboard, drums and sing that part? oh you're not skilled enough? that's why you pay the person who *does* have that skill money so you can use their work in yours.
Tiny little samples that are heavily edited? sure, but people sampling whole large pieces of other songs should have to pay the rights, because they are profiting off of someone else's hard work.

I don't think it should be illegal, but what you conclude is exactly what frank dukes does: creates instrumental tracks, some of which contain elements that sound very very similar to existing works, for hip hop producers to sample in their tracks to avoid the jig of clearing and paying for "established" samples. I can see (hear?) why yeasayer would be pissed, but on balance of fairness, frank dukes is a talented guy who has created other tracks that are wholly original, with some simply harkening to an established musical aesthetic (which uh... is illegal i guess now, in light of the "got to give it up" lawsuit)
Even IF he sampled the track this is a DANGEROUS precedent to set. Sampling an artist without credit is still kinda a slippery slope I guess but artist have been sampling shit from each other for so long. Its part of the culture at this point.
Can someone explain to me why people are spending their lives trying to find miniscule petty opportunities to sue other artists, wasting the time they could've been making music? Especially in this case, where it should be obvious for the author that it was not the same sample. And even if it was the same - what's the difference? In my opinion, it would be fair use, as the song woudln't be created around that sound at all, it would only be used as a tiny detail.
I hate our current copyright law. If you are successful, someone could file a case against you (and have a decent chance of winning) even if you weren't using ANYTHING else rather than your own work. No guarantees here.

I actually really like Yeasayer's stuff, a lot of it took multiple listens to really grow on me but they've put out some amazing stuff. Sucks that some person working under their name felt it'd be worth their time to pursue this lawsuit though.
Music is Music. There are only 12 notes in the musical alphabet. It’s about making something different than what other people have done, using others solely as an inspiration. Unless someone makes a note for note copy then you can’t sue them.

All those lawsuits are just a way for some irrelevant artist to feed one known artist's popularity.
For example the Katy Perry lawsuit. Nobody had ever heard of christian rapper flame but now that they had their stupid lawsuit his song racked up so many plays on Spotify and a lot more people know him.
