    Thanks for sharing. And indeed, the best option is always to play by the book. We are working to get our game, Kalyskah, on Steam in a way that the explicit NSFW content will be allowed as a DLC and then base game would be more softcore and without genitals being shown. And I was surprised with how open steam was to work together with us and explain us what needed to do and what we couldn't do.
    So I encourage other developers to open a ticket and ask what they are in doubt to Steam support *before* their game get's submitted. Right at the stage of setting your page up. This way it's more likely that once you are out there, things can go smoothly.

    I guess this partially explains the popularity of college themed adult games. You still kind have the high school schedules and social dynamics with classes where both boys and girls meet, but it is all legal age. So they pick the traditional high school hent@i visual novel narrative format that is proven to work, and moved it to college with a few ajustments.

      It's probably better to make the setting a college from the ground up, like Being a DIK or College Kings, which don't at all have the "high school" vibe.

    I'm curious how Koikatsu Party managed to get put on Steam. I know the game doesn't specifically say it takes place in a high school but nor does it seem like a college. I know the game is pretty much just a character creator on steam but it does have patches that make it something else. From this video I had the impression that Steam does take off-platform patches into account.
    I don't really follow adult games much but I get the impression that if I want that sort of thing I'm still better off just modding games like Skyrim and Fallout 4. I want games with actual gameplay in them and not just visual novels. For adult games I want the same thing I want in any other game, good action and adventure gameplay, but with adult material included. Whoever develops a Skyrim like game but with immersive adult material in it will make a fortune I'm sure. I was hoping Wildlife would be that but it seems to be in a state of perpetual development. Given their funding scheme just like Star Citizen it really looks like they have no incentive to actually release their game.

      Koikatsu Party came out on Steam before the policy change. That is why we have Evenicle on Steam, but not Evenicle 2.

    I guess they want to avoid people constantly resubmitting unacceptable content until they manage to alter it just enough to pass steam's inspection. It is sad they hurt a lot of totally fine games (with ladies that are 18+, but just look petite) but i can imagine they want to stay far away from the bad stuff.

    fun fact: in Washington state, where Valve is based, bestiality was accidentally legal from 1976 to 2006.
    Back in the day, anything even a little kinky was banned, including *blowjobs* and *threesomes*. In 1976, they decided that was stupid, so they got rid of the law, and no one noticed that bestiality was included in the list of things that were now legal until 30 years later when some guy died from ****ing a horse.

    Hot take: I think Steam is doing a good job. In that specific case, the reason they are cutting a bit "too much" is the reason they can both have adults game and usual AAA games on the same plateform.
    Otherwise they'll end up to have a site like DMM where the only non adult game are censored version of adult games. And steam isn't going to put their money making machine into jeopardy for a niche market.

    Great video.
    I'm torn on that subject. Yes, if you translate it to real life, it's a huge no-no... But so is family "friendliness", and so many other things in our games that don't get banned, because in the end they're just characters. Really, what I think varies from game to game.
    I'm still salty over MIST though. Mia did have a petite body type (and newsflash, smaller but adult women do exist), but apart from that there was absolutely nothing suggesting she was a minor. Great game that will unfortunately never get the attention it deserved.

    So basically, there's no legal precedent, and Valve doesn't want to spend millions creating one and simultaneously potentially being seen on the side of a certain kind of predator that it's probably unsafe for me to type out, assuming I'm not already on a secret watch list just because I've played an adult game...

    There's also some international nuance - the Steam sale of Book of Bondmaids was banned in Germany not because of the sexual content, but because of the torture scene. Weirdly, keys work for the German Steam version, so it's the **sale** specifically which is banned, not possession.

      @@Overcrook65 Well nudity and sex games aren't censored in germany. It's just that the law requires more than just a "click here to confirm you're 18" button. And in consequence steam decided to just block games with nudity/sexual content for germany, because it was easier/cheaper than rebuilding how the shop works for just one country

    Personal opinion, I found steam to be pretty helpful with information when it came to releasing my adult game, but I had to reach out to them first. In the game there's a Mother and Daughter duo, nothing explicit ever happens between them, but the mother is rendered at 9ft tall where as the daughter is only 5ft 2; so by comparison when standing next to each other the daughter unintentionally looks very young, but completely normal standing next to any other character. They were also the first two to be shown in the game, which gave me some concern of it being mistaken for something else.
    After reading the guidelines and seeing the age thing I contacted support and asked if I should change anything and they were very helpful with me, and said as long as the characters ages are clearly stated (47 and 19) and the one character doesn't appear 'young' there shouldn't be any issue.
    I'm aware the games that have been banned have been because they likely pushed that line, but just saying if any developer has any concerns before submitting their game then steam can be helpful and tell you what you should/shouldn't remove, but apparently only if contacted before submission. At least from my personal experience.

