    The ironic bit is that Disney COULD have managed to avoid looking bad, because the restaurant in question was basically just renting from them. All Disney had to say was "that's not our fault, take it up with that restaurant."

      Disney was sued for two reasons: they were the bigger fish and the restaurant was probably advertised on their resort's site as catering to the needs of those with severe allergies - that was the specific reason why the couple chose to stay there in the first place. So they did hold some responsibility.
      Also, the husband had to signed up for a Disney account too, when signing up for the streaming service and that account's ToS had the agreement about settling out of court, not the Disney+ acc. The husband used the same account to make the reservation to the resort, implying that the agreement was still considered as valid by both parties, and they used that as the reasoning for wanting to settle out of court.
      Considering the backlash (thanks to the misinformation that it was all thanks to signing up for Disney+ years ago) and that the husband was not suing for damages, but for accountability on behalf of his dead wife, who did not sign any agreement, the case was ruled in favor of the husband. Considering the damage this case have caused to their brand, it is unlikely that they would appeal.

    Keep in mind Terms and Conditions aren't just skipped by convenience, they are _designed_ to be too long to justify reading for the kind of service they provide and use confusing legalese and non-sensical structure to make sure you don't understand what you're reading. The effort to look up and comprehend what you're reading is made to take longer than just reading all the way through.
    I remember reading the T&C for so many services over a decade ago, they were a few paragraphs that boiled down to "don't use this for anything illegal". Now just one is the equivalent of reading a short novel, include so many privacy intrusions and you need to agree to hundreds.

Remember making the dumbest and laziest garbage you could scrawl together into a full page essay the night before it was due in school? It was someone's job to take "Don't sue us and by the way we own you now" and expand it into the Silmarillion.

    Another huge reason people don't bothering reading the ToS is because you HAVE TO agree to it if you want to use the service. And if you're at the stage where you're accepting ToS you clearly need to use the fucking service. If I'm making a RUclips account I can't just disagree to them being able to ban me at any time for any or no reason because otherwise I don't get to use the site. So even if it said something insane like you don't get to sue Google for the rest of your life you just have to click it.
    That's why the courts should absolutely just throw these agreements out whenever a company is overreaching. Whether they actually will is another question but that's the only way to fix this issue otherwise we're just relying on the good will of billion $ companies.

      These agreements even affect you if you agreed to a much, MUCH older version of the TOS, because they can claim that you continuing to use the service (or even just plain not terminating your account) meant you agreed to the terms.

      EU has a law in place that if your legalese is too long and or purposefully complex and hard to understand, even when you agree to TOS, you can argue that it's meant to confuse and trick the consumer into something they otherwise would not agree to.
      Most companies here have it just to cover their bases, but there are protections for the average person to prevent "selling their soul" type deals.
      So if a company tries to say "well they agreed to it" it can be argued that they didn't because the language was purposefully confusing or intentionally long.
      Most people don't know how to read a legal document as it's not taught in schools.

    FYI: Most lawyers agree that TOS agreements fall under the category known as "shrinkwrap contracts."
    Shrinkwrap contracts are essentially stickers slapped onto products to say that the company is not liable for any damage the product may cause due to misuse or negligence on the consumer's part. However, it is a legal precedent that agreeing to a shrinkwrap contract can not and should never extend past that point.
    TOS agreements function the same way, but there has been a rare number of cases of TOS overreach that would cause the courts to put them back in line.

      @@env0x For the EU it's called "EU hierarchy of norms" with TOS having one of the lowest ranks possible.
      As far as I know, the same holds true for the states: Constitution > Laws > Regulations > Contracts
      since tos are part of the contract, they are even lower then a contract. so if anything contradicts a TOS the tos will not withhold.
      A lot of cases are won in the eu, by the customer since the company did not properly established the "right of withdrawal".
      General terms and conditions are invalid if they disproportionately disadvantage the customer. In addition, clauses that are surprising or non-transparent are also invalid. This applies in particular to provisions in which the intended use is not clearly and completely explained. (EU not US)
      I would assume that something like this exist in the states.

      Also surprising things in TOS are invalid unless you prove that they explicitly knew about that point. Because the idea is simple, you only consent to the parts of a contract you are knowingly consent too.

    The funny thing is that I actually do read terms and conditions. To the point I have spent over an hour googling terms because I didn't understand entire passages. Mostly because I'm terrified of losing property rights or having to pay out because I did something I didn't know I agreed I wouldn't do.

A couple who were left with life altering injuries after an Uber crash couldn’t sue the company because their 12-year-old daughter had agreed to terms and conditions on Uber Eats while ordering a pizza that prevented them from suing the company.

      if a person(s) under the age of 18 signs a contract without the consent of a parent or legal guardian, then the contract is then null and void.
      Additionally if the daughter was the one to sign the contract then by letter of the law SHE couldn't sue, but her parents could provided they themselves did not agree to the TOS on their own account. Because you cannot sign another onto a legally binding contract without expressed consent.

