    Good news: Adobe listened to you and updated their Terms of Service. Bad news: It still spies on you.
    Tony Northrup digs into the updated Terms of Service and tests their filter to demonstrate that it's overly aggressive and will still trigger on innocent images, possibly causing a human employee of Adobe to look at your private pictures.

    I quit using Adobe when they stopped selling licenses for their products. I can’t remember what year it was, it was so long ago.The thing is, if you don’t have Internet service, you can’t use your products. Who the hell wants that.???

      I stopped using Adobe when they thought they could charge me every month for software. As a graphic designer I didn't need any services from them I just needed the software. That's all I wanted. And I refuse to pay for one product over and over and over and over again.

    I’m a researcher. Our university stopped paying for Adobe after they went to the creative cloud model. We now use Affinity programs. There was a learning curve but I’m used to it. I switched to capture one for my photography after the university took away adobe and have been happy ever since.

      I also use Affinity but I'm also a little concerned with Affinity as well. They were bought out by Canva. So because the original ppl are no longer in charge and out of the picture, Affinity products will most likely gear themselves toward the subscription-based model over time. Canva is also subscription-based. Canva also uses a cloud.

MS seems to buck the trend and insist we upgrade for free but you just know they are equally scamming us. Any company that gains traction opposing them gets taken over, one way or another.

      Except that he's not. He's just fighting against the wind. Adobe is a private organization who's going to do what they're going to do. And as long as you sign the TOS that's on you. Y'all shouldn't have let them turn Photoshop and illustrator into a service when it isn't one. What service do you think you're paying for? Their stock image service. This was always the goal. When you pay every month for Photoshop or illustrator you're paying for them to steal your intellectual property and put it on their image service. You're paying for them to steal from you and you always were.

    I think Tony is right. Adobe needs to realign with its function as a professional service provider, not as a nanny, not as an agent of big brother, not as a detective agency.

      Honestly ever since Pantone picked up their Ball, and went off back Home, with it. What reason is there to actually use Adobe? More to a point why haven't Pantone released any packages for other providers, looking at you Canva, (Affinity), and Skylum (Luminar).
      As for Illustrator, there is Inkskape, and Affinity Designer for Premier, we have Resolve. Not sure what could replace After Effects though.

    An increasing number of Adobe’s features will send images to the cloud for no other reason than Adobe wants wants your images. The trust has been shattered and it cannot be restored.

    I’m a digital artist. The main concern is being able to adhere to NDAs with clients and companies. Only recently did the 2d industry become more open to remote positions, but I can see adobe’s terms of service causing a reverse in that progress. I foresee studios requiring all artists to work on site just so they can store the images on their own protected server. That’s a big deal to many artists that can’t afford to move or live in cities where these studios are located.

    Christmas photo session of a mother and her newborn. Photographed mom from the back, mid-back up, with her newborn baby looking over her shoulder to camera. A truly wholesome and innocent image. I attempted to use generative fill to extend the image and Adobe's filter flagged it and would not allow the fill to generate. That's just one of countless times I've encountered Adobe's "virtue filter" denying me use of features that I'm paying for.
    Having Adobe employ automated detection algorithms on YOUR WORK and then humanly peeping your work is highly intrusive, and ought to be a huge red flag to photographers.

    I'm done with Adobe. The whole "CSAM" defense is a smokescreen. No one in their right mind would defend that, but i also bet most people who deal in this trash don't upload it to Adobes cloud. You're spot on about them wanting to keep themselves and their precious AI clean.

      @@iandavis1355 Years ago when I made the switch, a photographer that I follow was big on Capture One and I jumped on board but nowadays I use it with Affinity Photo. I don't know if you do video, I rarely do, but I love DaVinci Resolve and they have a free version.

      @@iandavis1355 I'm pretty sure I responded to your message but I come back and it's not here🤨. So when I stopped using Lightroom and Photoshop all those years ago, I transitioned to Aurora HDR (Now Luminar Neo I believe) and then eventually migrated to CaptureOne and still currently use that in conjunction with Affinity Photo. For video I tried Sony Vegas Pro when it was still owned by Sony and other programs before finally settling on DaVinci Resolve which is in my opinion better than Premiere Pro and actually still free.

    I truly believe they've viewed/spied/analysed/used every image on each subscription holders' computer. Even though I very rarely use Photoshop because I switched to the Affinity suite maybe 4 years ago, Adobe connects to my computer automatically almost daily, claiming to be "synching files". It was one of the reasons I wanted to move away from Adobe products. Too much communication with my computer.