      I guess it's because in some of those less successful cases, one or more of the characters look far too young. To such a degree that a disclaimer or statement of an older age isn't enough. You shouldn't use school uniforms, etc. that can be used as evidence of breaching Steam's rules. Nothing "bad" should happen to the characters in your game if they're going to be that young. If you don't remotely go there, they are relatively flexible.

    It's likely a combination of factors that makes them keep such an inhospitable design;
    1. This vague description of the rules means that people aren't pushing the boundaries of that which doesn't exist.
    2. The vagueness also absolves them of much political leaning when it comes to this touchy subject.
    3. They _will_ be helpful if you contact them prior to the game submission, apparently. So for those who are actively trying to not submit 'bad' content, they assume it will work out for those developers.
    4. Steam's general lack of footprint when it comes to controversy. They don't want to have even a small mark, so having this incredibly harsh and one-sided policy allows them to basically do what they want to keep that intact.

    Steam is quite generous when it comes to their policies regarding on what is disallowed so I can definitely cut them some slack if they're unable to explain in detail when a game gets banned. Well the way I see it, no company ever wants to take the risks of liabilities, no matter how miniscule. In the U.S., avoiding lawsuits is everything. ^_^

    This is quite informative as it lines up with how my discussions with Patreon and Deviant Art have gone over art I sell there. Luckily that has all gone well!
    Steam is something I am looking at in the future, too, so this is an awesomely helpful video!
    It also explains why a few games I bought on Steam years ago were removed. Even though they were not adult games, they had subjects here implied in them.

    I figured that's what it was. Honestly, for what they are, Steam always seemed super lenient on what they allow. I've played games that let you boink anything with at least two legs, so I figure in order to get the boot from Gabe there's really only one thing that would cross the line. They do seem more strict on the school aspect than others, since people can be 18 or 19 in high school. But I understand the need to play it aggressively safe. If Steam in their position were to become known for openly allowing that content, the only possible outcome is a swift death for the platform and Valve. We'd all end up using EGS and reminiscing about the good old days.

      I wouldn't be so sure. There is alo't more nuance too the issues at hand then thing bad, ban good. if anything, I'd say it would spark a larger discussion/US intervention that would very likely side with steam. As far as other countries laws go, there is already segregated Steam versions... This will just continue to be a thing.

      Think its because it isn't graphical and probably don't abide to pornography rules, like you see Beverly hills 90210 where they have sexual relationship but its not explicit, same with shows like Teen Wolf or First bite that got cancelled after 1 season. Think its a question of it being adult content I imagine or not, if there were strong rules against other you could never make movies or TV shows covering child abuse like special victims unit etc. without actually visually showing any of it, so imagine that is the distinction between it.

    Great video as always!
    The reasoning I was always given for not spelling out exactly what the ban is for is to not influence the art being submitted. I think it's an interesting angle to think from, but also very opaque. Remember that Steam is not saying the art is bad, it's just not selling it in the store.
    Also, this is a reason why wandering to other stores has been happening more for me as I know Steam is basically the video game equivalent to Hot Topic, edgy and new once upon a time, but now just the default place for T-shirts.

    Isn't it technically that the actual technical legal age starts at 17, but only under strict demand that it be written and signed by all those who are present?
    There seem to be a lot of games that are still on Steam, which have characters and topics that are considered illegal /or scarring that haven't been banned at all (Innocence or Money being one of them, because there are several scenes where rape is present, along with Jess looks more like she could be 16 and yet she's a nympho and still hits on Fred - along with so many others). There are a lot of locations in AVNs that look more like high schools than colleges/universities. There are also scenes in other well-known series like Fetish Locator and College Kings where sexual blackmail without consent in any way, along with sexual misconduct in the workplace. Mind you, there are also SFW games where it is quite clear that scenes of nudity are shown (CDPR) which are being played by people under 18. Also, I believe that to attend university/college you don't have to be 18, but there are cases where students are 17 typically when they are freshmen.

