You should report this to the BBB. "New" implies a certain level of quality and they definitely didn't fulfill that obligation. You probably won't get any justice but GameStop will legally have to reply, which will cost them money and maybe prevent them from continuing this stuff. I've had similar experiences buying "new" games from them in-store but nothing like this. I'd be pissed off.
Ordered a NEW PS5 game from Gamestop, $70.00 and I got the same crap. Pre owned, the pamphlet EVERY GAME puts in the case with the disc was gone, it wasn't factory sealed in plastic as ALL NEW GAMES ARE. So I wrote them, got ONE EMAIL BACK from a "Leonel" asking me to reply with my complaint AGAIN, I did, no response, I wrote another mail, no response, then wrote a third, no response. So I disputed the charge with my bank, they refunded me the money and I still have the USED game Gamestop sent me. Plus they are out the almost $80 they charged me with shipping. But not like it's hurting their bottom line with that BS rigged stock explosion. And today still waiting for "Leonel" to reply and it's been over two weeks. They can have their USED GAME back, I'll get a NEW one from Best Buy, Walmart or any other store. I will NEVER buy anything from Gamestop again.

That’s the biggest flaw when it comes to GameStop. I never buy their clearance games anymore because of it. I was supposed to get a game in “brand new” condition but got an open, generic GameStop case that had a stupid ass circle seal.

Had the exact same thing happen when I made a purchase as part of the clearance event. I ordered quite a few only because they were listed as new and so expected they would come new and sealed. Based on the condition they look identical to the used copies I see in the stores. I hope GameStop is happy with the money they earned as I don't intend on making another purchase like this again and will just wait for deals at Amazon or Best Buy etc... It's obvious they don't care about creating long term customers. Possibly they know every month is just trying to keep it alive one more quarter before the collapse. I want to say out of the 15 or so games I bought 2 of them were actually new and sealed.

This is some shady stuff Gamestop is doing. It made for a great video and hopefully will raise awareness to this issue. At least like you said the games are good if you get stuck with them. Wow I just got scammed by gamestop too in a similar situation. I bought a "new" laptop on clearance and I was sent a clearly used laptop that LITERALLY has someone's account already in the laptop. When I called the first customer support, they talked to their supervisor and they said that usually they don't allow returns but since this was gamestops fault at their end, they would allow it. Now after a week something happened and they're refusing to refund me or giving me the item I payed for. I received an email stating "all sales are final". So I called multiple times and told them that I don't disagree about their policy, but in this situation I NEVER RECEIVED THE ITEM I PURCAHSED. Their policy clearly states that "CLEARANCE ARE CONSIDERED "FINAL SALE" AT TIME OF PURCHASE. Remember at the time of purchase not after! During the time of purchase I bought a "new" not "used" laptop and then the supervisor I was talking to wouldn't answer anything I asked him and kept repeating all sales are final. He did think about it and I'm sure he knew I was right but kept repeating the same thing. They literally scammed me and refused to refund me too as I never got my purchase that was considered "final sale" at the time of purchase. And they're literally giving me an item I didn't buy and refusing a refund. Amazed at how they're even allowed to do this for so long and not getting into any legal trouble. They obviously don't even understand their own policy as we don't receive our final sales product. Seems like anything they ship "after" the sale they just consider it the final sales product which they're breaking their own policy. Edit: forgot to mention the supervisor thought about it and then changed their story that all clearance items are sold only as used or refurbished that's why it's on clearance. I told him I took a picture in case something like this happened as I always do on every purchase I make and told him the picture clearly states the item as new. The supervisor kept just kept saying that all clearance are sold as used and that all sales are final. They're lying and they know it. So yea... If you paid with a credit card, GameStop is hosed. All you have to do is call the credit card company and tell them that you didn't receive what you ordered and they'll do a chargeback. GameStop would have to show that they delivered what you supposedly bought or they get hose again.

I have found that GameStop routinely sells games as “new” after opening them and putting them on their shelves. I once asked them why they do this and they said most people don’t care.
I'm not surprise by none of this when it comes to gamestop. Things were missing and open in my elden ring collector's edition. I do business with Amazon now.
Classic freaking GameStop! But that’s a new low even for them. I am fortunate enough to have 2 GameStop locations in the next town over from me that the workers refuse to do the shady stuff. They put the sale label in your bag and not on the game cases if the games are new and also don’t break the seals. They’ll have a few shelf copies marked new that are unsealed but if you go to the counter and ask they are prettt good about it. I’m very fortunate and thankful for that. The only issue is they are around an hour away so there’s a trek to get to them. Though you got duped, this one is still on them and their shady practices. Thanks for sharing you experience though. I’ll def watch my P’s and Q’s ordering online from them.
I’ve met one of the regular counter guys at my main location and he seems willing to take care of me. That’s a connection we all need as customers. And it’s mutually beneficial because I’ll give him preorders and pro card re-ups and whatever other moving goalposts the district people set for him.

