Based on the original agreement the commission at that price should have been 10% which would have been $26,000, a $5200 difference, meaning Ed and his friend each got screwed out of $2,600.
No, he said the Base Rate was all the Crooked Seller would pay. The base rate is 5% which is $10,750. Divided in two is $5,375. He was screwed out of $7,625 x 2 for a total of $15,250. That is near 75% of the commission. I would have named this Slimey Skunk.

An agreement to pay a commission is no different than paying interest on a loan - Try going to the bank and saying to them after you sign your mortgage contract: “Hey listen Mr Mortgage company, I am sorry but my wife won’t allow me to pay you 4.3% on this 10 year deal I begged to get approved for - she will only allow me to pay 3.8%” See how that goes.
You have to be paid for your services no matter the excuse or reason if you make the deal happen. Been in this boat on a couple of occasions. More times than not the ones with the most try their best to shit you the worst. But gotta take the good with the bad and move on. And Like Ed said these transactions go a lot smoother and a lot less chance of hurt feelings if the deal is between a buyer and a seller. I compare these middle man/broker deals to a ménage à trois as you can imagine they sound enticing but when done someone in the group participating usually just feels f...... lol

Ed did it as a favor to his mechanic. It was not about the money. As he could have walked away from the deal for not honoring the original verbally agreed commission. But since his mechanic and friend could really use the money. He decided to eat the loss to close the deal. Ed is an upstanding guy. He wouldn’t screw his friends or clients over a deal just to earn more money.

You could do the deal through an bank like an escrow account. Buyer deposits money, seller deposits title of car, and you set your commission percentage. Then when everyone agrees to the deal, all preset items are withdrawn from the account by the different parties. You have set your commission %, price, and car title when the account is established, so there is no way anyone can be cheated. You could probably set it up anonymously as Partys A, B, and C with only the bank and you knowing all the names.
I would love to hear how you responded to the sellers reneging of the deal. Just what you actually told him. Dealing with that type of client I can understand why no longer enjoy it. Really enjoy VINWIKI.

It's usually the ones with money that will try to screw you and squeeze you. I used to work freelance for a time and there were always people who wanted me to lower my already reasonable rates. Told them I had enough work at my current rates and saw no reason to go lower. If they wanted to pay less, I could do less or they could go elsewhere. I also spent some time working as an insurance adjuster. The money I was paying out to clients didn't come from my pocket and I had no great love for my employer, so I always got them as much as I could justify based on policy and circumstances. The regular working Joes were good to deal with and would usually be reasonable about what they could get and I'd work with them if they could justify a change. The ones with money, though...they were the worst. Nickel-and-diming everything and claiming I didn't understand the policy right and blah blah blah. I've known some cool people with money, sure, generous and good folks, but if somebody is going to try to screw you on a deal, it's 90% likely someone with a lot of money. I hope you make back what you lost on the revenue from this video, Ed.

I brokered a few cars from about 2012 - 2015, almost always someone either asking me to find them a car, or asking me to represent a car for them. I got out of it for a lot of the same reasons, primarily disputes over agreed upon commission. The last deal I ever took part in could be a VINWiki story by itself, but I'd be too scared to tell it on such a public forum in case any of the parties involved were ever to find the video.

I Call "Science-Fiction" on his Brokerage Persuasion to the Seller. He told the seller that his Countach was worth roughly $175K then he told the inquiring buyer that it was worth around $400K. Then he tried to justify the Low-Ball offer to the seller by giving him an "unparalleled-comp" that had 30K+ miles compared to his 5K- mile Countach. Anyone who is an Exotic Car Buyer and Enthusiast, Know that there is a HUGE price difference between the two cars. The 30K mile car should not have been used as a Comp. for Assessing Value. Ed's Sliding-Scale Commission would have been a "DEAL BREAKER" for me. Your chances of being "Struck by Lighting" is Better than Finding a 1989 Countach with 5K miles for $175K - $225K. This Video Enforces the Deceiving-Image that Car Brokers and Dealers have.

any business transaction where you are pairing buyers to sellers, you can do an NCNDA agreement for both sides. That way, NO MATTER WHAT, they can never do that transaction with each other without you legally because you can prove you are the one that presented the deal from that seller to that particular buyer. In that NCNDA, you can implement any friends, family, associates, partners, affiliates etc.. cannot purchase that asset either as well because in order to get around it someone can easily have their brother, cousin, business partner purchase the asset instead. I do this for all of my off market Real Estate transactions.

I own a car dealership and often finger print people on contracts I write and draft - this is on various custom made contracts I write. No law firm can come back and say that is illegal but what it does do is that you have a signature and date + finger print. Using a notary is a pain , this works much better. Also, I have learned to protect myself in writing that if we get to a lawsuit and there is a judgement that I am guaranteed payment back. I am giving the broad strokes - I spent thousands upon thousands of dollars to get to this point in terms of having sophisticated legal contracts work for me and my efforts. I would have sued that guy silly. If he signed a contract and dated it with a finger print - I would have taken pleasure in the lawsuit, plus my agreement would have stated that if it comes to that and I win that all my legal fees, also be covered. This guy is very sharp (narrating)...I'm sure he didn't want to deal with getting caught in a law suit that can drag on for 3 years and bleed him of multiple $20,000 retainer calls / demands as all attorneys are pretty much in the "Retainer Business" bleeding their clients dry. That's where arbitration and mediation could come into play where they will look over the signed contract and plea in favor of the broker. To the EUNUCH men out their who have to use the bathroom mandated by your wives - I hope one day you can reverse that tragedy - there is nothing more sad than "My wife won't let me do this or that'. You are only castrated mentally and by being overly passive...pretty sad. Who knows if the classless castrate was telling the truth or not.
Use an escrow agent with the terms of the brokerage deal set forth as distribution terms. Escrow agent accepts payment. Payment clears escrow. Escrow agent cuts two checks. If there is a dispute, escrow agent holds funds until dispute is resolved. You can go silent on owner until he agrees to abide by terms of the deal.
I love folks who try to renegotiate, I say I think I can work with that, and here are my new terms. They always get pissed, then I let them know I won't accept their changes.
In the boat brokerage world there is so much legal paperwork so things like this don’t happen. Industry standard commission is 10% and most people are fine with that. Then some think they can do better on Craigslist and we have to convince them why they won’t do better or in very rare cases drop the commission to 8-9%. But this is always fixed before the boats are ever even listed.

