- What up y'all, its been a minute and during that long break I received a good ol state ref ticket. Modified emissions, one of California's many ridiculous laws.
I wanted to try and help anyone that is caught in this situation and what the best course of action would be in accordance to your unique situation. I hope you guys find this helpful.

so what happens if the car is registered out of state and your are just back in California visiting.
So I asked a friend of mine who is in law enforcement about this, he said technically an officer can write you a state referee ticket but it will have no chance of holding up in court since you are visiting and don’t reside in California.
Ok... I've seen a bunch of videos now from cali with people getting pulled over... I would suggest running bags, run an electric cutout so you can close the valves in a problem area. As far as intakes, Bov, etc when the cop asks you to pop your hood, say no. You do not consent to a search. But me, I would just move out of that state.

I went state ref for intake with sticker with but officer said “has to be Visual”
If you say no you’ll get your car impounded
They told me if they could search my car and pop the hood and I said I don't consent to a search. They then told me I was disobeying a lawful order and I can be taken to jail.
Can I just register my car in a different state?
you can but you need to know someone that has a house out of state because registration info will be mailed to that address
My friend did that, and when he got pulled over, he got popped for having a CA address on his license, but not matching address on his insurance and registration. They will still get you for this.
late to this but I have a heavily modified 335, me and my buddy were chilling in a parking lot when around 6 cop cars pulled up on us (RSO) said we were doing donuts etc and the car wasn't even on or anything. They impounded my vehicle for 30 days, went to jail and got charged w reckless driving and exhibition of speed and now almost 20 days later I'm finding out I also get state reffed and this is just crazy to me because I only just turned 19 and I have no idea what to do because I didn't even do anything wrong.
Damn bro I’m sorry to hear all that! The best thing to do would be to get a lawyer that knows what they’re doing. If they falsely accused you of doing all of that. Let the attorney destroy their story in court so you can get those charges dropped
Most importantly do not talk to the police with out proper representation(a lawyer advising you what to do and say)

This shit sucks I have a catless m5 that goes to 128db and here it’s a 95 limit I’m scared to drive my car but the thing is with the cats on my car is they are not visible so when my hood is popped u can’t see any sign of modifications yet they mark me it’s so stupid

I got pulled over for the first time ever two nights ago. CHP wrote me up for speeding (93mph) and state reffed me for my headers. Definitely don’t want to deal with putting the car back to stock. I’m debating about hiring fyourticket. Hopefully court doesn’t take too long, I already miss driving my car 😢

You can but you run the risk of being towed in the future if you don't fully clear the state ref on your vehicle record. Just paying the fine will not clear the actual state ref order.
Literally went to pump gas and CHP waited for me to leave didn’t even make it out the lot and he light me up…. Got a state ref and two days later my daily gets total :/

What if the cop wants you to pop your hood and you refuse. What do you know about that. I have a heavily modified Nissan 240sx
According to the law, you are required to pop the hood for an inspection or you can get arrested and towed if you do not, unfortunately
Thanks for responding. I will contact Fyour ticket before my car is done to get some advise about my rights and what I can do if I where to get pulled over for any dumb reason like loud exhaust.. There is no way I am loosing my 240 with that 2jz engine

Can you get it dismissed if the vehicle got stolen ? I have a state ref on my truck that got stolen about a month ago.
Also, I believe my citation says it’s correctable
I have a friend who lives in Cali, emission laws changed and made his car unable to smog. Headers, Trilogy supercharger, etc..
He found a specific place to pass a star certified smog. Next time he went to the same place, when he hooked it up, the computer flashed something about the car being "flagged". So although he never failed smog, or got pulled over for the mods, he was now somehow in the system.
My question is, does anyone know if there is a time limit on this? That was about 2 years ago. He covered his car and has been driving his daily driver ever since. Is the car flagged and permanently in the system, or does that expire? I'm sure he would appreciate any advice or suggestions.
Yup unfortunately if your vehicle fails at ANY smog shop in California it will automatically flag your vehicle and refer you to the state referee. I’m not sure if there is a time limit, I would say no because California emissions is so stupid and savage why would they give us a chance like that(that’s my thinking). It would have to get sent to the state ref and inspected for it to be on the road legally, or he can try reaching out to an attorney for advice as I’m sure he wasn’t the only one that was screwed over by this stupid system.

