    Ordinance was voted and passed on July 20th 2021 not 2001. That seems that have slipped through the cracks during my late nights of editing.

      I know lawsuits are expensive but I be happy to donate the little money I have because I mean the unconstitutional law was passed July 20 I heard while the city attorney was on vacation. Since new now houston went up there yesterday the 28th. The signs are now down but they still have the city ordinance still in place. We all need that city ordinance taken away ASAP.

      So they passed a law to prevent audits, and instead ended up bringing the highest profile ones to town, exposing themselves to multiple unwinnable lawsuits, and realizing the ordinance was unenforceable, all within a week? Big brains in that town.

    My suspicion is that they passed this without running it by the city lawyer. After the fact, the lawyer told them they could not win and fighting it could only cost the city money.
    Philip Turner, I am so impressed with how calm and non-threatening you are during all your interactions. I think you ARE the epitome of what a first amendment auditor should be.

      Though I agree with you that Philip is awesome, we also need the unpleasant and rude auditors as well. Our rights aren't reserved just for pleasant people. I do understand that it's a breath of fresh air to watch these style of videos, but just remember the rude people are fighting for our rights as well.

    The cop that was recorded talking about how the governor was going to pass some law making it illegal to film the police needs to be dealt with too. Bad cops have issues with cameras and that guy really had an issue with them. I love how you guys got on top of this right away.

    It doesn't matter if they took the signs down or dismiss the ticket. They passed an ordinance and used that to detain you and cite you in direct violation of the constitution and your own caselaw. It's pretty sad how ignorant people seem to be at all levels of government. The fact that they thought they could get away with this tyranny is what should drive you to teach these fools a lesson.

      You know it! There is a small town just outside of Lansing that has a ordinance that states that anytime you refuse to identify to a police officer that you can and will be charged with obstructing a police office a class 3 misdemeanor with a fine of up 500 dollars and no more then 90 days in jail. The police there use it all the time to lock people up and I dentify them that way

    I'm not one for a frivolous lawsuit. But in this case, you and everyone else who was charged and arrested or at least ticketed needs to sue for violation of the 1st and/or 4th amendments. Writing unjust laws need to be fought. Get a lawyer, sue them, and make them pay, and then hold a press conference to show that these politicians who approved this law can then be held accountable for failure to do their due diligence to hire a competent city attorney to advise them that they never should have drafted a law like this in the first place, and also to get the tyrants who arrested you held accountable for their actions. The whole town is crooked, they need to pay.

      @@montymartin8609 Hi Monty. What region of Ohio? Technically, it was the Fifth Circuit Court of Appeals that made the ruling on Turner vs Driver. It never reached the Supreme Court. But either way, it is case law that this town is required to enforce.

      In this case, it sounded like he wanted to speak truthfully about how dumb and illegal the ordinance is, but didn't want to expose the city to further legal liability by saying it while being recorded. Battousai correctly valued his recording over that admission. It's not like the judge needs a confession to know this ordinance is unconstitutional.

      Oh no! The wonderful police officers and city officials don't want any recording for two reasons.
      1. Terrorist that target cops MUST record them in broad daylight first otherwise they have no idea how to hurt any of them. See? Don't allow recording and the cop hating terrorists lose!
      2. They want to protect innocent people's privacy. You know, keep everything they do to citizens nice and secret and with zero transparency!

      @@erikwilliams8559 Wouldn't work, Texas is a single party consent and there is no legal obligation to disclose that you are recording to a city official. If the city official was employed law enforcement, then it could be a legal mess but the odds of the city manager being a cop also is almost none existent.

    I called and complained several times to the PD (not an officer), city hall (left messages not a real person) and I called several prominet businesses and told them they would probably be the ones who would be paying. Only one person listened, I sent her a link to Turners and another arrest/citation. City managers are who I call to complain to besides PD because they know that their city could lose money and unlike PD managers care about losing city money.

