      well spoken and well said Dan,
      I upload most of my Japanese Robot mecha 2-in-1 stop-motion and instruction videos which are aimed specifically for adult collectors only because I spent I don't know how many hours I looked through my videos and I had to make some changes to them which makes me feel very, very, very sad. I enjoy sharing my Japanese robot mecha videos, Pokemon card videos and my Transformers videos on RUclips and sharing them with fellow adult collectors from various parts of the world. I understand where you're coming from I honestly do. what also upsets me is that no-one can comment on other adult collector's videos, etc. Its a terrible disaster.

      I left this comment for the FTC:
      This regulation is a huge overreach that will have the effect of taking good things away from children, not helping them. This will hurt small, independent creators of content for children while having no effect on giant corporations who are big enough to get their own sponsors. Huge amounts of educational and entertaining content for children produced by these creators will be wiped out overnight by this rule. That is not good for the creators and not good for the children.
      The internet presents wonderful opportunities for small, independent people who aren't wealthy to produce content and reach an audience that was impossible years ago. This rule is attacking the personalized advertising business model that makes that possible. Parents are the people who should be making the decisions on what their children can or can't watch. No rule should be passed that has the effect of removing content, taking away anybody's choice to watch it because it no longer exists.
      Children are not being harmed because a video they watch happens to have an advertisement on it directed at children. Children's programming on TV obviously has lots of advertisements directed at children. All the FTC is doing here is attacking progress and a new technology. They're attacking a new and improved way of doing advertising that they do not seem to understand. They're not understanding how new business models on the internet have awakened opportunities for creativity and communication between vast numbers of creators and viewers that did not exist before. The FTC has no business getting in between people who want to create harmless videos and people who want to watch them and stopping them from exercising their free will. This rule is unnecessary government overreach that the American people did not vote for, did not ask for and do not want.

    I got to be honest I never really thought about this channel as a kids channel more of just a channel for older collectors

      It's not, but to ensure compliance, RUclips doesn't have much choice but to err on the conservative side when it comes to flagging this type of content. Besides, the situation would still be complicated for a creator like Dan who features both adult collectibles and actual toy products aimed at kids (even if he does both for an audience of adult collectors).

      In all fairness, that's probably because the FTC isn't likely to disinguish between them either. To most of the general public outside the toy collecting bubble, toys are for kids and only kids

      yup i wouldnt have thought any kids today would watch channels like this. maybe the kids of adult collectors but not random kids watching 40 year old toy channel's

    I have only had a few comments like this so far, but I still feel the need to address this. So consider this my blanket statement on the matter of “RUclipsrs whining about losing money.”
    1) The perception of “this should be a hobby” and “this isn’t real work” is a really negative way to generalize content creators. It’s not fair to anyone who spends their time doing something they are passionate about, and you should really consider changing your outlook.
    2) Not that this should matter at all, but I DO work a 40 hour/week job outside of my Pixel Dan job. I’ve been at this job for 16 years. But Pixel Dan is STILL a job. I spend just as much time, effort, and MONEY on this. And the government sure does tax me for having an independent business. So don’t come stomping in here like you know me and accuse me of “begging” or “whining about losing money.”
    3) If your whole feeling is that I’m begging for money, you obviously did not pay attention to this video. This is not about just losing ads. The punishments are far greater. I have been on this platform making content since before making money was even a thing. I made content for a solid 5 years before I saw a dime. This is about much more than that.
    4) Be better. Don’t be so quick to judge people. Everyone has passions, and we should be encouraging people to do the things they are passionate about.
    That’s all. I shouldn’t waste my time on this, but I’m all fired up over protecting this thing that I care about so here we are.
    Most of the comments are amazing, well thought out, and inspiring. And I thank you all for your continued support and your kind words.

      @@scribblingjoe Its still on the parents! There is a RUclips KIDS for kids under 13 if parents are letting their under 13 kids on RUclips main its still on the parents. Either way, if parents let their kids on RUclips they are basically giving permission end of story.

      RUclips has already done everything they can under the law, and the law is all about 'Parental Consent'; handing the device to a kid and _allowing_ that kid to watch RUclips sounds like consent to me. I don't understand what the problem is, smh.