I got the ticket last year bro, same story as you i wasnt racing was just cruising the freeway not speeding. Went through the ref process it fuckin sucks

@@Virtualcarmeets hey bro, I was banging threw gears on my car with a modified exhaust. Wa barely speeding. As you know the ZF transmission makes that loud gurgle on the up shift. Cop gave me a fix it ticket for my exhaust (no state ref) hoe do I deal with this without actually fixing it? Thanks

bro, i got a “fix it” ticket. and i got it signed off by a cop, paid the fee to the court. and they sent me it back saying i need to get it checked by state reff. i dont even have the state reff sticker on my ticket. its just the ticket as is
Yup, went to chp today for an exhaust ticket and cop said that they don’t sign them off and I have to go to a state reff and also pay that bs ass 108$ certificate so stupid.
I just put a Catback exhaust on my Lexus GSF one day ago and today I got pulled over for loud exhaust I wasn't even speeding going 40mph and he gave me a ticket for loud exhaust and he state reffed me...
I just got reffed back in December and my court date is this month and I got fyourticket on it as well but only thing is idk how I’m gonna smog my car to get my tags renewed in June. Fyourticket was telling me state refs can even take up to a year to fight

@@alonsocortes5546 my cars been reffed in the past by the previous owner. I still do dirty smog cause it won’t pass any other way. It’s a 1990 which makes things easier than a newer car
Hey bro I got State reffed for aftermarket air intake. If I go to the state referee inspection do they only focus on that one thing you got reffed for or like do they focus on exhaust and tinted windows etc?
beware where you go, I was state reffed for modified exhuast and it was stocked and they failed me.

Nothing except put your car back to stock if you want to move past this. If you pay off or try to fight, you'll only end up in the same situation. It sucks man.. but modified cars in Cali just don't mix.

CHP are not qualified to know what is a factory exhaust. So they leave it up to the Ref to judge that and sign off on the ticket. While you are there they will look for other violations related to the emission system and make you fix those as well (CAI, Tunes, Etc) I guess CHP are qualified to know what a modified exhaust is because they right plenty of tickets for that! LOL
So can I just pay the ticket off ? Then make it stock after I’m able to drive it again?
In order for you to legally drive the car with no possible troubles in the future you have to either A) get the car back up to CARB requirements aka stock parts/legal parts & tune or B) Get the ticket dismissed.
You can just pay the fine BUT since you did not get the vehicle assessed and approved by a state referee, it stays on the cars record so if you get pulled over in that same car in the future you CAN get arrested and towed since the vehicle is deemed non street legal
I got pulled over a week ago for my stock exhaust with muffler and resonator delete. It's not straight piped, I still have 1 resonator and one muffler on, and of course I have my cats on, but it did wake up the car up, but not obnoxiously loud. The police officer told me that they are pulling over loud cars or cars that belong to a category of a "street racing scene" because there is one that is going on around my area apparently, but how would I know? I told him I don't belong to that group because first of all I work 12 hour night shifts, and I am a fucking nurse. I told him I wouldn't risk my RN license for something so stupid. I just love cars and that's it. He didn't even do a sound test, and yet he gave me a citation, good thing not state ref, but he still marked the ticket as not correctable so I really have to pay the fine. I tested the exhaust my self, I searched for proper CA sound testing guidelines, and at 3k rpm, my car only goes up to 92.3. WTF.
It is definitely a correctable offense. bill AB1824 was specifically dedicated into stopping modified exhaust tickets from being non correctable. I would go to the court and see what they can do because that officer made a mistake.

If only this video was out last year lol. I was state ref by rso. Was my first time ever going thru the process. But tbh it was stressful bc I had some police officers that didn't even understand what a state ref was lol. So I said screw it, made my car stock, went to ref station, passed. Paid my proof of corrections that the car was legit and passed, sent copies. Boom done deal. BUT It did take 3 months for my ticket to show up In the system bc of covid I assume bc it happened right at the peak time covid hit. So everyone out their, the best bet is to make your car stock and pass legit so u won't have to wrry about any funny business if u do get pulled over again. That's what I would recommend. But the decision is all up to you. But you guys have any questions regarding the process of the state ref, just respond to this comment and I will my best to give you guys a understanding. But this video was great and has good information regarding the ways u could handle. Basically everything I learned thru the process as well! California sucks!
Sorry you went thru the state ref process, I got reffed by RSO too haha they really don’t know what they’re doing as far as vehicle inspections go. I’m glad to hear you got it settled though! Thanks for the feedback bro.

