Hi, I'm honestly not sure. I would have to see the notice. It's a possibility that it's not bad, but USCIS just need more information about something. Sometimes it is better to get an RFE (in some cases) because then you get an opportunity to fix or clarify or submit whatever else they need rather than getting denied.

They're asking for something I've already sent in so I guess I'll have to send it again. Anyway I was thinking, in the last 3 years we've let in 15 million people not to mention 20,000 Haitians in a little town in Ohio and we have no idea who these people are. Some of these people Haitians in particular are getting a ton of money a month and have been seen driving around $100,000 vehicles like Lexus. Yeah we don't know these people are. On the other hand there are those of us that have spent thousands and spending more currently for example myself trying to get my fiance over here. It's pretty audacious to get pushback for more evidence and in my case alone, My fiance. One person........ It's not fair and a slap in the face for those of us trying to do this the right way and like I said the legal way. They want more evidence and that can be in any case yet it's okay to let 15 million people plus 20,000 Haitians who are getting all kinds of benefits but we don't know a thing about them. In fact immigration probably knows more information about my fiance than the millions of these people that are here illegally. Just facts. It's very very frustrating. If my case alone gets denied, I'm considering contacting my congressman to ask these same questions...

Hi, thanks for your question. It would depends on your agreement with the law firm and the services they agreed to provide. Take a look at your agreement for clarification.
The processing time for responding to an RFE varies; but if 30-60 days have passed and you haven't received a response, give USCIS a call. If you are talking about processing times for the overall case, every case is different but you can get an idea by checking on the USCIS website.
Which is worse :( I got an RFIE. It says online they sent one on 7/3. Its now 7/11. Says if I done get it by 7/18 i have to submit a request online. I dont want to get denied.
@@sahibazizuddin yes i did! It didnt specifically tell me what I was missing. It just told me which application had the error and it just had a full list of everything that should have been included and says i was missing 1 or more of the following. In my scenario there was an error with my affidavit of support for my wifes i-485. Im 100% sure its because I forgot to submit my tax returns. Stupid me. I submitted all of my w-2's, 1099's and what not, but I didnt actually print off my tax return summary. So i submitted everything to the address specified on the RFIE and the online case status updated about 5 days later saying they received my response to the RFIE and they have resumed working on my case.

@@sahibazizuddin i got it 2 days before the date i specified in my post. They said If i didnt get it by the 18th that month to go online and put in a request. I got it in the mail on the 16th. So it took a little bit. Wasnt fast.
In a majority of cases it does mean the interview will be waived, and they may want to make a decision, but cannot because they have not received the medical. Please be mindful this is not so for all cases. We have experienced cases where an interview was still scheduled, although we submitted the medical in response to the RFE. Good luck!
What happens if you checked the status of the case and it says that they sent you the request for initial evidence, but you never actually receive the notice in the mail? My friend has written to them plenty of times since last year May, and they still have not replied. Will they deny the case in such an event?
When someone does not respond to an RFE or RFIE by the deadline, they do run the risk of having their case denied. It is not uncommon to not receive a notice, but you really have to keep contacting USCIS relentlessly, until you get it. Writing them alone may not be enough. I received the RFE on may 08 2023 for me just requesting the medical exam and for my partner they request again prof of marriage etc. we gather all the documents and sent it on June 01 2023. We have been married for two year now (we got marry April 12 2021). My question is, are they requesting all this to send the green card by mail with no interview? Due to the long time marry already? We are just curious and nervous at the same time. And another question, they already received the files (because USPS confirmed that they received the files) but in the USCIS account they have not updated the data. Hi, thanks for watching and for your comment! Well, USCIS doesn’t always update the status to show that they receive RFE response. You can always give them a call to verify if they received it. Also, because they requested more documents doesn’t necessarily mean they want to waive the interview. It’s a slight possibility, but sometimes not enough documents were sent in with the filing so they could be giving you a chance to prove your marriage is real. Don’t be nervous, stay positive!

Hi, I cannot answer your question with complete certainty without actually seeing and reading the notice myself. However, you should consider providing w-2’s for both 2021 and 2022.

Hi, thanks for your question. There’s no way of telling what USCIS is requesting. It could be the medical exam, or something else. Typically the medical exam will be requested after the case is pending for some time, but you never know, they could request it as initial evidence. It shouldn’t take more than a week and half to 2 weeks to receive so just wait and see what it is.