      In this particular case, it doesn't really matter what RUclips does or doesn't do. If the FTC decides someone's in violation of COPPA, they're going to come after them and if RUclips gives specific advice over what is or is not safe, they're likely to risk somebody trying to hold them liable for that when the FTC disagrees and comes down on someone for something RUclips said would be approved. They're being vague and general because they don't know what the FTC will do any more than anyone else.
      The only really defense, for RUclips and content creators is to err well on the side of caution and not post any content (at least without flagging it as kids only) that might possibly be considered to be aimed at kids in any way.

      @Hello There Trump was the one who allowed this to happen, he's no different than the Left. He is a DEMOCRAT. I told these ignorant Trump supporters that when Trump signed FOSTA / SESTA that this would be a slippery slope and it would eventually reach other social media platforms. Ignorant Trumpers called me a pedo and a pedo defender if I was against this bill. They're being hoodwinked just like the Left was under Obama. Trump used the SAME LIE to fool these gullible supporters too. This level of naivety is too hard to counteract. The people are too dumb down to figure any of this out. The government always pulls on the heart strings of their constituents to take more liberties and freedoms away. And in this case, this is what the Left and Right have done (using the same deceptive tactic) to infringe on your freedoms online :
      *2A (Dems.) = We must regulate guns for the **KID'S SAKE** (school shootings)*
      *1A (Reps.) = We must regulate the internet for the **KID'S SAKE** (child trafficking)*
      Trump did say he was the LAW AND ORDER CANDIDATE, I guess we're starting to figure out what that means. He's pushing for more draconian laws and tighter regulations online under the guise of trying to stop child trafficking. No different than Obama using mass shootings to push for stricter gun laws. Folk are gonna get what they deserve for trusting any of these crooks in suits and ties in D.C.

      Which is why channel creators shouldn't feel entitled to collect data from kids to push ads onto them. If you create content for kids, you shouldn't be collecting data or advertising to them anyway.

    "Should we really be advertising to kids to begin with?" Well haven't they always? Cartoons always had toy commercials. Comic books had advertisements galore for all sorts of stuff. It's been this way for at least 80 years.

    While I haven't always agreed with the personal perspective of RUclips content creators, I agree with them all on this issue. RUclips is really screwing over creators because they don't want to work at finding a better solution. I'm a 45 year old married man with no kids, and most of the RUclips I watch centers around toys, comic book characters, and video games. I really think RUclips, like many other companies, has no idea how big the adult collector community is, and how much we enjoy interactivity. It's ridiculous, and there are probably more children watching PewDiePie, Jacksepticeye, Markiplier, and the like than there are watching toy channels, but you can bet all those guys will be safe.

      I think even the big channels like the ones you just mentioned will be affected since this whole ordeal covers anything that kids might like, including videos by Markiplier or Pewdiepie. And of course whether or not the video is truly being aimed at kids or something kids would like doesn’t matter. That’s up to the discretion of RUclips and other higher ups. I find it funny how they don’t want videos that kids might like or are aimed at them but at the same time don’t want to us make videos that aren’t kid-friendly or that go against Google’s political views. And of course they’re vague about what we can and cannot do. I’d argue that nearly every channel on this website that makes videos is under threat due to this ruling.

      alison madell I believe that Netflix will go out of business as more and more people move to Disney + and Hulu. Disney will continue to buy more intellectual properties and possibly buy Netflix themselves when they are close to being broke and then liquidate the assets such as Stranger Things.

      "Kids" arent supposed to be on RUclips, you have to be 13 to make an account.
      RUclips could fix all of this by just stopping the data collection and targeted ads. they wont.
      Dan and others should just go and make their own websites, and collect no data. Obviously a toy website could attract toy ads or sponsorship without collecting if its kids or adults watching. Or even just make a $5 a year membership or something (Like Giantbomb did for their video game website).
      I just wonder - if you come after toys, and games, and comics -- are you also goign after videos about ice cream? Justin Beiber videos? Kids music channels? Anything a kid is into right? So you could have Shell Silverstien reading his poetry on a video - and that should go away? the Giving Tree is aimed at kids!
      I really see this as everyone should just abandon shitty RUclips and Google - they knowingly broke the law and made millions - literal crooks - as bad as any Mafia cartel. (minus some deaths I suppose, (or not?)). Just get a video platform that doesn't mine data!