Same question here! Was it correctable or non? Mine is non but I went to state ref and I passed! So can I go in to court to like the clerks office instead of actually going to court to speak with the judge ? I’m not trying to wait another month for court date :(
@@themesican5540 my modified emissions citation was non correctable. You can definitely show up prior to the court date. The citation should say that’s it’s a promise to appear on or before the date on the ticket. since you passed your state ref(congrats btw) you should go to the court and a clerk should get you all set up and drop the case

yes you can BUT it will stay on your record. So if you were to just pay off a state ref fine and not take it to the ref and then get pulled over again, the officer will know about the previous state ref once he runs your information. He can then, issue you another state ref and tow your vehicle. The fine the 2nd time around will be around double what the first one was.

Has to be 100% stock from what I know. They will fail you without mufflers. I’m literally on the web to see if I can find stock mufflers for my car but can’t find any I’m wondering if I have to have the oem mufflers or some silencer mufflers like some aftermarket mufflers that tone down my exhaust note.

i got a modified exhaust ticket yesterday and it is fixable and my first time . In california san francisco . Does that consider state reff? Theres no way i will put it back to stock what do i do? Modified exhaust is good! You can just pay the fine or put the stock exhaust back on and get it signed off. As long as it’s not modified emissions you are ok

The sticker on the back says the car must be taken off the road. I would drive it anyways but if you get stopped get ready for impound fees.

That’s a good question, from what I’ve heard, you don’t need to but it would be a good idea to check with a smog technician in your area.

Do the state referees check only what you violated? In my case i bought a 240 with a sr and waited like 4-5 weeks till I actually went to register it to my name and they told me the car was state reffed but prior to going I got a parking violation but my vin number wasn’t visible because I had my sun visor to protect my 240s dash parked in a permit only residential area? May have this cause state reffed or did the previous owner sell me it with a state reff ?

You can submit a request/application to CARB that states you unknowingly bought a modified car with a state referee stuck to it. I wish you luck man
I just got state reffed today on my way to work for having a modified exhaust. I spotted the officer two lights behind me , driving the speed limit , he just got behind me & pulled me over.. I only have a muffler delete on my 370z. He even put that I have engine modification , & my license plate was missing but it was just on my dash.. do you think it’s worth fighting ?
He also said my car was loud enough for him to pull me over , but I was only driving 55. He was just a dick tbh…

Not sure if you’ll see this but a couple weeks ago I got state reffed, he only wrote me for my cat back exhaust, but putting back on stock exhaust, air intake and Downpipe, just to be on the safe side do I need to pay the fine and go to state ref to get it passed and if I need to I’m able to push back the date to have more time right
He mentioned that as long as you pass state ref that’ll be $100 + $20 in court fees. They waive the rest

That doesn’t work bro, it works for correctable offenses like loud exhaust or no front plate. Modified emissions is a whole different process which can not be written off and requires you to deal with it, unfortunately

@@BLOODYMACZ I did not pay any fines from the citation. I made a one time payment to FYourTicket to represent me and that’s it. Not another dime came out of my pocket since he dismissed all charges

Having a nice car is one thing, but having a loud, obnoxious car that is heard a mile away, and is above 95 decibels, and or heavily modified, is on you too!
It's part of the L.E.O'S job as well, vehicle safety.

I understand your point on those loud obnoxious cars out on the road believe me, Not my taste either. On the other hand “Don’t like it, dont modify your car” is not the solution at all. Officers need to understand the difference between illegally modified and legally modified. I am well aware of the 95 db test from a certain distance. The problem is, most officers here in “task forces” don’t abide by those laws set in place. I have never seen an officer pull out a decibel meter and measure a vehicles sound levels, the fact that they are issuing citations for modified emissions and loud exhaust on stock vehicles or legally modified vehicles is the problem here. It’s not a plain and simple solution. It’s more officer training and respect from both sides that needs to be established.

In Cali the seller has to smog the car. Private seller or dealer. Seller broke state law.

@@__flako As long as the readiness monitors are Ready ,no check engine light, and a the components are stock, your vehicle Will pass at the ref station. And it's only $8.25 When you pass.
