Hey Donald Milazzo, the internet is forever. You've left behind a great law-enforcement legacy for yourself. Your family must be so proud!
A legend in his own arrogance and idiocy.

If you have a police lieutenant who is that stupid, then the entire police force is in bad shape.
Jeez... when I ever need a lawyer to present me in a case, I'd like to have this one. Well done!!
He’s so good, so would I lol
*The question I have is how in the world this man became a lieutenant for 25 years in a police department, totally unbelievable*
He was promoted because he is corrupt. Like in every department. Why is this unbelievable?
Low IQ hiring makes for better unchecked corruption!🕵🏽♀️
that is literally the most believable thing i can think of. Like besides that if you jumped you'll fall down or the sun will rise in the morning, that's pretty much number 3 "incompetence is highly rewarded in police departments"
Who you know not what or how much you know
He isn't the brightest bulb in the chandalier
What kind of Lieutenant has never arrested anyone, never read anybody their Miranda Rights, and didn't know anything about the Fourth amendment!!!!! Something in this Country I just don't understand.
Something in the State and Agency that he’s employed to Police.
cops dont have to know rights they just do vibe checks. better pass that vibe check
Paper pusher and one step above a security guard
He was the Lieutenant at the Court House is why.
@@MomentsInTrading I was put into custody when I was sentenced and refused probation. At the courthouse. Ignorance of his job is ignorance of his job.
A 27 year officer, 22 years as Lt. and a Sergeant both had little to no understanding of the laws !
Unbelievable!
Im guessing the Lt. may have had nude pics of someone higher up.
Miss Bergquist's attornery's a friggin' rockstar!!! Watching that arrogant lieutenant go from smart a#% to squirm worm mode was so satisfying.
When he asked if there is a difference between objective and subjective...I haven't had such a strong LOL moment for years now.
He doesn't know the difference between detaining and arresting (as a lieutenant) yet he is confident, that he didn't arrest her? Prime comedy.
The back and forth between arresting vs detaining questions could have been a great Abbott and Costello bit.
Sad but true. He comes off as such an idiot. My 7 year grandson sounds more intelligent than this loser.
The embarrassment went through my bones
Or better yet...
* An arrest vs detention..
* 4th Amendment content
Miranda Arrest Warning
* Probable Cause vs
Reasonable Suspicion

Why did she have to go before the judge if she wasn't arrested?
That attorney was snarky and sarcastic, and I'm here for it. He shredded that idiot.
😂
I'm 30 minutes in, and it appears to me that the prosecutor makes a very big effort to appear almost as stupid as the defendant. I'm not sure it's a tactic.
As a fellow snarky and sarcastic person, I love this prosecutor.
Well to be fair, it ident's take much to shred this total idiot js lol

Well said
He's not a cop

How ignorant and arrogant is this police officer? How many years? Never arrested anyone? A true disgrace.
It's nice to see a senior cop who doesn't actually know or understand the law, and never bothers to lookup the laws, just goes around arresting people based on what he subjectively thinks is the law.
THIS WAS HIS FIRST ARREST IN 22 YEARS !
And DOESN’T know the difference between detain and arresting a person! 🤡

He must have made sure other people filed the paperwork; premeditated corruption.
But while he has not made arrests personally he has advised others when to arrest and that is a huge problem imo. He should be fired immediately!
He 💯 made arrests. It’s just that they are so comfortable with lying. They don’t even think they’re doing it
The level of ignorance of this 🤡 about the law is breathtaking…and to think he has 55 people coming to him for guidance and supervision 😵💫

He doesn’t know the difference between objective and subjective
My first question is, how can you be a lieutenant and have never arrested somebody before in your entire career. That man should never have been in that position.
Did you just watch the first 30 seconds of this or something? Lol... Notice how almost all depositions the person being deposed is always snarky. There's a reason for that and it's because lawyers ask leading questions.