    you might not see this, but you honestly NEED to read the actual COPPA law, and then rewatch your video around the 10 min mark, but let me boil it down here...
    NO CONTENT CREATOR can be in violation of COPPA, because NO CONTENT CREATOR has access to their viewers personal information, COPPA was created to prevent WEBSITE OPERATORS (owners, manager, webmasters) from collection first and last names, home address, social security number, telephone number, online contact information (email) etc. YOU as a content creator do NOT get access to that, you only get broad blind data that X% of your viewers are male / female, from this county or state, and are of XYZ age groups.
    What happened in September was YT tried (and failed) to push blame on the creators when it was YT themselves collecting data, and YT is literally using scare tactics (and winning right now) by trying to convince content creators that this is all your fault and YOU are the only ones to be held liable going forward.
    There WAS another FTC thing years ago called COPA which WAS about content, but that was literally shot down and squashed because it was deemed unconstitutional, COPPA since it's inception in 1998 was and is ONLY about collecting data from kids under 13, NOT any type of content, and if you read the actual stuff on the FTC website you will see NOTHING is changing, and nothing has been changed where COPPA is concerned.
    You are 100% correct though the entire landscape of YT WILL be changing, and it's been changing for years now, YT does NOT (nor have they EVER) cared about homegrown creators, they used people like you since the site first opened to gain the viewerbase, but their end goal has always been mainstream creators IE TV, Movies, Music, News, and THAT is what they promote most, and that is what they only want on the platform, Mainstream is how YT can get the bigger ad money and that is all they care about.
    This does NOT mean the end of homegrown content though, you simply need to leverage your audience off of youtube IE social media, make sure ALL of your viewers are following you on Twitter, Facebook etc, setup a Patreon to make up for your 60-90% loss of YT ad revenue after January, and everytime you post a video make sure you blast it to your socials and get as many followers to share those links, there will always be ways around RUclips's unfair practices, it's just going to take more work moving forward.

      Then why does The Verge report that "Under COPPA, the FTC is entitled to seek $42,000 for each mislabeled video." What does that have to do with RUclips? RUclips cannot make the government fine people. That's the government's decision.

      @@jedijones it's very simple, because RUclips made the claim, RUclips = GOOGLE, GOOGLE = a 'trusted company" and most "news" places are far too lazy to fact check these days.
      Don't take my word for it though, goto the FTC website, type in COPPA and read the actual law for yourself, read how since 1998 there has only been TWO rounds of changes, and BOTH of those have been "wording changes" because of changing / changed tech IE 'online contact information" was extended to include an email address.
      Also look and see that since 1998 only 33 violations have ever been enforced ALL to major companies because... as the law was written AND is enforced, COPPA ONLY APPLIES TO OPERATORS / OWNERS of ONLINE COMPANIES. NOT individuals who upload videos to RUclips.
      The fine talk from RUclips and ALL who parrot it back to others is nothing more then a scare tactic from RUclips to help cover THEIR butts, IF your videos are NOT marked proper then RUclips will collect data from those videos and CAN be in violation again, so if they purge all those videos no more issues, don't want to have your video purged? Scare tactics will help change that.
      Again, just read the actual law and NOT some vague as always crap RUclips sent via email and parroted in their 'official video'

These bureaucrats themselves are admitting that these new enforcement tactics are GAME-CHANGING, see: Andrew Smith, director of the bureau of consumer protection: “we are holding a platform liable under COPPA for content posted by somebody else. That’s a really big deal. And if you think about all the platforms out there in the world and the economic power that they wield and the amount of content that they host, this is game changing.”

      @@RB01.10 correct, and it HAS been updated, last time was... 2013-2014 if memory is correct (FTC site shows all the updates) but at the end of the day, COPPA is ONLY about collecting personal information from kids under 13, and THAT doesn't change no matter what changes the internet has gone through or how much it's grown, as new methods of tracking and collecting data pop up COPPA does get updated.

    I honest think you and other toy reviewers, as well as any other content creators concerned about this, should get together on a vocal, protest campaign online to show everyone how this COPPA act is unreasonable and draconian. At least show up how they're trying to mess up honest workers by strangling their incomes.

      That's what they're doing, but they can't provide many of the features they do without data mining (which is why those features are going away for content that is tagged "for kids". The entire way the algorithm/targeted advertising/notifications/recommendations etc. works is by matching that stuff to your individually stored user information.
      That said, even if RUclips does ramp down on that, it will still have no bearing on what the FTC does.