      It is true though. Documentation errors get tickets thrown out all the time, even dumb things that have no material impact on guilt or innocence. I once had a speeding ticket tossed because they put the wrong make/model of car I was driving, but they had everything else correct. I was guilty and was only there to pay the fine and try to not have any points assessed, but that one little thing had my entire case dismissed. That was my "if the glove don't fit you must acquit" moment. It is entirely possible they know this ordinance is unconstitutional, so they write citations for violations of their fake ordinance, but screw up some little detail knowing once they get to court it will be dismissed just because of that. The goal isn't to collect money or solve some problem in town, it's to make your life hard (look at all the leg work Turner is putting in for this one citation) for doing something you are allowed but they don't like and have no legal way to stop. Cops are resorting to social engineering now to stop auditors and people that record interactions with them because legally they got nothin.

      @@jdanon203 I agree that could be a tactic, like claiming video is copyrighted by a city to avoid a social media stream. If the officers in the Turner video weren't so pumped up when they were jacking him, I'd lean more toward this being a paper chase to frustrate the 1A auditor. There are other municipalities who are wrapping enter blocks with crime scene tape in an attempt to avoid the watcheye of 1A. We end up right back were it needs to be. That government works for us, and public servants are in the public. THAT'S when this ends. When the government employees accept they are not above the law

      Curious, I called the Georgia sheriff's office that had arrested and detained the Canadian woman, for driving without a U.S. driver's license.
      1.) Officer who answered the phone still did not know Canada and U.S. have a treaty recognizing each other's licenses.
      2.) I was not allowed to leave a message for the Sheriff. *Supervisor I was handed over to kept informing me (3 times) she was the Sheriff's wife.* Kept telling me I was a "piece of cake". Didn't realize until later that's a southern insult. Oh, and she still insisted the arresting officer was right.
      3.) Called governor's office about above. They were appalled. I don't know if there was any follow up though. Also called local newspaper who sounded very surprised. Called Canadian embassy in Washington, D.C. who sounded bored.

      @@veramae4098 I actually live in Australia and even I know that a tourist can enter the US and drive on their foreign licence.
      I have been there and driven cars on my Australian licence.
      I really can't believe sometimes seeing some clips how poorly educated US LEO's are.
      I have seen clips online where someone shows a Californian Cop an out of state licence and they wrote a ticket for not having a valid drivers licence while driving in California. They seemed to believe you have to have a divers licence for each state you drive in.

    Considering that the officer said that the governor was writing a law to make it illegal to photograph police I wrote a letter to the governor and asked if he was writing a law that violated the constitutionally protected rites of his citizens.
    Haven’t heard back yet.

      @@cabinbills6743 to not allow the easy "cop out" of marking the gender "female", I think it would be great if they (Mr. Or Ms. Turner) became gender fluid and identified as female at the time of arrest and for court. I'm nearly certain, they figured out who they were messing with. Then intentionally created a formality on the citation so there wouldn't be a need for court.

      City Manager doesn't have that kind of power, only the counsel does. The next meeting should be full of people concerned about this. When the city manager said he had to protect his city he meant that he couldn't ask the question he wanted to ask because he was being recorded. He didn't want to admit to anything on tape, which is reasonable because he watched the videos and knows that a lawsuit is very likely incoming.

      His rights were violated by the ordinance that was passed which was illegal in the first place , so the fact he was detained and unable to leave for doing a constitutionally protected thing definitely gives him a case for a lawsuit . His case doesn’t go away because it was dismissed and quite the opposite cuz it shows they never really had a real reason to detain him…

    The City Manager does not want this to go to an Appellate Court. He, the city’s court will make your ticket go away to avoid being embarrassed at the federal level.

      A ticket dismissal at the city level in this instance would only help Mr. Turner. It shows that the higher-ups KNOW their officers fucked up big time so they won't pursue charges. Mr. Turner was already illegally detained and issued a citation, it doesn't matter what the city manager or anyone else does at this point. That little podunk town is about to write some big checks.

      @@vpnhp1524 Heres what the town was hoping by writing that ordinance which the distinct caveat of saying you are only violating the ordinance if the sign is present they thought they had a work around with the Turner v Driver so they would be able to stop the videoing of traffic stops by citing the ordinance in the hopes that the average citizen would just pay the fine and move on...unfortunately the two people they tried to screw with were NOT average citizens!
