Response to Ben Brown’s Client Accusations

Despite his recent arrest for second-degree felony homicide and manslaughter by culpable negligence of his wife, Dr. Ben Brown decided to take to social media to respond to our client’s public service announcement video we posted last week, which detailed her experience with Ben Brown at Restore Plastic Surgery.
Our aim was to share Ms. Fitzsimmons’ story, accompanied by videos of her procedures, to highlight warning signs of improper practices by negligent plastic surgeons and help others avoid similar situations.
In his response, Ben Brown posted nearly nude photos of our client, along with her personal information, clearly identifying her.
He claimed she was pleased with her results and had consented to the procedures she underwent. However, his actions went beyond what she had consented to in her original procedure.
Not only did he violate HIPAA, but he also breached the Florida Information Protection Act (FIPA). Enacted in 2014, FIPA expanded Florida’s existing data breach notification requirements for entities that acquire, use, store, or maintain personal information of Floridians.
We stand in solidarity with our client and all the victims of Ben Brown, recognizing the terrible quality of care they received and the long-term effects they will endure. Should he choose to push back, we are prepared to respond with even greater determination.