    We have watched you for years. The FTC guidelines will discourage creators from making family friendly content.
    The FTC still won’t answer 1 question. Why are contextual ads better for kids than targeted ads? Targeted ads are usually more appropriate for the viewer.

      Reagan deregulated that law, which brought us all the great eighties cartoons that were on some level an advertisement for a toy or game. That changed in 91 when the FTC decided that marketing to kids was a bad thing. And we're still feeling those effects.

    RUclipsrs with content that includes toys, games, cartoons, etc need to unionize, hire council and file suit against RUclips or at the very least get a legal opinion and very clear set of guidelines on what you can and can't do. Love your channel, stay strong!

    Yeah this is why I'm worried, my channel is all set as "not made for kids" as it's all about Nostalgia but I just know something is going to go wrong and it's going to be a struggle with us making the type of vids we do. My channel is definitely family friendly and my subscribers kids watch it...but it's not aimed at kids at all. Good luck to all of us nostalgia channels

      Yeah agreed, i mean its like if movie studios only could do G/PG and R/NC-17 Rated films, its either kid friendly or its not, but there is a middle ground with PG-13 films and there needs to be a middle ground for "PG-13" RUclipsrs that make content using toys or characters that are popular with kids

      @NoBrainer Languages Well, data collection being illegal is ridiculous. You think Hasbro, Mattel or other companies don't have data on what kids like and what they're buying? Even libertarians like John Stossel aren't scared of data collection for the purposes of advertising. People like the fact that their computer can track their interests and give them ads relevant to their interests rather than random ads for adult diapers or whatever. These laws need to get with the 21st century. Targeted advertising is a huge benefit the internet gives for everybody and isn't harmful to anyone.

My childs have to respect me. And I have to decide whats the best for my childs, yes this is not always easy but it works. For me its better to watch ads in type of things which I am interested in and my opinion is this is also good for kids because then the dont see any stupid stuff.       BTW my childs know that they are not allowed to create a youtube account so they will not make this until its allowed and they know what to do thats it, that parents responsibilty and this is good
      Every time when we rent buy or rent a film over amazon. I say to my childs the one who click on the purchase have to pay it. Guess what happened ?
      They said oh no I dont click because than I have to pay it, dad pleade can you gonna click and buy it so thats also a kind of parents responsibility.
      ...... sometimes they also click but as said the one who click have to pay for it for us to enjoy

    I do reviews on my channel of mostly horror and sci-fi related toys from movies that kids shouldn’t be watching. Can’t believe this is going to have to be an issue going forward

    I’m shocked by the shortsightedness of the way this act is acted upon. I’ll keep watching and enjoying your videos as a 40 year old toy collector and will rewatch all your turtles stuff in the first months of next year, because I love those videos and I know they exist, even if they don’t show up any more.     Oddly, I checked my YT analytics today, 200+ million views on my YT channel, the vast majority have always been under 18, though the videos were aimed at people who are older. Analytics now says that just 4.5% of total views come from kids🤔 It's kinda odd, but I have now hit the button to say that all my videos are for over 18s. I feel for all in the toy community and hope this is resolved asap.

    Blatantly "all ages" educational content creators are in the same bind as well. I'm hoping RUclips and the FTC realize that "all ages" is a thing.

      While alternative platforms are likely to get less initial attention, this issue is likely to follow content creators to whatever platform they use.

      @@timf7413 not unless the company is independent and not corporately funded. This is a formula weve seen time and time again with companies both on and offline. You start as an independent company, then its bought off by a corporation then controlled by the government. After that you move to the next one. Hell tiktok is as if not more popular than Instagram now plus competition for Google and RUclips would be healthy. Imagine if bitchute is bought by Amazon? It be on par with the console wars.

      That's what a lot of people aren't getting though. This has little to nothing to do with the platforms themselves and is more about how the government regulates this type of content online. Assuming they follow through with the announced crackdown (and it would be prudent to assume that they will.), it's going to have an impact on all platforms that collect any type of user data. (which is essentially all platforms that have any commercial upside whatsoever)

    This is soooo asinine. Why should content for kids be unsearchable? As a parent, how am I supposed to be able to even find appropriate content for kids?