      I paused the sync option because I NEVER wanted to use the cloud. And never activated the sync. Same with Apple, I never wanted any sort of cloud service, yet they did it any way. Fuckers.

    I've had enough. After 20 years as an Adobe customer, I am actively searching for Adobe replacements... Software that isn't a subscription, doesn't spy on you, and is made by a company you can, at least partially, trust.

      I'm enjoying DxO PhotoLab. They've got a special going, 20% off. They have a library of camera body and lens profiles, and they use them to automatically render color and sharpness. You hardly have to do anything, other than crop, and tweak exposure. You CAN play with colors, but unless you're going for funky colors, the defaults are pretty damn good.
      For stuff where I need layer-based editing, Affinity Photo 2 works well, for me. Together, the two cost about what a year of Adobe Photoshop and Lightroom do, and that's for lifetime licenses. No subscription.

      Affinity is fantastic. I have been using it for years, but using windows is about to be the same as this adobe situation. Windows will be taking a screenshot of your desktop every second for this new service called recall. It's time to move to apple or linux. I chose Linux.

      For everyone. Premier and After Effects = Davinci Resolve. PhotoShop = Affinity or any bitmap program that has layers. Illustrator = Inkscape, which has artboards and layers. Adobe Animate aka Flash or Character Animator = Procreate Art and ToonSquid. Anything 3d = Blender. Now that you have options - if you stay you agree with Adobe. It's not like you don't have the knowledge.

    Great points Tony. I have taught many classes on "Alternatives to Photoshop and Lightroom" and although there are quite a few very good Free and not-free PS alternatives, there is a huge, gaping hole in the LR alternative universe. Thanks for holding Adobe's feet to the fire.

    Tony: teach us Capture One. Adobe: Don't look at my photos. Period. I don't care about your good intentions. If a feature in Lightroom or Photoshop lets you look at my files then you need to let me know so I can turn off that feature. In fact, I want it to be completely removed from the software so that it can't be accidentally turned on. Adobe, your software is amazing and you should be proud of it. Don't let this be the hill you die on. I'm already learning Capture One and getting used to its features. Straighten up and fly right!

    I do glamour and boudoir photography and virtually every single photo I try to use any kind of generative fill tools on is rejected, almost every single one. It's idiotic overreaction and censorship

    Canceled Adobe Photo Suite and Moved to Capture One + Affinity Photo. At this point, I wouldn’t even use their software if it was free.

    Tony, you are a real asset to the worldwide photography community. I really appreciate your corporate and technical experience on top of being photographer, author and educator. Excellent points end-to-end. The structure, scope and content was great! I hope Adobe's evil and greedy overlords see this! And I hope their CEO who is ever closer to some kind of distopian advanced humanoid android 50 years from now sees this too! I'm super glad that you will begin exploring alternatives to Adobe's products. It won't be easy, but any revenue shift from Adobe to other software companies would fuel their R&D, and hopefully we might see a worthy alternative software few years from now. We need competition in this pace - even if Adobe didn't switch off their human side. This could only lead to better products for us all.

    I tried to cancel Adobe like twelve times and always was ignored when I attempted to cancel. I was being double-charged and never enlisted into two subscriptions. I know this for a fact.

      I went through three months of trying to cancel Adobe Stock. When I blocked them from debiting my checking account they charged me on a credit card I had removed from the account months earlier. Adobe are straight up dirt bags.

    great heads up on this, Tony. I do appreciate Adobe's video response from their legal team but wish this info had been part of a larger discussion BEFORE making big changes to the TOS. Adobe should consider hitting the pause button on this set of actions until they can hear from professionals and hobbyists alike...especially considering WE helped them profit $5B!! On the subject of Adobe AI learning from our Stock photos to generate new ones for them - WE the original creators should be notified and compensated for that act. This should be true for ALL creatives - musicians, actors, writers, photographers etc...we don't get to use their products for free, they should not be able to use ours!     Glad to see you expressing what a lot of us are feeling so eloquently and precisely - thank you for publishing this. Especially after the "next photo" bug in LR that came in the middle of last wedding season, I have also been exploring alternatives. We've all invested SO MUCH TIME AND EFFORT into integrating these applications into our businesses and recently it just feels like slap in the face after slap in the face from them, and it's impossible to trust that these applications will continue to be the best choice for small business owners going forward.

