I like the defendant! He is a gentleman for sure! My take on this is that the plaintiff doesn't want a land close to a burial ground. He didn't check before paying
The seller would have won the case if he didn't agree to refund the 2m. Clear case of ignorance of the law is not an excuse.

The defendants would have won the case, had he not signed an agreement to refund the plaintiff. It is a simple case. Unless the defendant did withheld information from the plaintiff then plaintiff would have had a case. Defendant sent someone to verify the land, took video and agreed to purchase the land.
Both men are educated and pursed their case in the most civilized manner…. Their conduct and understanding is highly commendable. I commend in a special the legal luminary, she is what Nigeria need at this moment

Another well adjudicated case by Judge Funmi. Also an eye-opener for anyone who wants to purchase local real estate in Nigeria; learn the inner workings of the local chieftain and its customary practices in land purchase in order to enable a worry-free and smooth transaction.
This is by far my favorite episode! Both parties are men indeed, very mature people. Them no stress Judge Funmi at all.

I think this is a case of Mai Angwa (Original owners of the land) customary law which was bycotted when payments of N2m was made. The seller was at fault here for not settling percentage to the Mai Angwa who were aware of change of ownership. As for the buyer he still has the right of ownership for the land as soon as he pays the balance. Unfortunately, he's not interested as bodies were buried. I don't blame him. No one wants to buy a land where bodies will be exhumed.
Customery laws can be very tricky!!!

The plaintiff won by documenting things well but I blame him for not going to verify, I also feel that since the defendant needed the money urgently he might have pressured him into giving the 2m that Man too no talk say burial ground dey the street because he wan sell market. Nigeria 🤣