There’s actually been a couple of commenters wanting to debate it too! I knew there would be. But it is total BS. One guy said there’s fine print, (there isn’t) but even if there was, underhandedness isn’t a good business model or an acceptable one. Period.
I scammed myself last time I was at gamestop. I bought 3 Xbox one games. Then when I finally setup my Xbox SX and got gamepass, all 3 games were on there🤦♂️
The way I see it is, Gamepass is really fairly priced, just more than we need. We’re paying almost $200 a year for that. When you could just buy the games cheap like you did because they’re ON gamepass. So you’re really doing ok.
I've been scammed by GS. I've contacted their support a few time and I never hear back unless I call and wait for an eternity. I ordered a bunch of games on the cheap in November Never received my new copy of dragon quest XI for the ps4. It was on such a bargain that Im not too upset but I'd still like my game. Its odd to that order doesn't show up in my account so I have to go to the email. It's like they screwed up, I called them on it and then they covered it up. The fight isn't over yet.

I have Rift Breaker on my Amazon wish list and will probably be my next purchase! Disciples is a fantastic game that I've played and completed last year. I order a refurbished PS5 console from gamestop and it was broke and I don't know if it was gamestop or Fedex did it. My wife said she heard something flop the porch. Anyway I got a free new PS5 out of it.
Mur, I ordered some "new" games around Christmas on sale and a few were opened as well with minor rips in the plastic case. Nothing should be sold as new if the manufacturer shrink wrap has been removed. Oh, and today I went to use my last $5 monthly coupon but since my membership ran out a few days ago they can't honor it unless I renew my membership. Say what? That coupon is issued under my last membership and should be honored. I told them to blow and walked out.

You say that they offered to sell you apples, you agreed to buy apples, and you ordered and paid for apples, but they then sent you pears. Your view is that because the pears were the same price as the apples, this is legal and there is nothing a consumer can do. On that basis, people who order beds can receive chairs and people who order doors can receive windows, as long as the price matches. It would probably be best to now read the small-print and see if there is any mention of substituting pears for apples, and if there is not, bring this to the attention of Gamestop management. . .

I read into it for the sake of it. No mention of possibly getting used items when sold as new. Even if there had been, that’s not acceptable business. Even if the print said you might get a wet dog turd in your order box, it really wouldn’t make it ok if you did.

From Grapevine down to the local stores, the leadership of GS aims to 1) convince you to preorder upcoming games 2) push the Pro membership although they constantly water that down to screw even their “most loyal” customers 3) offer you next to nothing for trade ins and 4) scam customers by selling whatever they have in whatever condition it is to unsuspecting customers. Look no further than YT videos of folks buying consoles and games only to be promised one thing and receive another. Worst of all, they pay employees next to nothing to alienate good workers and fill the stores with sales-zombies with little interest in forging a community of gamers. It’s a weird scenario. Because I’ve sold a few of the games and profited a little. I’m keeping like 3 of em. So at that point I’m kinda committed to handling this myself. But you’re absolutely right. Reverse charges is an option had I retained the merchandise to allow them the option to reclaim it. It’s all just so stupid. Well I dont order anything used on gamestop anymore. Only new stuff I will get is stuff I plan on opening. I live in a small town and we have a gamestop but its stock is garbage, pretty much if you dont preorder something it will never appear in the store. Any good stuff they have it goes to online orders, which imo is killing their brick and mortar stores faster than they should be dying. Even when I preorder to pick up at store the quality of what I get sucks. I got the bayonetta 3 masquerade edition and only 2 went to the store, the other was for an employee. Both our boxes were smashed on the corner. So you basically take it as is or you dont get it, alot of collector edition you cant just get somewhere else after the fact. Long story short gamestop sucks, but like in my town I still want to support it cause when it goes there is nothing but a walmart.

They were just waiting for someone like yourself to order. If they had them marked clearance I'm sure it was stated somewhere maybe not so obviously but it was there that these were final sales So they got you oh well. Hopefully the RUclips video will make it worth it.

The problem is you’re a reseller and GameStop actually has an unspoken policy not to cater to resellers which I understand bc resellers can harm their sales and can harm gamers in general. I don’t begrudge resellers when they keep it to a reasonable level but just buying up stock so no one else can get it is extremely selfish imo
He bought a couple different games. He didn't use bots and hoard tons of copies of these (very low value) games. This has nothing to do with re-selling... And the concept of re-selling for the purposes of building a collection is way different than scalping. People who collect and find these games out at flea markets or thrift stores are basically the only ones keeping the market for physical retro games alive. I don't see it as selfish at all.

