      It's not just this city. Municipalities all over the US have been dismissive of citizens rights for too long and in too many places. Tons of munis have illegal or contradictory laws on the books. The bullies have been able to prosecute mass numbers of unlawful cases through what can only be called racketeering. An ordinary citizen simply cant afford the consequences or in most cases submit and hire a bar colleague of the court in any case pleading guilty. Mass numbers of American citizens have been racketeered into guilty pleas for which they were innocent. Great work dude! 👏👏👏👏👏🏆

      @@OromeVala The execution of this one was actually diabolical. The sign in the lobby says "No filming past this point". The sign outside said no filming in accordance with the ordinance, but didn't list all the restrictions of the ordinance. But once you read it, you see that filming in the lobby is illegal!! So if you were there in the morning, read the sign and then came back with a camera to ONLY TURN IT IN IN THE LOBBY, as the sign said you could, you'd be in violation of the ordinance and subject to arrest and fine. This arrangement could only have been made by truly evil people who want to steal from and harm the innocent public.

    Amazing how officers were so aware and well informed on an ordinance that had existed less than a month, but they always seem shaky on the details of ID refusal, when they can detain someone and everything else related to your basic rights.

      @@jorgueruelas482 I think he is saying it was dismissed because the ticket was improperly marked, they checked "Female", so perhaps that's the reason as opposed to the obvious unconstitutional ordinance. I am waiting to hear the status of the other 2 or 3 auditors who were also ticketed for the same ordinance.

      @@ShainAndrews He will, ticket dismissal is just another evidence which goes in his favor. There were 1st and 4th amendment violation, illegal detention, civil rights violation, illegal search and seizure (they turned his camera off, it's same thing like they went through his phone, without warrant they are not allowed to do that) and threat with arrest. In eyes of the court threat with arrest is same as arrest, you must comply with orders, they said we will arrest you. It's slam dunk lawsuit for him since he won many of them, he knows the drill. It won't be 1 mill dollar settlement and it won't be next week, but in period of 6 months to year he and his lawyer would be richer for 60 to 80 thousands $.

    Ticket is dismissed, now the civil case can begin. Sue them into the ground including those two officers. The only way to make this and every other small town understand is a civil case. Without case law based on Turner v Driver others will try the same.

      Wrong, it does not effect them when they waste public tax dollars. File criminally for unlawful arrest, detainment, imprisonment, rights violation etc under the color of law all while carrying a deadly weapon. That makes a lasting impression!
      Once you file you then fall under the protection of the State for jury/witness tampering etc. if they mess with you in any way that is perceived as pressure, retaliation or threat!

Corrigan only has 1595 residents and a payout will way heavy on each and every pocket, they there people will be the ones putting pressure on the cops to obey the law and constitution.

    The city should terminate the services of any lawyer that they had review the ordinance, or provided a supporting opinion when it was passed. If the city moved forward without a review, then the taxpayers should call for the resignation of the officials that passed it. A sizable settlement should be awarded to motivate the taxpayers to follow through.

    It’s great the ticket was dismissed but something needs to be done about it being written in the first place. Way too much leniency and benefit-of-the-doubt is given to government agents who can wily-nilly jack up peoples lives.

      Except that Neither Phil nor the other gentleman who was cited were ever "chained in and thrown in a cage like a mangy dog." They were issued a citation on the spot and released immediately thereafter; No chains, no cages, no dogs. So that makes it a lot less egregious of an offense committed against them.

      @Steve Casian Barry Fields was being metaphorical in his comments. Phillip was unlawfully detained which when they seized his cameras and his persons that is called a custodial arrest. The ticketed him. Does not matter that the chargers were dropped and dismissed. They took down the illegal signs which is an admission of guilt. Everything thing done is absolutely grounds for a civil lawsuit for deprivation of Rights. And they will try to settle out of court with no admission of any wrong doing. If I was Phillip I'd take them to court except no settlement unless they give a public apology of wrong doing and a nice hefty check. Otherwise let us see what jury trial will say.

Therefore, my point stands: Without egregious acts committed against them by LE, they have less of a case ( NOT "NO" CASE - "LESS" OF A CASE) against the PD & city, regardless of how unfair that may be or how wrong the city/PD were to have passed an illegal ordinance and inflicted the distress upon Phil and the other individual that they did in their enforcement of said illegal ordinance. This is not nitpicking on my part; Details and minutia matter in a court of law. That was my only point.

    Dismissal ex parte? So the judge and the DA had a conversation? Those decisions are not made in the vacuum of a judges mind.... I've had instances where the DA was not present and I motioned for dismissal.... and shocker... denied, and rescheduled.

      @@Dragonstalon1001 Yup... FTA warant. Granted I know some jurisdictions and judges that are not hard core on FTA. But that is fading fast if not almost gone. I've seen them issued while the defendant was talking with their lawyer outside of the courtroom when the case was called. Keep in mind the lawyer is already entered on the case and signed in on all cases before the judge that day. They know representation is in the court house. That FTA once entered is what other judges use to set bond on future cases... if they even allow it with an FTA.

      Other municipalities should be asking themselves: "what do we gain by prohibiting filming? The ability to do as we please without accountability. That sounds pretty sweet. What can we lose? ... ..." Without lawsuits, they stand to lose nothing

      @@monkeyfunk8371 Not applicable in the case where the police are actually enforcing an ordinance passed by the local legislature. In Turner v. Driver, the police had no law whatsoever (legitimate or not) that they could claim they were enforcing. In this case, while the ordinance is invalid, it does EXIST, and that fundamentally changes things when it comes to qualified immunity.

      Exactly what I'm dealing with in San Antonio.
      515 s. Frio central substation. Officers misinterpreting signs and threatening arrest for filming or carrying firearms in police lobby. 411.209 only gets lawsuits if the sign is wrong so the new thing is for officers to say they didn't know what the signs mean.
      It does not matter once your arrested. It will take 3 to 5 years for my court date. Will always have arrest on record and the officers get to laugh about it.

    I knew this would happen because it HAD TO HAPPEN! Now, a FOIA request to find out if anyone else has been charged with this same TYRANNICAL CRIME! If so, then we need to draw attention to this to get their case adjudicated and have their money returned!

    I have been watching many auditors (I'm not one) for months now, just to educate myself on how to behave in front of a police officer. Mr Turner is a tru professional, he does his homework from the start to finish. No, arrogance, no cursing or profanity, in fact he expressly display some naivity in order for the police to dig deeper their hole of ignorance. Respect sir. I watch all your videos.

    when the court says they sent a dismissal, I would want to know if that was with or without prejudice, so they can't later refile and issue a warrant for arrest, a common tactic for personal vendetta cases, like some auditors have gone through... until its dismissed with prejudice, it means nothing.

      The ordinance was unlawful and unconstitutional. How would the city of Corrigan Texas even try this ticket in court? The city would open itself up to a huge lawsuit and waste people's time.

    I wonder what they would have done if you parked in front of the station with a TESLA recording everything. Funny how they try to make it illegal if you hold the camera in your hand.       Absolutely they deserve nothing less. Such an easy lawsuit to win, they will most likely try to settle out of court. Then Phillip gets paid but they will have no obligation to admit their criminal behavior.
