    Last time I got pulled over the cop tried to say some shit like that, “it’s for my safety.” I told him “you chose to be here, you can get in your car and leave anytime if you don’t feel safe.” That shut him up 😂

      One of the main traits of a born clinical sociopath is the need to victimize and control other people...especially, when they don't get their way. This officer is your stereotypical underdeveloped amygdala in utero resulting in sociopathic tendencies like greed, lying, thieving, manipulating, exploiting, abusing, victimizing, murdering.
      "Not everyone born with an underdeveloped amygdala will become a serial killer but every serial killer has an underdeveloped amygdala"
      They go into law enforcement so they can legally abuse and victimize other people per their genetic predisposition. They should be banned from working a slaw enforcement because you don't know which ones will be the serial killers and which we be the civil servants. That's the issue. When they have a genetic predisposition the general public has no idea whether this officer is one of the evil-doers or was successfully nurtured away from his genetic instinct on a daily basis so we're not doomed to live it out.
      Awaken to the science of the brain and its detrimental effect it has on the rest of the world.

      Honestly I find the spray being empty to be the most disturbing part of this video. How many other people did he spray to be so casual bout it being empty? He acted like it ran out all the time! Obviously he makes everyone exit their vehicle without exercising any discretion just as a power trip.

    The mere fact that the officer abandoned all efforts to use force against this guy after his pepper spray didn't work, proves that the officer never felt actually threatened. It was always just a power play, devoid of any actual justification.

      Police officer force isn't always in response a threat or self defense. A reasonable amount of force can be used to affect an arrest or overcome resistance. These 2 were both jerks. I'd give cop a C- and the driver a D+.

      It's not. But if you get a resisting arrest charge before the the arrect gets identified as an unlawful arrest, you can get charged for resisting. That's why it's best to comply and sue later.

      This cop doesn't deserve an F-. If anything, he derserved nothing. He was indeed able to order the guy out of his car. However, he searched his car witout making a proper arrest with was an illegal search. Plus, he made the situation worse over a simple traffic imfraction. Then the traffic stop was a bad one anyway due to him not speeding in the first place. Bro deserves a grade so bad that it's an unknown bad grade.

      You have no right to resist an officers order to step out of your vehicle during a traffic stop. This was decided by the supreme court as stated in the video. This man should have been charged for resisting arrest.

      He wasn't under arrest for resisting a lawful order- Yes it was definitely heading that way, but he had to be under arrest in the first place, can't skip steps.

The SCOTUS has ruled you MUST comply. If you want to argue your case then go to court and argue there otherwise follow his lawful command to exit the vehicle.

    The fact that he turned away to ask his partner if he had pepper spray and didn't seem to be afraid to do so, while also lowering his taser while doing this, invalidates his "fear" he had of the man. If he was so afraid for his safety, he wouldn't take any chance or at least not look away.
    He just wanted the man to comply and got caught up in his power trip. Crazy.

      @@Nan-59 it's not just that he's a jerk. It's that he's bad at his job. He doesn't know how to deal with people. There's nothing about him or the way he acts that seems like he's in a position of some authority. He speaks to the driver like the kid nobody likes in your history class, not like a police officer, or professional of any kind for that matter. Even being an asshole, if he'd spoken to the driver like an adult, he would have at least been more likely to be taken seriously. As it was, the driver saw and treated him like a joke because he was acting like a joke. Wishy washy unprofessional calling him dude, and he kept giving ultimatums then not following thru when the driver didn't care what he has to say. So he just kept losing any shred of credibility he may have had up to that point. Cop seriously has a lot to learn. If that guy can get him all twisted up n flustered n not knowing what to do, if he ever has to deal with an experienced bad guy who's done time, he might end up walking back to the precinct in his skivvies.

      @@marvingonzalez926 it's usually closer to around 6 to 9 months and then a few on the job months training. It's not completely the length that's the issue. It's the quality of training. A lot of the departments are not funded enough for actually good training. One of the reasons defending cops will just make things worst sadly. It's also a hiring issue, departments take people who are not stable and or racist in certain areas. It's am awful combination.

      I hate 'contempt of cop' reactions as much as anyone. But at the same time, many times at traffic stops it's gone from a seemingly harmless guy just arguing with the cop amount a minor offense to him grabbing a gun and shooting the cop. If the cop wanted to pull him out for safety, the driver should have complied. Was the cop being a jerk or did he really have concern for his safety? Or both? Hard to say.