Classic freaking GameStop! But that’s a new low even for them. I am fortunate enough to have 2 GameStop locations in the next town over from me that the workers refuse to do the shady stuff. They put the sale label in your bag and not on the game cases if the games are new and also don’t break the seals. They’ll have a few shelf copies marked new that are unsealed but if you go to the counter and ask they are prettt good about it. I’m very fortunate and thankful for that. The only issue is they are around an hour away so there’s a trek to get to them. Though you got duped, this one is still on them and their shady practices. Thanks for sharing you experience though. I’ll def watch my P’s and Q’s ordering online from them.
I’ve met one of the regular counter guys at my main location and he seems willing to take care of me. That’s a connection we all need as customers. And it’s mutually beneficial because I’ll give him preorders and pro card re-ups and whatever other moving goalposts the district people set for him.
@@Emceemur Absolutely! I always try to stress to people how important a relationship with your gamestore workers, people in the community or resellers truly is. Some people don’t realize how beneficial the “you rub my back, I’ll run yours “ mentality really is.
I'm glad you made this video. GameStop needs to be called out and stop these shenanigans. You got hosed pretty bad, and you experienced what I've been experiencing for years with GS and even commented on in your other video where you got lucky getting actual new games. I hope everything gets resolved to your satisfaction.

So you bought games for clearance online and all sales are final. Why would you do that. Go to the store to buy something that is a final sale. If it was open it was the only copy in the store. Blame other ppl for your decision making. I see how this channel works 😂

There’s actually been a couple of commenters wanting to debate it too! I knew there would be. But it is total BS. One guy said there’s fine print, (there isn’t) but even if there was, underhandedness isn’t a good business model or an acceptable one. Period.
You can still input a DLC code to see if it's valid. If it lets you redeem it, it's good. If you back out of the redemption, it's still valid.

I scammed myself last time I was at gamestop. I bought 3 Xbox one games. Then when I finally setup my Xbox SX and got gamepass, all 3 games were on there🤦♂️
The way I see it is, Gamepass is really fairly priced, just more than we need. We’re paying almost $200 a year for that. When you could just buy the games cheap like you did because they’re ON gamepass. So you’re really doing ok.
I've been scammed by GS. I've contacted their support a few time and I never hear back unless I call and wait for an eternity. I ordered a bunch of games on the cheap in November Never received my new copy of dragon quest XI for the ps4. It was on such a bargain that Im not too upset but I'd still like my game. Its odd to that order doesn't show up in my account so I have to go to the email. It's like they screwed up, I called them on it and then they covered it up. The fight isn't over yet.
Yeah, it’s just overseas call centers. Screen readers. GS hasn’t given a s*** for over a decade now. It’s a miracle they’ve survived this long on funkopop sales.

@@Emceemur they replied finally. The third email was a charm! They said the game is back ordered, I doubt they'll be getting more. I'll probably have to settle for a refund. Thing about inventory is that you usually leave room for error especially online stores. Just shows how poorly the place is run, top to bottom.
The “new” open copies is the single reason I don’t shop at GameStop. If they’re discounted sure but I’m not paying full price on an open game.
This totally sucks! But seriously, I'm not even that surprised with all the shenanigans they've been pulling in the recent years! I have Rift Breaker on my Amazon wish list and will probably be my next purchase! Disciples is a fantastic game that I've played and completed last year. I would be totally surprised if you didn't like that one! Those Collectors at the end, it's like they already knifed you, and now they're just twisting the knife for the sheer pleasure of it! I order a refurbished PS5 console from gamestop and it was broke and I don't know if it was gamestop or Fedex did it. My wife said she heard something flop the porch. Anyway I got a free new PS5 out of it.

Mur, I ordered some "new" games around Christmas on sale and a few were opened as well with minor rips in the plastic case. Nothing should be sold as new if the manufacturer shrink wrap has been removed. Oh, and today I went to use my last $5 monthly coupon but since my membership ran out a few days ago they can't honor it unless I renew my membership. Say what? That coupon is issued under my last membership and should be honored. I told them to blow and walked out.

You say that they offered to sell you apples, you agreed to buy apples, and you ordered and paid for apples, but they then sent you pears.
Your view is that because the pears were the same price as the apples, this is legal and there is nothing a consumer can do.
On that basis, people who order beds can receive chairs and people who order doors can receive windows, as long as the price matches.
It would probably be best to now read the small-print
and see if there is any mention of substituting pears for apples,
and if there is not, bring this to the attention of Gamestop management.

I checked. Definitely no pears for apples talk. And if there had been, this would still be mad shady. But this is just Gamestop being Gamestop. I just wanted people to know how aggressively they seem to be implementing this underhandedness.