    [Not a lawyer, not legal advice]
    I've seen this popup a few times both with hgames and other content, and I think there are some things to keep in mind.
    Steam is, at the end of the day a business that does have to follow government guidelines both at the state and federal levels. With it also doing business across state and national borders there are other guidelines that have to be taken into account.
    The subject matter mentioned in the video is an extreme legal gray area and can be handled/interpreted differently across states. So from a business point of view I can see why steam a.)will just flat out ban the game and b.) Not give a specific reason (discord does the same thing when they suspect cp and forward it to law enforcement.)
    Is it protected by the first amendment, I'm not sure. Steam could fight for it but is it pratical? No

    In the end the only thing angering me in this case is the opacity.
    Actually Steam is way better today than it was 10 years ago.
    I remember the time when nothing more than light ecchi would be allowed (like non-patched "sakura something" games).
    To me, Steam remains a hero of freedom of speech and creation for finally... spinning the valve, lol, and opening itself to most adult games like pornographic or "too violent" (yeah right, this hypocrysy is even worse than the puritanism) contents. It felt to me like an imperfect but still major liberation.
    It the end, i think we can be glad to keep what we gained a few years ago. Which is already more than the majority pf non-specialised platforms would ever allow.

    I don't ever use steam for this as steam, even with a different account makes it near impossible to make games invisible on your main account. Maybe when you every time delete the connection the map it's in before logging in to the main account but it just shouldn't show games you didn't install/play on that account.

    I have no problem with the rule itself and most of steam's rules are fair enough, but the way steam moderates and enforces their rules is just too subjective and inconsistent. I'm not even a game dev but I've seen it happen far too often and even been slapped a couple times by steam myself. Once for uploading game screenshots (properly tagged, unmodded, and not depicting any content banned on steam (but steam community has a different set of rules, even for screenshots straight from legal games), and once for "liking a review of a game that violated steam's policies". Despite steam not telling me what review I was being banned for clicking a thumbsup on I knew exactly which one they were referring to, the curator who wrote those reviews is trans and was being harassed in comments on their reviews. Someone took it a step further and used bots to report their reviews. Appeals on both cases amounted to nothing, this is just how steam moderates things and game devs have to deal with these same frustrations with much more painful consequences than a few months of community bans.

    thank you for making this video. it definitely clear things up. i have no real problem with a platform following the laws of the country or territory they reside in. that just makes sense from both a legal and business viewpoint. i just wish they'd be more upfront and clear about it.
    and since depiction of minors isn't allowed on Steam, i'm sure that is a big reason why college eroges are so popular lol

      But that's the thing, Steam isn't following the law. The law says this type of art is allowed. This was settled in the Supreme Court case of Miller v California.

    Here's a question on my mind. No body probably knows the answer but it would be great if Steam would answer or provide some guidelines. Can you have underage characters that are not part of any adult content. For example could you depict a family with children below the age of consent, where one of the adult family members is involved in the games adult content?

      On the surface, steam requires that no minors be depicted in reference to a sexual act. The problem however, is that by placing a minor in a game as a character that includes sexual acts, even if the sexual acts don't involve that minor, may also trigger a ban. It's probably safer, from a developer's perspective, to avoid having minors in any form in a game that has sexual acts, even if those minors aren't involved in them.

      We’ve asked Steam about this actually! Our game contains a scene featuring a child having a conversation with two other people, so before uploading a build we sent them a message asking if that could be a reason to have the game banned. They were very clear that the “minors” rule only applies when it comes to romance/sex scenes.
      Anyway, as others have mentioned, I believe it’s always worth asking before uploading a build just in case. They were very helpful with us.

    The zealous fight against anything remotely appearing underage in media is ridiculous when it's clearly fictional characters. I can understand Steam's point of view due to legal concerns given depictions of underage characters in anything sexual is illegal in many countries even when they're clearly fictional. But the idea somehow this media is harmful has as much logic behind it as saying violence in media is harmful. If fictional underage characters in sexual situations causes people to prey on children IRL, then we have to assume the same for any depictions of people engaging in violent acts. I personally believe media isn't responsible for what people decide to do to other people and I'm unwilling to give murderers or predators an excuse for their actions. They did it, not the game or TV show or whatever.