Yeah, so did his supervisors and upon an internal investigation they found out this guy and the 2nd cop that was there were playing a game where whoever pepper sprays more people wins. The reason he is out of pepper spray is because he has already sprayed many others in a traffic stop. "wE aRe MisSiNg CoNtExT" is a bootlickers excuse for always trying to give the benefit of doubt to a cop. By your own theory then you should assume when the citizen continues to tell the cop to give him the ticket and let him go, by default that means the cop already has his information and he's telling him go write the ticket and stop telling me to get out of my car.
      The context is that this cop has had NUMEROUS roadside pepper spraying innocent drivers cases and this video bright on the investigation that finally got him FIRED and his buddy, the second cop CHARGED for unnecessary use of force for pepper spraying people "for points" in their own little secret game.     It’s terrifying how easily one cop having a bad day can ruin your life. This isn’t an example of that, but it easily could have been.
    Though I understand the system makes it so that justice can only safely be found in a courtroom, what about the in between? What about the job you lose while you’re in jail? What about the fact that even if you are blatantly in the right, the courts are FAR more likely to side with a cop?
    It’s enough to keep you up at night if you let it, at least for me.
    As a side note, I believe it’s a dangerous precedent. If someone suspects they are being falsely arrested by someone pretending to be a cop, what do they do? Just go along with it crossing their fingers? Or risk jail time? It’s a choice no one should even have to think about.

So ...the police contact/traffic stop/arrest is the preeminent domain of the law enforcement officer; but, what about the accepted fact that the police officer’s ‘word’ has more weight than a defendant’s in court?       I'm stunned that ATA gave the cop a "C" instead of an "F." If his can of pepper spray wasn't empty, the cop would have pepper-sprayed the driver. ATA should stop giving such lenient grades to cops. It makes him look like a bootlicker rather than an objective observer.       i am not pro-cop by any means, but the grading this channel gives is pretty fair. He does not ignore parts of law that cops were right with just because they acted like extreme assholes. In this case, the cop did have quite a few things correct according to law. Sure, i get that his attitude was trash and what he did was awful, but that does not negate the legal stuff that was correct. Normally we see cops on here that are incredibly nice, but totally misrepresenting the law, and he also grades them a C.
      If they act like this dude and totally do not know the law and are dead wrong about it, then he gives that big fat G

    The major problem with the accusation of resisting arrest is it’s up to the discretion of the police officers. Threatening violence, aggressively grabbing or striking someone will naturally cause a resistance action.

      Yeah, I've seen videos where cops repeatedly strike people in the face or about the head while screaming at them to put their hands behind their back and stop resisting which is absolutely absurd. The natural urge to react to such attacks by trying to shield one's self from the blows with your hands and arms is overwhelming.
      People have suffered severe and sometimes permanent injuries or even death because of being struck in the head repeatedly while being ordered to put their hands behind the back.
      But even less severe actions by officers such as grabbing can cause an instinctive reaction to recoil or try to shield one's self. I'm not saying it's okay to fight the cops but instances where someone just recoiled or jerked away for a second shouldn't always be grounds for charges of resisting arrest.

    The 2A was written for cops like these. These "police officer safety" exceptions to someone's natural rights are disgraceful.

    Correction, people who are in positions of authority who think they are above the law is what makes it almost impossible to find Justice on the street, just because something can be made legal does not mean that it's correct. Based on what I see, the court system couldn't care less about Justice, and it seems like it's more about draining your bank account and they get upset if you try to deny them that.

    At my company we make policies and procedures vague to allow for some leeway.. knowing that the police have enough leeway to arrest you and use force to do so even for no reason is pretty terrifying..

    The 2nd cop that showed up was at least aware of how unhinged his co-worker officer stowers was ... When stowers asked him for his pepper spray because his was out, he not only DIDNT give it to him, he flat out ignored it and didn't draw any of his weapons. Decent guy

      Then the driver was also an ass. We both know this cop escalated it because the driver was being an ass as well. Had the driver kept his mouth shut and handed his license, he'd never have been asked to get out of the car. This case they both get an A... for ASS.

    The constitution clearly gives an individual unlawfully arrested or basically kidnapped the right to resist unlawful arrest by any and all means necessary. No failed judgment or misinterpreted ruling is going to circumvent that right. Nor should it allow hardship or suffering to be placed on a person for exercising that right. Misleading people into thinking or believing they have to continue to submit to unlawful act even for an instant is undermining the US CONSTITUTION. I am a retired policeman, and I won't be giving up my rights

    The problem with fighting something in court is that they never let you get there and it's extremely hard to press criminal charges . Maybe tell us how to press felony charges against cops .