    9:50 I think what makes the idea of referencing Humancentipid in this episode so much funnier is the fact, that by knowing it is a reference to a classic, the show is implying that Steve Jobs didnt even come up with the idea himself nor the apple team. They just stole it from a lesser known individual, reshaped some details and announce it as their own branch. Just like real Apple with its moder Smartphone features

      A comfy medium between finding The Simpsons or Futurama too hand-holdy in delivering their intended message.
      And at the other extreme, Rick & Morty inexplicably being too obtuse or morally ambiguous with their messaging.
      Who can really say how many people got confused & irony-poisoned, and actually misinterpret, the subtext of Rick & Morty? People who coincidentally aren't aware that the character they've been identifying with, Rick Sanchez, is not the protagonist they mistake him for, he's actually the irredeemable villain. A similar misinterpretation as is done with Scott Pilgrim Saves the World (original movie).
      The "main character" stays high off their own supply & abuses everyone around them with their delusions of grandeur.
      The misunderstood anti-hero who's cursed with the dual burdens of a superior intellect, and also a deadpan delivery (others describe as "glib") of hard to swallow truths. "he's literally just like me fr!" is the fictional yarn I've heard woven by far too many...
      Rick's opinions/positions appearing to align with reality, have equal significance as the twice daily a busted timepiece accurately tells the current time (the Broken Clock meme). 🤡👍🏾
      I know Bojack Horseman also belongs somewhere along this spectrum, but I'm honestly not quite sure 'where'.

      Never gonna happen. Find any video or social media group with mostly Americans, and write a post stating corporations should pay a lot of taxes and if they avoid it they shouldn't be allowed to operate in the country, that there should be anti-corpo laws in place, or even laws against price dumping. People will dismiss it by calling you a commie socialist that needs to GTFO to Europe. And then complain about Disney or whatever.
      When EU introduced laws forcing Apple to use regular USB C ports, meaning everything has to use the same charger, meaning you will be able to charge every portable device with the same cable. One of the biggest reasons behind this was Apple introducing a new port every generation, forcing clients to buy THEIR cables everytime they break or buy new device, causing tons of waste in electronics etc. The entire world was celebrating this... besides Americans who called it communism. You get my point im sure lol.

    As someone who has loved South Park from a distance for a long time, it is shocking to me that one of Cartman's most iconic scenes is from an episode fans habitually skip. Almost as shocking as the fact that people aren't familiar with The Human Centipede?!? I mean that's tip of the iceberg of disturbing films. Like, I wouldn't expect people to know A Serbian Film or even Salo but I thought Human Centipede was a cultural touchstone especially for the kind of people who watch South Park.
    I have yet to have the pleasure of actually watching any Human Centipede films but the second I heard Blooms say "the Human Cent-iPad" I knew what we were in for and this episode sounds like it would be one of my favourites, if I actually get around to watching the show all the way through (Still on Big Al's Big Gay Boat Ride from S1 on my first sequential viewing)

      they streamline most of the animation now which makes things a lot easier and quicker, and why they can get through a single episode in a week. but when matt and trey first began animating they did everything by hand with cardboard cutouts, frame by frame, all by themselves.

      Ehh, it's a lot less a question of evil than it is incentives. They are a company, an entity that is not capable of thinking or taking action on its own. Rather any action taken is taken by people on behalf of the company. And often those people don't see the bigger whole because they are a small part of the company. The actions they take are based off what they are instructed and what they are incentivized to do. The result of every individual decision is what you see as the things "Disney" does.

    It's worse than Disney. Uber was getting sued by 2 people that were in a major accident when riding with their driver, and got the New Jersey supreme court to uphold their tos. Worst part is that due to their underaged daughter ordering a pizza off of Uber Eats (a separate app) they can't sue Uber.
    Tldr:
    Uber got the NJ Supreme Court to say a contract accepted by a minor in a separate app applies to a parents ability to sue.

      How the court found that the minor daughter clicked the button that said she was 18 and that means the contract is valid in its entirety and she somehow waived her parents rights to sue is definitely the bigger mystery. You'd think "the person who signed this contract lied and wasn't actually able to sign according to its terms" would invalidate the contract or at least make it only apply to her, specifically.

    0:14 I had surgery on my sinuses, and they leave gauze in there that usually liquidifies then is expelled during sinus flushings... However sometimes they don't dissolve and you hack it up like a loogie.... This happened to me.... And I swear to God I coughed up a cheeto sized piece of gauze that was dark reddish brown... and my mind went INSTANTLY to this exact episode (Red Hot Catholic Love and in particular the moment when Randy first finds out you can poop out your mouth).... So I can honestly say this cartoon has warped my fragile little brain...

    almost certain putting "You cant sue us for any reason" in terms in service is literally illegal.     The Disney lawsuit legitimately makes me sicker to my stomach than the South Park episode does; several times over. Could you imagine if an individual tried to get away with a claim like the one Disney tried to make?
    "Yeah, I killed that person but 4 years ago somebody signed a contract that said it was ok". In the case of a single individual they would be in prison for life, but because Disney is a big corporation with a lot of money they almost got away with it. Not saying I know a better way to run a country, but capitalism really does make me sick sometimes.