Thank god for cameras that now can tell the stories without a cop lying about it.
Q.) What's the difference between arrest and detain? A.) I don't know.🤯(see 37:00)
I love how the lawyer followed that with "Is there any training required to become a Lieutenant?". It's quite incredible how officers like this are able to climb the ranks on the basis of what I assume is pure nepotism via the 'good ole boys' club, where they clearly have no clue on how to actually enforce the law.
Isn’t that frightening this muppet is a cop?🙄
Lured him right in, later claimed he only detained her. How do you know the difference??? hahhaha.
Freemasonry at its finest
Failing upwards, as they say.
@@agorpb5871 claimed he detaine her, said that was his "legal basis" for looking thru her property to id her (legally you dont have to id yourself until an arrest), and then said that its "case by case" as to whether or not you keep questioning people after they ask for a lawyer. Holy fuck how did this man make it this far
This is pathetic, a Lieutenant has no idea what the law is, what peoples rights are, and when he's allowed to arrest someone. He's not a cop, he has no business in any authoritative role.
She bruised his ego that’s why he arrested her.
Exactly, an ignorant law enforcer who knows nothing about the law, how did he go up the ranks, clearly this shows how mediocrity runs havoc in those police departments 😢
He knows the law. He’s just playing dumb because for whatever fucked yo reason he thinks it’s his best defense.
Lawyers learn the laws, not the cops.
Right, he should NEVER have that authority
This lawyer is a beast!!!!
In todays climate that lawyer would get hurt very badly
The lawyer is so patient and good.
It's horrifying how many police officers, especially long serving ones, who don't know the The Constitution or the law
Let them tell it they’ve “been doing it for 20 years and know the law” even though they’ve been doing wrong for that long.
More time in the range, then the library sadly.
Miranda!! Don't know Miranda! Scary 😳
Only the sheriff is responsible to the constitution. Stay in school
You are thinking of lawyers, they are the ones that study laws and the constitution. Police are just taught everyone wants to kill them, literally not even taught about your rights..
I saw the video of the incident & he deleted her pictures, she even asked him "are you deleting my pictures" & he said YES!
The level of WTF?! can not be overstated with this situation. 27 years as a cop, doesn’t know the Miranda Rights, doesn’t know the difference between detained or arrested…etc. What has happened to America?

Wow! This lawyer is righteous. Also 'astonishing', this cop's ignorance of civil rights.
His ignorance, while astonishing is not uncommon.
Were you mandated to wear a mask during covid ? Civil rights , tell me about your civil rights
The Lt. is not a cop.
Solomon M. Radner is the lawyers name
I don’t think he’s “ignorant” of our civil rights, I think he’s used to being in a position of power and knowingly abuses it. He’s using his qualified immunity to basically say “oh, my bad, I thought I was right”. If he were to say that he fully understands the 4th, he’s admitting to violating it. While I disagree with it, it’s a smart legal move.
Hate to see cops like this, but love to see them exposed. I wish disgraced cops like this had to pay back all the money the public wasted on them.
That would be great!
I want them arrested and fired and not being able to look for a job in the same field.

-- He did not refer, read or get assistance to any then current written texts, policies or laws as of that date of her detainment
-- He did not give the woman a lawyer when she requested one, yet kept asking her questions
-- He destroyed her property
-- He personally violated her 1st, 4th & 5th Amendment Rights under cover of Law
-- He has never once in his career arrested anyone
-- He has never once has Mirandized anyone of their right to remain silent, etc., etc.
Best of all, he swore an Oath to the Constitution. To uphold the sacred rights of the people.

End qualified immunity. Make individuals responsible for their actions and not the taxpayers.
Police state will never allow that......how else can you maintain the police state?
You muppets don’t have any idea what qualified immunity is or how it works, you just scream it as a buzzword. Qualified immunity has no bearing on this case, as all the rights violations have already been clearly established in case law and SCOTUS decisions. Qualified immunity only works for situations not previously covered by legal precedent. Filming in public has already been established as protected under the first amendment for decades.
Maybe learn the meaning of the buzzwords you use *before* you screech them out like a child with Tourette’s. And for the record, I agree with at least significantly limiting qualified immunity.
Agreed, how about individual officers carry LIABILITY INSURANCE not unlike doctors have to carry
@@thebigguy8306💯
I don't know what you mean by that. Even if they make the individual liable, you will still pay the tax. The tax money taken from the people will just line the pockets of the corrupt system even more. If you say we shouldn't be paying tax for this, then I'd understand. But it's not like our governments are going to take any less money from us regardless of who pays the bill.

Nah that's a question on the level of a 6th grader striving to be an officer someday.

Quasi sentient potatoes are people too.
. the interesting detail, not to miss here, is that "9/11" made this(illegal act!) possible but also enabled the (illegal!?) invasion of Iraq as well as the(legal!?) invasion of Afghanistan which lead to millions of people dying, the creation of ISIS/Islamic state as well as the defeat of the USA and it's allies in Afghanistan etc etc. So have they learnt ANYTHING from any of it?
he stays behind and protects the doughnuts!!!
Sad to say but this is how 99% of cops are. We are seeing it now because there are good people going out and putting themselves in danger to record them. If not for them people everybody would still think they are here to protect and serve
So if an Officer SUSPECTS a person of suspicious activity (ex. Taking pictures outside a building) they can “detain” them, but if they suspect that a person committed an actual crime say robbery, rape, or murder they can’t arrest or “detain” them unless they have evidence of that crime. Oooook.

