  • This video is PART ONE of an interview with a real private investigator that films injured workers without their knowledge. He answers your questions as to what to expect if you are being followed and how to protect yourself.
    If you have a worker's compensation claim, there is a good chance you will have someone following you at some point. It is important to know what they can and cannot do to protect yourself.
    This is part one of three in the interview.

    I remember 12 years ago I almost got into some serious trouble being falsely accused of causing serious badly harm to another worker. I was a janitor at the time this coworker falsely claimed that I hit his foot with a vacuumed cleaner and that the vacuum cleaner sucked up his leg chopping up his foot. as of result of this he got our boss and his doctors to sign off on this claiming that he lost his foot and that he had to be amputated. 12 months later I was clear from my troubles which I happened to find out that my coworker and the entire company got into some serious trouble because it was a fraudulent workers comp claim they made against me just because i'm visually impaired.

      @@asbmp Your best bet is to do an incident report the day of and make a list of potential witnesses.

    Ms. Naomi. I found this interview fascinating. My limitations have always been not to lift more than 20#'s and no kneeling. In these 7years I am not aware if I was ever surveilled. If I was, they were good at their job. he he he. Thank you for your wonderful videos.

    They definitely be watching I've caught them 3 times the last week and we made it clear we know they watching amd I won't lie it's very nerve racking and makes you very paranoid like now o feel like qhen I go out my house someone always watching me or following me not good for someone who has mental health issues I hope this stuffs over soon smhthey even followed me to my family's house and parked and watched me untill we flew the drone in front his windshield 🤣

    My question is if my MRI shows a legitimate injury would and insurance company still hire an investigator?

      Hi Sanders,
      The insurance company can hire one if they want. More red flags the more likely. You have a lot of prior injuries or your work status not consistent with the injury or last too long, they are more likely to do. But really might anytime.

    Went to court today the insurance company said they have surveillance they want me under oath 20 minutes for testimony. I can’t see the film until I’m done testifying. Now I have fear until march. I had 2 surgeries and the have survalence. So much fear did I bring garbage out did I bring groceries in did I walk my dog it could be anything God help me.

      I'm sorry, that sucks. You're right, could be anything. Your best bet is to use non committal language. Give yourself some breathing room with your language. Like did you take out the trash? Not that i recall as opposed to no.

    Is it legal for a surveillance investigator to look at your back yard? Sometimes I feel someone is in the alley near my back yard wall. Idk maybe I’m paranoid lol

      It would go back to your expectation of privacy. If any bystander can look at you in your back yard, they can. If they would have to climb at tree or something to see in, then you have a good argument against the use of their film.

    Ms Naomi thanks for all the great videos. I`ve been on workers comp for 4 months and today my job sent me a return to work letter as they can now accommodate my restrictions. My issue is I thought I was terminated because whenever I contacted human resources after I reported my injury they would ignore my texts, I also received a letter from my medical insurance company informing me my benefits were terminated because I was fired. I was fired 4 days after I reported my injury. Now they want me to return to work. Is this right and can I sue them for wrongful termination?

      James, are you sure you were terminated? Usually still on the books unless actual termination letter is received. Can be off work for a time and private health care discontinued then offered a job. If you weren't terminated then can't sue for wrongful termination . But if were terminated, I can give a referral to employment attorney for a consult on wrongful termination.

I didn't receive a termination letter but letter I have is from Optum Financial financial stating my employer said I experienced a qualifying event (termination) and that I can continue my health care coverage under COBRA.

    Hi Naomi, I have a question; I saw my primary treating physician last wk and was told my work restrictions may be permanent; she will discuss it at my next appointment. I was wondering if the work restrictions are permanent,who will decide it? is the primary treating physician or QME doctor? (I saw QME doctor prior to surgery). if my current employer cannot accommodate my permanent work restrictions, will I be unemployed? What about the waiting time ( from primary doctor give permanent work restrictions till seeing QME doctor, can I still receive tempt work benefits?) Thank you so much!

      Whichever dr PTP or QME finds you P&S first, your TTD benefits will stop.

I saw the video you recommended, I was wondering what about the 60 days when HR makes the decision to either provide reasonable accommodations or not? Is it still eligible for tempt benefits to wait for HR to make decisions in the 60 days? Thank you!

      @@qiulynn2421 Unfortunately no, but you can sometimes start getting PD advances. But those have to be paid back at settlement.

    Hi thanks for the info. My workers compensation pays my medical bills but they are not paying temporary disability payments. They have paid weekly benefits before but I have not been paid for 4 weeks now and today they just paid me for medical mileage but not the weekly benefits. I just recently filled a claim for compensation and I'm currently waiting for their official response. What do you think is going on? Thanks

      Thanks for the question,
      Sounds like your case is accepted but either 1) you've hit your max payment of 104 weeks, 2) you were released by your doctor or QME P&S 3) the adjuster does not have your updated work status with off work 4) your employer now can accommodate your restrictions.
      Just ask your adjuster or attorney why they have stopped coming.

      They shouldn't be talking to you. But they are not sometimes all that secret. Some are better than others on being discrete.

    Will workers comp hire private investigator even if my claim is denied ?

      If you have a case open, they may hire one. But not as likely. They have denied you and don't want to spend money on you. But they do need to litigate your claim and that can be part of their discovery to try and gather evidence of it were to go to trial especially if the reason for the denial was that they think you made it up.

      Hiram,
      No way of knowing for sure until they produce it. Usually they will ask very specific questions when they do. Ie when was the last time you walked your dog? If they have you on video walking your dogs.

    Can they go to gyms even tho the doctors said you have to lose weight and excercize so your back gets better no weights just cardio equipment and sauna

      Yes, gyms are a public place. If you are only doing dr orders then they will only capture you being compliant. They are not analyzing legal arguments they are just doing surveillance.

    I got injured in April and reported my injury at work. After I went to the emergency room the insurance adjuster contacted me and said they will send me the necessary paperwork to seek treatment. They never sent anything until July. In August they paid for my mileage expenses, surgery, and physical therapy but they have not paid the temporary benefits from the time I actually got injured in April. They only started paying from July the date I saw the orthopedic doctor for my injury. What documents do I need to submit for them to pay benefits from my date of injury in April to July. Thank you

      Hi Bigg1942,
      The most likely reason they didn't pay retro TTD payments is you have no work comp doctor report saying you were needing to be off work for that time period.
      If we are in that situation, we usually ask the QME, for their opinion as to periods you were TTD from date of injury. If QME says you should have been ttd, then you will most likely be successful in getting retro ttd.
      Can ask your PTP too but they are more hesitant to give that opinion and defense less likely to accept.

      I don't know what you mean by personal space. They can be anywhere in public you are. They cannot touch you. But if you are aggressive with them, they will probably defend themselves.

    Disgusting!, Violating victims privacy and put them in Danger trying to get inside your apartment, hack your accounts and all nasty stuff you do, should NOT be legal.
    I know you walked inside my building and you know I saw you, and I want you to know I have your photos as well., And I know who is paying you to put my life in Danger.