    I never use, or have ever used, cloud services. I have always felt that it is like handing Your stuff to a stranger. Instead I use different NAS setups as my private cloud. I didn't know that some AI functions need cloud access, I am very thankful that You told me about this. I have managed my work without this for 20 years, so I will just keep doing what I have done.       Yes, I agree with Alltomhusbilen that NAS (Network attached storage) can work as a private cloud. You can access it from anywhere in the world. You will have to pay approximatelyt at least $1,000 up front for a reliable NAS system + hard drives. That’s not including the setup fee it you don’t know how to set it up yourself. However, this system will last a long time. In the long run, it will be much cheaper than cloud storage fee that you pay the cloud companies. The greatest benefit is your data Won't Be HELD HOSTAGE by the cloud companies.

    You nailed it, Tony. There are many programs that I could use to edit my photos as well as I can with Lightroom, but the problem with switching is tied up in the management aspect which I have become so dependent on.

    Heck, Adobe screwed us over many times prior to switching to a subscription model (and I mean all the passionate users, certified developers, distributors, educational institutions, all products from then-acquired/milked-then-abandoned Macromedia, Adobe Creative Tools, Enterprise Products etc. etc.). Back then, it was easy to assume they would screw us over again in the future after the switch, so I never onboarded. Are the shinanigans of late surprising? Not one bit.

    If I use a knife to murder someone, KitchenAid is not liable. If I run over someone, Tesla is not liable. If I use Photoshop to edit a counterfeit dollar bill, again, Adobe is not legally liable. There's absolutely no reason for Adobe to look at my work, private images, and my creations for ANY reason whatsoever. By looking at my work, and granting themselves a MANDATORY license (through a forced TOS) to use my work in any way they see fit, even my clients' privacy and potential intellectual property is being violated.

      @Tugela60 problem is LrC. There is absolutely nothing to replace that. Ditch it, and your catalog of hundreds of thousands of photos and millions of edits ...is lost. Nothing exists to migrate to. LrC is the best catalog, photo management, and editing program in existence. Unfortunate the company that provides it has chosen a path leading to them killing the businesses of their customers. It's a horrible situation.

    Adobe is constantly flagging my stuff like what it did with Tony's image here. Sometimes it's obvious what it thinks somehing is, other times I'm completely at a loss as what it thinks it's looking at. But what bothers me is that when Adobe flags something, it asks me to send my image for review to a human so that they can 'learn' where their AI is wrongly flagging images. I'm annoyed at the constant false positives for terms violations, but I also don't want anyone and everyone being able to see all my images.

    Tony: You know that anytime your data is on someone else's server, they "can" look at it (unless you have it encrypted with your keys), NO MATTER WHAT THEY TELL YOU (e.g., Google, Microsoft, et al.). ANYONE NOT UNDERSTANDING THIS SHOULD NOT PUT THEIR DATA ON SOMEONE ELSE SERVES UNLESS THEY DON'T CARE! PERIOD!

    I totally agree with your suggestions. Especially informing us individually when an image has been viewed by an human. They should provide a screenshot of what they saw too with an employee code as reference. So if we see our image online we can track back to the person who leaked it. Now that’s transparency.

    "think of the children" has been the most common and most abused phrase in the world. There is no corner of hell deep enough for those people who create and spread CSAM but Adobe will not be the ones to put them there. Even if they did find illegal material, they need to outline what they would do once they found it. And I personally believe that as long as they keep invading all of their users' privacy, they should be held criminally and financially liable for every instance of CSAM that they do not find/report.

      Another Photoshop alternative is *Krita*. While its text seems more limited than Photoshop's, it supports basically all of the Layer Styles and can open/save PSD files.

    For anyone wanting to cancel your adobe subscription but being caught out by the "Cancelation Fees", when cancelling, instead change to another plan. You will be refunded some money for the remaining time left in the current month from the original plan, and the new plan is within the 14 days to cancel for free. Immediately cancel the new plan and it will be refunded in full, and you have avoided the cancelation charge altogether.

      Affinity Photo 2 is under $40, if you don't need cross platform versions. It's a pretty good Photoshop substitute. That's for a lifetime license. For a Lightroom alternative, I like DxO PhotoLab 7. DxO has a 20% off special on lifetime license.

    The harsh truth is that many consumers/creators are so deeply invested in Adobe products that it would be extremely difficult and time consuming to move away. Finding alternate products and then the learning curve… just a mission! And then there are the third party plugins that can’t be replaced unless the developers adapt their plugins to be used with other products. How would they choose which products though? Nah, I think Adobe has us by the balls folks. Just keep up the good work holding them accountable. Chip away until they get into line. Thanks for what you’re doing Tony