People are always gonna try to cut out the middle man, their ussually a unnecessary step and just drive up cost for very little to no benefit.

I brokered a few cars from about 2012 - 2015, almost always someone either asking me to find them a car, or asking me to represent a car for them.
I got out of it for a lot of the same reasons, primarily disputes over agreed upon commission. The last deal I ever took part in could be a VINWiki story by itself, but I'd be too scared to tell it on such a public forum in case any of the parties involved were ever to find the video.

They are notoriously cheap, notoriously bad about paying their bills and even worse about keeping promises. I am an Exotic Car Owner and Search-Fanatic. And within only 10mins of this Video, Ed Prooved to me, to place little Trust in Exotic Car Brokers. I Call "Science-Fiction" on his Brokerage Persuasion to the Seller. He told the seller that his Countach was worth roughly $175K then he told the inquiring buyer that it was worth around $400K. Then he tried to justify the Low-Ball offer to the seller by giving him an "unparalleled-comp" that had 30K+ miles compared to his 5K- mile Countach. Anyone who is an Exotic Car Buyer and Enthusiast, Know that there is a HUGE price difference between the two cars. The 30K mile car should not have been used as a Comp. for Assessing Value. Ed's Sliding-Scale Commission would have been a "DEAL BREAKER" for me. Your chances of being "Struck by Lighting" is Better than Finding a 1989 Countach with 5K miles for $175K - $225K. This Video Enforces the Deceiving-Image that Car Brokers and Dealers have.

any business transaction where you are pairing buyers to sellers, you can do an NCNDA agreement for both sides. That way, NO MATTER WHAT, they can never do that transaction with each other without you legally because you can prove you are the one that presented the deal from that seller to that particular buyer. In that NCNDA, you can implement any friends, family, associates, partners, affiliates etc.. cannot purchase that asset either as well because in order to get around it someone can easily have their brother, cousin, business partner purchase the asset instead. I do this for all of my off market Real Estate transactions.
Hiding behind the wife, what a gutless move... Ed should've called the buyer and have him drop the offer 10k, no point having the buyer overpay if he ain't getting the entitled commission.

I own a car dealership and often finger print people on contracts I write and draft - this is on various custom made contracts I write. No law firm can come back and say that is illegal but what it does do is that you have a signature and date + finger print. Using a notary is a pain , this works much better. Also, I have learned to protect myself in writing that if we get to a lawsuit and there is a judgement that I am guaranteed payment back. I am giving the broad strokes - I spent thousands upon thousands of dollars to get to this point in terms of having sophisticated legal contracts work for me and my efforts. I would have sued that guy silly. If he signed a contract and dated it with a finger print - I would have taken pleasure in the lawsuit, plus my agreement would have stated that if it comes to that and I win that all my legal fees, also be covered. This guy is very sharp (narrating)...I'm sure he didn't want to deal with getting caught in a law suit that can drag on for 3 years and bleed him of multiple $20,000 retainer calls / demands as all attorneys are pretty much in the "Retainer Business" bleeding their clients dry. That's where arbitration and mediation could come into play where they will look over the signed contract and plea in favor of the broker. To the EUNUCH men out their who have to use the bathroom mandated by your wives - I hope one day you can reverse that tragedy - there is nothing more sad than "My wife won't let me do this or that'. You are only castrated mentally and by being overly passive...pretty sad. Who knows if the classless castrate was telling the truth or not.

Use an escrow agent with the terms of the brokerage deal set forth as distribution terms. Escrow agent accepts payment. Payment clears escrow. Escrow agent cuts two checks. If there is a dispute, escrow agent holds funds until dispute is resolved. You can go silent on owner until he agrees to abide by terms of the deal.
I love folks who try to renegotiate, I say I think I can work with that, and here are my new terms. They always get pissed, then I let them know I won't accept their changes.

In the boat brokerage world there is so much legal paperwork so things like this don’t happen. Industry standard commission is 10% and most people are fine with that. Then some think they can do better on Craigslist and we have to convince them why they won’t do better or in very rare cases drop the commission to 8-9%. But this is always fixed before the boats are ever even listed.
Ed is such a smart and calculated guy all of us think we would just freak the fuck out and then end up spending tons of money to sue to not make as much,shitty situation but leave it to Ed to keep it classy

Been selling cars\boats\Motorcycles for years... I create a sense of urgency in the buyers mind. Here today. It will be gone tomorrow...As I seen these exotic cars deals take months. Just to make $10k Dollars. I can sell 5 used cars in one month. And make that. Without all the drama and headaches. Just have to be good at reading customers...

You know the old saying "The rising tide raises all boats?" Rich people don't believe in that. If all the boats are equal then what they have isn't worth as much.