I cannot believe this was settled for only 15 grand. That's insane to me.
Also, qualified immunity has got to go.
thats it 15K ????? highway robbery should be 150K min
The plaintiff would have been a terrible witness, too. There was all sorts of stupid stuff she put online. She actually did record inside the courthouse - a nonpublic form - which gave them PC even though the cops were fairly clueless. The District Court granted an MSJ in a fairly well-reasoned opinion. Oh, and her criminal history - which has some extraordinarily bad stuff - would have been admissible had they taken this to trial. So she took a cheap payoff in exchange for dismissing her appeal.
This guy should be embarrassed....but more than that...his department should be livid and demand for him to step down or they wont return to work.
he works for one of the most corrupt departments in the nation
The department wouldn’t be livid. This proves that the whole department is unfit. There’s obviously no regulation on making sure their police know the law. This proves they don’t care and they believe they can do what they want. This should be on the news and be made a much bigger deal than it is. This is the police! Thus us proof they are what everyone thought they were. They are murdering people and getting away with it.
Could you imagine Johnny Cochren. Questioning him, he would have a field day
If someone says ‘I don’t recall’ instead of giving a definitive yes/no answer in this circumstance, it is legally regarded as a ‘yes, I did say it’ as far as I’m aware.
What a piece of excrement of an excuse of a human being.
This lawyer is so sharp and on it, truly incredible.
I wouldn't use such strong words against this guy. He was out of his league in dealing with this lawyer, and he should of practiced what he was going to say. It is obvious he is not one to question what other above him tell him what to do. He follows what ever he is told to do . He never questions how or why . He got to his postition by following orders and not making waves. He is a 2+2 =5 type of guy.
I would use stronger language to describe him. He is clearly trying to play in the margins to violate people’s rights.
Omg. This guy is an absolute idiot. And, the lady's attorney who is conducting the deposition is phenomenal! I definitely would have been busted giggling or making comments under my breath if I were him. Kudos for self restraint to that dude, FR!! 😂

Future Walmart Greeter
😂😂😂 so sad
Her counsel is a True Pro .!!
BOX OF ROCKS
This attorney is on an elite level ❤.
This liutenant is the law. Why in god's name has he got a lawyer at his side. Object object object object object object object object object object object object is all you hear. I take my hat off to the guy asking the questions.... A star, brilliant. Clever, clever questions asked by an extremely knowledgeable intelligent guy. Well done ..... 10/10. Flawless. This is the best of the best that I have ever seen on RUclips.
I absolutely LOVE how this attorney is treating him with the disrespect cops treat people all the time!!!
It was the "I'm not answering your questions, you're here to answer mine" That struck a cord I swear lmao.
@@wasdwasd609I also liked how he repeated to the note taker, "he said he doesn't know anything" in a way that made it sound like "doesn't know anything in general".
Savage.
Not all cops don't paint everyone with the same brush. It's like saying your Wife or mother is a whore. Not true right?
What are you talking about? The attorney treated him with total respect.
I think this attorney was very respectful and professional. I think you may be confusing his poor attempt at hiding his (understandable) frustration with the witnesses' glaringly feeble attempts at trying to hide his obvious incompetence with disrespect.
Wow!! This lawyer made the lieutenant look ridiculously dumb with no knowledge for a person in his position! I could answer the majority of these questions with ease and I have no background in law enforcement!!
he's not refusing to answer because he doesn't know, he's refusing to answer because his words will be used against him later on. the less he admits to knowing, the less testimony he is bound by at trial. not to say that awards him any credit, quite the opposite in fact. he's as slimy as they come lol
Jodie is that know it all you see with a big mouth without a lawyer. Ridiculously dumb is more common than you may realize.
Exactly!
@@sal-my1idLol no, he didn't know the answer. This cop is borderline mentally disabled.
@@sal-my1idyup. It’s because he probably knows now he has no legal standing for what he did and answering questions will ONLY hurt him.
Wait, wait this Lieutenant says he's don't know the difference between being detained and being arrested? how is he even in his position? it like he's pretending to be a cop.
I'm not a lawyer, but it is always extremely frustrating to me when these lines of questioning follow "policies of the police department". That is not the point. Even if the policy of the police department WERE to detain for filming, it is completely irrelevant. This is a 1st and 4th amendment violation absolutely 100% regardless of any city, county, or state policy or law. The line of questioning seems short sighted.
