    Seems to me the cover extends beyond a reasonable distance over the waterway, impacting the ability to navigate.

      The metal framing would be there regardless if whether there was cloth stretched across the top or not.

      That seems unreasonable to expect other people to remove their property because you bought a boat that is too big to navigate the waterways safely. The boat owner could also consider using a marina. There are dry docks, wet slips and other storage facilities that would eliminate this problem completely.

      @@LuciusKyrus Is this your boat cover? This attitude like yours is way wrong. You buy a home in the water to have a boat (big or small) and access to the bay and waterways. His cover and frame is over hanging by several feet into the right of way. If you parked your truck half into the roadway, would you say to just buy a smaller car or drive on another road. No! The right of way access if for every one. Not just this dirtbag and aholes like you and make obstacles and obstruction in the way.

      @@mattk8810 Great idea ! Let a judge decide. A few problems with that idea is, Lawsuits are very expensive and if you lose then you are obligated to pay for the defendants attorney fees. Furthermore, laws are based upon technicalities. If the law say you cannot have permanent structure and you can prove it is temporary structure then you win.

      Yeah, sorry, but when these people elect to live next to 30 other people all cramming into a canal with bigger and bigger million dollar shiny boats that barely fit in the first place, what do you expect? If it's not the cover, it'll be something else like the next neighbour upgrading their dock to fit their even bigger boat they just upgraded to. And while all this goes on "po folk" in small sportfishing boats are coming and going no problem.
      I see this as the water version of buying the biggest SUV possible but living in a dense city, and complaining that your side street in the middle of the city has too many steps and dumpsters and you can't get your SUV out anymore because you keep clipping the dumpsters.
      More money, more and stupider problems. Want a big boat? Don't live on a tiny canal.

      The business owner seems like he's in the right. His structures do not violate county ordinances according to lawyers because they are not permanent structures and if that is correct then he should continue running his business. In many counties it requires permits and licenses to install a concrete wall around your property, but you can still install the concrete wall if the blocks are not permanently joined together. It's not wrong, it's called playing by the rules.

      Yes, they are temporary. Just like carports and be very large fabric covered metal framed structures which can be built in places where pole buildings and other permanent structures cannot because they are not permanent structures even though they're often used in the same ways.

      If the cover is relatively the same size as the boat it’s covering then what difference does it make if it’s permanent or not ? Most people aren’t stupid enough to try and moor a 40 foot boat in a residential marina, it’s like buying a Mack truck and double trailer then blaming the neighbours parked across the road because you can’t park it in front of your house lol rich 🤑 entitled stupid people it’s hilarious everyone else has a modest sized boat in the marina then you got these idiots

    It's not the "cover" that is the issue. It is the frame that the cover is bungeed to.

      The frame does not look like it's more stout than the beams holding up the docks. $25,000 in damages seems a bit excessive to blame on the metal frame. I'm curious how the outriggers caught the cover if they were stowed correctly and if the captain had complete control of his vessel. With as many security cameras as there are these days, it seems reasonable that someone should have caught.

      @@LuciusKyrus in the United States which includes Fla. the right to clear passage or Navigability by the Daniel Ball equal doctrine ruling of the US Constitution. They block the right of passage, it has to come down. That contractor selling those roofs is in the wrong and he doesnt even know it. The only way he can get out of it is to try to declare the waterway is non-navigable.

      Not really a loop hole. The drone shot shows the cover extending past the supports for the boat lift. So the only reason they are staying up is people with money and greased palms.

      Yeah, that sounds like it needs to be addressed ....when you have outriggers extended and can pull them in when coming into port -you should ....I think I am on the side of not allowing those roofs though because they extend past the slip and the language sounds pretty clear (not buying the temporary explanation... no one seems to be taking down those roofs)

      Yea, Florida waterways have 3 kinds of fools. The ones with a dock that takes up 1/2 the waterway, the ones with a boat that takes up 2/3 of the waterway, and the ones who can't navigate a straight line.     The only thought that went into the boat cover installed, was to protect THEIR boat. No thought went into the neighbors use of the channel. Rewrite the law and have it state ANY COVER or STRUCTURE THAT IMPEDES SAFE NAVIGATION SHALL BE REMOVED IMMEDIATELY. Self important clowns will be self important clowns.

    Just because the canvas cover comes off does not make it temporary or portable. The metal structure that holds it up and actually does the obstructing is NOT portable or temporary. The guy selling and installing those things must be giving a kickback to someone in that government to allow them to stay. No building or zoning inspector with an ounce of sense would allow them.

      It's a technicality they are trying to get away with. The metal structure is the boat lift so it's allowed but because they attach the roof with bungies it's not a permanent roof and they only said permanent roofs aren't allowed. Building inspectors don't usually have much sense but unless someone reports you they won't go looking for violations.

    If the covers are prohibited,they are illegal and need to go. And that business owner is selling and installing a prohibited product and should be liable just like the home owner.
    It’s just like pool fence. Sell and install a non code fence around a pool,your just a liable as the homeowner if something happens with the pool( someone gaining access and drowning) if it’s not compliant.

    The reporter is really missing the point... the material covering the thing is not the problem, doesn't matter if it's attached with clips or not, the metal frame underneath it is the problem.
    People shouldn't be allowed to build those frames hanging out over such a narrow waterway.

I personally don't see any issues with this type of cover other then it overhangs the dock to much. I would be a pissed off neighbor if this guy blocked up my canal with this. I'll sell this guy some outriggers if he's willing to pay $25k for them... lol

      Yeah, the contractor is in the right. Temporary structures have never been permitted structures anywhere. A boat cover on a dock that can be removed is temporary. The contractor knows his laws. That’s why he’s waiting to get a ticket and go to court, the court has already defined permitted vs temporary structures many times and the local government always loses that battle. It is a temporary structure. People need to stop trying to control what people do with their own property and money. If you don’t like the covers on the canal, sell your house and move somewhere else.

    Anything that impedes a navigable waterway or canal must be made in a way so that it does not impede the waterway and safe navigation of all vessels that normally or are able to navigate that waterway.
    The waterway must be kept safe during daylight or during night time use .
    Nothing shall protrude in such a manner that can not be seen during night navigation .

    The tarp is the only temporary component of the cover... the framework is fixed permanent, that’s what did the damage in the first place, not the soft tarp! Yet not a mention of this common sense fact.
    Personally I’d just hook a rope to it and pull m effor down.

    There was one report last summer that a family left their boat dock and went out for the day. When they came back they could no longer reach their dock. The neighbor had a contractor on standby for when the families boat went out so he could modify his dock. He had told one of the neighbors that he could not put the cover over his boat until his neighbor went out on their boat.
    That incident had the police involved. The neighbors attacked one another over the structure. The police made it clear that they could not make anybody take down a structure. They had to turn it over to the permit department. When I first saw this video I thought it was this case that I'm speaking of and that perhaps a verdict from permits had came through.

    When you’re operating a vessel, you are in control of that vessel, if you hit something, it’s your fault, NOT the structure you hit! Plain and simple.
    Question- why did they hit the dock coming in and not going out?

    I don't see a problem with using the covers unless the actual roof goes past the dock and into the navigable water. I believe there are rules as to how far you can go out with a dock and the roofline should be limited to that setback as well. Would be a better solution than a lengthy legal battle that ends up costing the taxpayers.

    The boat lift cover was installed by the previous owner. This property was sold just recently. The frame can be slid back and the height can be adjusted to a desired height. It's easy to do.