If the smallprint says they are allowed to send used items when you order new items ..... then they could come back at you legally for what you published here. Every online purchase has written terms. A RUclips publisher needs to read them before raising cain.
I read into it for the sake of it. No mention of possibly getting used items when sold as new. Even if there had been, that’s not acceptable business. Even if the print said you might get a wet dog turd in your order box, it really wouldn’t make it ok if you did.

You get scammed just walking in the door at GameStop. I’m sorry your online order contained “gutted” copies. Even when I worked at GameStop I never understood how these games could be sold as new. From Grapevine down to the local stores, the leadership of GS aims to 1) convince you to preorder upcoming games 2) push the Pro membership although they constantly water that down to screw even their “most loyal” customers 3) offer you next to nothing for trade ins and 4) scam customers by selling whatever they have in whatever condition it is to unsuspecting customers. Look no further than YT videos of folks buying consoles and games only to be promised one thing and receive another. Worst of all, they pay employees next to nothing to alienate good workers and fill the stores with sales-zombies with little interest in forging a community of gamers. Again sorry you were on the receiving end of a “GameStop Special”.
Great write up and very well said, James. A decade ago, we had a cool community in our district with employees who really did care and really were enthusiasts. Now its all leftover holiday hires making 7 bones an hour who understandably don’t give a poop. Lolol

I think we just vote with our wallets honestly. You see all the people in this comment section that are saying they won’t order online anymore for fear of this happening. I mean, can you imagine? Lots of people have done similar videos. It’s immeasurable, but I’d love to see the calculation of just how much business Gamestop has lost with their practices.

If you ask your credit card company to reverse charges, because GS won’t take the return, they will.
It’s a weird scenario. Because I’ve sold a few of the games and profited a little. I’m keeping like 3 of em. So at that point I’m kinda committed to handling this myself. But you’re absolutely right. Reverse charges is an option had I retained the merchandise to allow them the option to reclaim it. It’s all just so stupid. All because Gamestop thinks acting unethically is their only path to a bottom line. C level idiots who hop companies bankrupting them as they go. That’s who I blame.

Wow that’s awful ! I did got a copy of tales which had a bite mark as if a human had taken a bite out of it but traded it into the store and told them the story . I barely buy new becusse of the way they call new to games they open

Well I dont order anything used on gamestop anymore. Only new stuff I will get is stuff I plan on opening. I live in a small town and we have a gamestop but its stock is garbage, pretty much if you dont preorder something it will never appear in the store. Any good stuff they have it goes to online orders, which imo is killing their brick and mortar stores faster than they should be dying. Even when I preorder to pick up at store the quality of what I get sucks. I got the bayonetta 3 masquerade edition and only 2 went to the store, the other was for an employee. Both our boxes were smashed on the corner. So you basically take it as is or you dont get it, alot of collector edition you cant just get somewhere else after the fact. Long story short gamestop sucks, but like in my town I still want to support it cause when it goes there is nothing but a walmart.

I don’t want to be captain obvious here but I think they open it and take the disc out so they can put it on their store shelves. They r scared people might steal it . If it doesn’t sell then they sell it online as “new” but really it should be listed as “new opened box”
Yes, that’s called a “gut” copy. But when you receive an order from the corporate warehouse and its all opened games? That’s BS. We’ve basically uncovered that the stores are shipping unsold gut copies back to Texas to fulfill online orders with. And that’s not acceptable. You’re right saying they could sell it as “open box”. Best Buy does. But Gamestop is actually trying to blow these out under the guise of it being truly new. And opening a collector’s edition?! They’re on crack.

They told me the one time I couldn't return or exchange a clearance iteam that's a lie I did a exchange/ return on a clearance iteam for other game n it worked 😊

They were just waiting for someone like yourself to order. If they had them marked clearance I'm sure it was stated somewhere maybe not so obviously but it was there that these were final sales So they got you oh well. Hopefully the RUclips video will make it worth it.
Hopefully so. And even if clearance sales are final, they still have to guarantee I receive what I purchased. Which was not preowned merchandise. I just want people to know how aggressively they’re doing this.

The problem is you’re a reseller and GameStop actually has an unspoken policy not to cater to resellers which I understand bc resellers can harm their sales and can harm gamers in general. I don’t begrudge resellers when they keep it to a reasonable level but just buying up stock so no one else can get it is extremely selfish imo
He bought a couple different games. He didn't use bots and hoard tons of copies of these (very low value) games. This has nothing to do with re-selling...
And the concept of re-selling for the purposes of building a collection is way different than scalping. People who collect and find these games out at flea markets or thrift stores are basically the only ones keeping the market for physical retro games alive. I don't see it as selfish at all.
