    When he asked if there is a difference between objective and subjective...I haven't had such a strong LOL moment for years now.
    He doesn't know the difference between detaining and arresting (as a lieutenant) yet he is confident, that he didn't arrest her? Prime comedy.

      I'm 30 minutes in, and it appears to me that the prosecutor makes a very big effort to appear almost as stupid as the defendant. I'm not sure it's a tactic.

      There are no law tests for police, you are thinking of the bar exam. Officers have literal protection from being sued for not knowing the law, it is not a requirement or gone over in training.

    I love how the lawyer followed that with "Is there any training required to become a Lieutenant?". It's quite incredible how officers like this are able to climb the ranks on the basis of what I assume is pure nepotism via the 'good ole boys' club, where they clearly have no clue on how to actually enforce the law.

      I don’t think he’s “ignorant” of our civil rights, I think he’s used to being in a position of power and knowingly abuses it. He’s using his qualified immunity to basically say “oh, my bad, I thought I was right”. If he were to say that he fully understands the 4th, he’s admitting to violating it. While I disagree with it, it’s a smart legal move.

    THERE ARE GOOD COPS & BAD COPS. This a bad cop and worst yet, by his own words --
    -- He is a Supervisor with the rank of Lieutenant of 22 years
    -- He did not refer, read or get assistance to any then current written texts, policies or laws as of that date of her detainment
    -- He did not give the woman a lawyer when she requested one, yet kept asking her questions
    -- He destroyed her property
    -- He personally violated her 1st, 4th & 5th Amendment Rights under cover of Law
    -- He has never once in his career arrested anyone
    -- He has never once has Mirandized anyone of their right to remain silent, etc., etc.
    Best of all, he swore an Oath to the Constitution. To uphold the sacred rights of the people.
    But .... he did NOT.
    This is WHY all cops must be trained properly in the performance of their duties. And once is not enough. Refreshers mandatory yearly. Some cops seem to forget the Laws.

      You muppets don’t have any idea what qualified immunity is or how it works, you just scream it as a buzzword. Qualified immunity has no bearing on this case, as all the rights violations have already been clearly established in case law and SCOTUS decisions. Qualified immunity only works for situations not previously covered by legal precedent. Filming in public has already been established as protected under the first amendment for decades.
      Maybe learn the meaning of the buzzwords you use *before* you screech them out like a child with Tourette’s. And for the record, I agree with at least significantly limiting qualified immunity.

      I don't know what you mean by that. Even if they make the individual liable, you will still pay the tax.     So if an Officer SUSPECTS a person of suspicious activity (ex. Taking pictures outside a building) they can “detain” them, but if they suspect that a person committed an actual crime say robbery, rape, or murder they can’t arrest or “detain” them unless they have evidence of that crime.       The plaintiff would have been a terrible witness, too. There was all sorts of stupid stuff she put online. She actually did record inside the courthouse - a nonpublic form - which gave them PC even though the cops were fairly clueless. The District Court granted an MSJ in a fairly well-reasoned opinion. Oh, and her criminal history - which has some extraordinarily bad stuff - would have been admissible had they taken this to trial. So she took a cheap payoff in exchange for dismissing her appeal.

      I think this attorney was very respectful and professional. I think you may be confusing his poor attempt at hiding his (understandable) frustration with the witnesses' glaringly feeble attempts at trying to hide his obvious incompetence with disrespect.

    Wow!! This lawyer made the lieutenant look ridiculously dumb with no knowledge for a person in his position! I could answer the majority of these questions with ease and I have no background in law enforcement!!

      he's not refusing to answer because he doesn't know, he's refusing to answer because his words will be used against him later on. the less he admits to knowing, the less testimony he is bound by at trial. not to say that awards him any credit, quite the opposite in fact. he's as slimy as they come lol

    I'm not a lawyer, but it is always extremely frustrating to me when these lines of questioning follow "policies of the police department". That is not the point. Even if the policy of the police department WERE to detain for filming, it is completely irrelevant. This is a 1st and 4th amendment violation absolutely 100% regardless of any city, county, or state policy or law. The line of questioning seems short sighted.