      I have never heard any reputable source ever say loli's caused irl crime, infact Ive only heard the opposite, That it gives these potentially awful people a life without despicable crime. If it can do that, then it's an extremely dumb idea to go around banning it.
      I have complicated relationship with the subject matter myself as my R*pe fantasy's(as the victim) were also present when I was a child and can find it sometimes hot to be able to experience it in a safe environment. (Note, Do not use this comment as justification to commit a heinous crime on someone you think might be into it! you can never know, and even if you end up being right, that doesn't mean they want to do it with you, and even if they did, fight or flight instinct is powerful in us women and it could still end up being torture!)

    It's not only that, they also ban for just showing the Hub or any similar site.
    I've seen multiple games get banned because a site of that type appeared on screen for a single frame, as the character was watching those types of videos.
    That's why you should always avoid real life brands.
    Now, the craziest thing about this, is that the game is forever banned, even if said content is removed.
    We've seen this with Fashion Business, which got banned because of a single secondary character.
    And even when trying to re-submit the same game without that character, it still got banned.
    This doesn't make any sense at all, but I honestly feel like that DEV deserved it for not focusing his game on the main protagonist.

    Just make that everything about your game's setting and characters in keeping with being an adult and you probably have a pretty good chance. Interesting that "family" themes seem to be okay on Steam, but not on Patreon. It makes it difficult for those type of games to exist on both. That's why Patreon has a lot of games where you live with your "landlady" and "roommates", but for some reason, your landlady is really concerned about your personal life.

They also could've been nicer about things, denying a resubmission does not have any functional purpose, it's only a gesture to "send the message".

    There is a bizarre cognitive dissonance with western media. People have a problem with fictional cartoon characters that are teenagers being sexualized, but have no problem with live action real people being sexualized in the same way. Sure the actors may be in their 20s, but they are playing teenagers. Dawson's Creek, One Tree Hill, Riverdale, and most shows on the CW are fine? , Even some of the stuff on Disney is I would call questionable, but a cartoon character is not ok for these people. It's weird and inconsistent

      I mean, I see both sides. Putting scenes of kids 𝘢𝘥𝘫𝘢𝘤𝘦𝘯𝘵 to adult-only sex scenes, I can see why that juxtaposition isn't great. Not saying you're wrong but I certainly see it as a grey area, and I respect Valve's no tolerance policy even for grey areas.

      Like I had a dream sequence where a mage was traveling the countryside creating food for starving families, and casting spells to entertain the kids.
      Nothing sexual at all, just telling the audience who the character was more than anything. But that whole dream sequence is out now.

    I remember being mad when they banned MIST but recalling how kiddish Mia's character was, I don't blame them now. They simply have to follow the cultural tide, to survive or at least to stay as big as they are.     I know of games right now that have highschool settings, that depict young characters, in extreme sexual situations(no patch) on steam lol They obviously only ban popular well known games.     Would explain why Zombie Retreat isn't on Steam despite having a link to it. I don't fully buy the protagonist is 18. Especially in Town of Passion. Though if Steam is concerned about Underage content, then they might want to have a look at Spooky Milk Life which still has a demo up and the characters act very questionably.

    I have no opinion on the content itself one way or another, but Steam are cowards if their excuse is the laws of Washington State. This is already a settled issue in the Supreme Court, Steam would instantly win at trial if them allowing these types of games was challenged by any local governing body. Any sort of government response would literally be a violation of the first amendment.

      Think its more about stuff like payment services, for instance many adult site been regulating themselves as result of pressure from places like paypal on what they wish to be associated with, think its one large reason for the many harder stances patreon been taking on adult product on there.       No self respecting country will follow U.S. laws but since the marjority of them usualy have laws against underage sexual content they could simply prosecute Steam and ban the store/app/site from their territories.
      That would lead to the loss of a whole market and i doubt Steam would bother to pick this fight over a small time porn developer.
      So even if this is a excuse when it comes to the rest of the world it is a sensible one, it allows them to function and sell games without issues most of the time.