      The root of the problem is selfishness, we can build all kinds of barriers to obstruct selfish choices but human minds are excellent problem solvers and someone will always find a way. It’s why a common saying about communism is that it is excellent on paper but not in practice. On paper you can exclude the human element, but as soon as you try to make it reality our flaws seep in and find the cracks in the plan and exploit them. And sure you can go back in and make changes to fix mistakes but someone will find a new one.

    More recently Uber did similar thing. An Uber driver good into an accident and the people that got injured can't sue the company because their daughter used their food delivery service or something.
    Also I find the fact that South Park creators use apple computers (as shown in that documentary) hysterical.

    I hated this episode of South Park just because of what it did to Kyle. It didn’t just humiliate him. It didn’t just torture him. It completely ruined him. Why did it have to be Kyle? 😢
    I especially hated Cartman in this episode. The fact that he shit-talked about Kyle for being in that position and only got lightning struck at the end was not a bad enough punishment for him. He should’ve been part of the centipede, suffer the same fate Kyle did, and see if he likes it. 😡

      Truth be told, its not a really bad movie. Like it has some gross moments, but it is astronomically slow-paced, way too much talking to be "horror", and it just isn't all that scary. Even the grossest moments are just bleh at worst. Like if you can tolerate a saw movie or the excorsist, you'll be fine

    That Steam Terms of Service change is a lot less awesome than you might think. There are currently 2 law firms engaging in mass arbitration for a combined total of about 100k Steam users as a way around the previous line forbiding class action lawsuits. Another line in the newly updated terms states that not agreeing to the change will result in a total loss of one's Steam account and all purchases held within, meaning the 100k people not-suing Valve have to choose between dropping their arbitrated dispute or losing their Steam purchases. This gets a lot worse with another set of lines in the old and new terms regarding legal fees. In the old agreement, Valve will always cover 100% of arbitration fees regardless of the outcome of the case, so long as the cost is below $10k, which an individual case will always be. The new agreement has no such provision for legal costs in lawsuits, which means a user suing Valve and losing has to pay all legal fees out of pocket. So the real reason for this change is to force these 100k Steam users to drop their arbitration claims or lose all Steam purchases AND risk thousands of dollars in legal fees for continuing their cases in court. It is a very shitty thing Valve is doing to get out of their current not-class action suit.

      I am actually one of the many users on a case and can confirm, THANKFULLY my lawyer states that it was technically signed under duress (I use Steam in order to access the tools I use in order to do my freelance work), therefore the agreement could be thrown out of the window, but it does make me fear that my steam account could be terminated because of this.

      Forbidding class action lawsuits can be a good thing because then each person is required to sue individually. It usually is to the benefit of the COMPANY, not the plaintiffs, if people classify as the company only has to spend money on a single lawsuit.
      Lawyers push class action lawsuits because it targets lazy and poor people, which tend to be the most likely victims of consumer fraud. The biggest winners are the legal team as they get 50% of a settlement, while the other 50% is split evenly among everyone in the class, which usually comes to a pittance.
      Secondly, if you already are engaged in legal actions under the old terms, new terms cannot invalidate those actions, even if you accept them.

    Valve was one of those companies who actually had very fair arbitration terms since they would pay the entire bill up to 10k regardless of outcome, including your lawyer cost.
    However they also forbid class actions.
    Now, two major players in the class action game sniffed easy money and prepared to flood Valve with thousands of arbitration cases in order to get a cut of that juicy 10k.
    So Valve pulled a reverse uno, they allow class actions now BUT in a way that would require you to delete your current steam acc if you want to be a part of it. Genius move.

      WRONG! The reporting on this was utter TRASH! 🤦 First of all, the case isn't over, it hasn't even started. Second, he was NOT suing for only $50,000, that's just a threshold number for categorizing lawsuits, just a line to determine where and how the suit should proceed, depending on if it's over or under $50k. It's like how suits under $5k go to small-claims court instead of a jury-trial. Or, vandalism becomes a felony if it does over $5k in damages and can results in prison terms of up to 10 years, versus six months if less than $5k. He was obviously suing for a LOT more. 😒

      See the problem with that, is that it relies on legal precedent, and courts being responsible and consistent.
      The courts could always just change their mind like they have frequently recently.
      Sure they aren't going to do something like the centipad obviously but they could definitely start baby stepping in that direction, making it easier for companies to seize your rights.
