As attorney Tom said lawyers have to be lawyers. I could see getting mad about someone not giving credit and I can see protecting your Brand
100%. This whole thing is the definition of "could've been an email". Like, why is it harder to say "hey, can you add a link to my Facebook page or tag me or a link to my original video"--all of which are very reasonable requests and very easy to resolve--than it is to get ahold of a lawyer, pay them to write (or adapt a template for) a c&d? Like, surely DMing or emailing would've been faster, simpler, and cheaper. Not to mention all the bad press this is.

I mean, the supreme court case of Dred Scott v Sandford literally includes a typo in its name and all the case info about it... Bcuz some clerk put in Sandford instd of Sanford.
So theres def a longstandin precedence of a typoed name not bein a problem in court cases.

I was involved with a writer's organization that got sued. Our annual conference was at the end of September, 2001. Because some assholes flew planes into buildings in New York, most of our scheduled guests were unable to attend since, you know, the whole country was a no-fly zone. This guy was pissed because an editor he had an appointment with didn't show because he couldn't spare the time to drive or use a bus or train and there was NO FLYING to Albuquerque or anywhere else. We notified him and everyone else we could reach who had appointments about the issue and offered refunds or credit for the next year, which he rejected. It ended up on the Judge Joe Brown show. Joe Brown said "he who complains, wins." I was able to chat with one substitute guest, who said that his entire publishing career up until the year before had been in those buildings, and most of the people he had worked with were in them that day. Apparently Joe Brown did not have much connection with reality.
Night Court would be most appropriate!
You know what threatens Ms Baily's reputation? Sending an unfounded cease and desist letter to a RUclips lawyer that reacts to all sorts of ridiculous content. How could she not anticipate this would happen?

On Apr 14, 2022 around 9PM Local time I heard what I thought to be an explosion that shook my home. I began gathering supplies and made costly arrangements with my family to take flights away from the perceived danger zone.
I now realize on Apr 22, 2022, This was in fact Attorney Tom delivering the biggest "sit the fu** down" slap ever heard on RUclips from across the world.

She could have approached you in the spirit of collaboration. You obviously didn't make any attempt to "steal" the content outright, and she could have garnered interest in her own channel while making more interesting content by working with you as opposed to using a cease and desist.

It's a TV judge that pretends to have law knowledge. She's not even worth anyone's time, especially since she doesn't know anything about fair use, or how to use google to look up a name of a famous youtuber. Embarrassing.

That cease and desist letter was one sneaky way of getting Attorney Tom’s signature.

I have a feeling this letter was sent by a 3rd-party service, the same way your Facebook page is automated by a 3rd-party.
It's certainly possible. A project my nephew did was struck for the actual video because the AI mistook his cardboard recreation of the opening of phantom of the opera for a bootlegged copy. He worked it out with the people who ran the FB page in the end, since it was an honest mistake. Could be a similar thing here, though I must question why it was only an issue on Facebook if it were something 3rd party.
I'm very much thinking the same thing but that does not make the way that this was handled by the even a third party acceptable. A professional content protection team or whatever you would like to call it would be well encouraged to perform basic research on the way the content was used in terms of fair use as well as determining whether a resolution may exist that does not involve spending money on an attorney.

@@devent10n YT's copyright system is a bit heavy-handed and overly zealous. Most people don't manually claim, most claims are automatic through registering content IDs or automatic registering of content ID by the AI. I believe FB is all manual requests but can be AI scanned. So the content is identified automatically (potentially) but FB doesn't automatically assume everyone's a thief and a liar like YT does (boy, really shows what Google/Alphabet thinks of regular people doesn't it?)
Yeah, suing a bar certified lawyer over a minor non-issue in general is usually not exactly indicative of a very high intellectual capacity or intelligence. I'm sorry you had to deal with this, and I'm glad that you're not complying with such baseless requests.

Both those cud be easily viewed as within fair use, esp more likely if shown without audio.

Tom, thank you for this. Large channels and companies have been using false DMCA strikes to remove content they don't like, steal the ad revenue from smaller creators for using tiny snippets of content, and generally abusing the tools that exist to their own ends (as intended by the entertainment industry). It's awesome that you're intending to fight this. It's important to the future of content online that fair use is protected.
How to screw over your brand:
Sending a cease and decict to an attorney.
That’s exactly why I’m studying to be an attorney. Not just to make a living of what I enjoy, which is legal research, but also to stand up to bullies. In America knowledge of the law is the strongest power you can hold in your hands apart from money (for the purpose of bribery, access to key figures who can turn the tide your way and/or the resources to fight lawsuits indefinitely obviously lol). This is wonderful and satisfying to me.
Keep at it, man. We need more people like you in the World.
I'd suggest if you're going into law, you rationalize in your head that argumentation and perception is more valuable and often stronger than the laws themselves. Hopefully it'll save you that grief I went through when I realized the law isn't perfect and can be argued into a wet paper bag. Wish you all the best going forward! Whatever you do, don't give up.

I have literally responded to official and scary sounding C&D letters like this from real lawyers with the words, "Pound sand," and nothing else. Only once, ever, has anyone ever escalated. In that case, I responded with a link showing that the law firm in question was famous for bullying people whom they had no legal claim against, and I said, "I repeat, pound sand." Didn't hear from them again.
That one ticked me off. They made me actually take time out of my day to search their law firm on Google. I wasted a whole 15 minutes on them.

This is one of those situations where you just send a message. "Hey would you mind linking a reference to my channel in your Facebook post that covers my video?" Sending a cease and desist should in a civil world be the next step..
This is so gross. I loathe companies trying to force C&D letters on things that are OBVIOUS fair use. You don't have to link anywhere, that is just courtesy. You totally should give credit, and a link, as Tom always does. But not doing so has absolutely nothing to do with intellectual property. This is just a judge that knows she can abuse her power, abusing her power and having her lawyers abuse their power.

Sadly no tho. Dred Scott v Sandford didnt get dismissed on acct of a name typo in the spellin of Sanfords name. Thus theres very longstandin precedence of typos not matterin as long as they arent egregious.
If they called him Mr. Krabapple and Attorney Mat; then theres potential for case dismissal on procedural grounds tho.

I wouldn't have known of Vonda's channel if it hadn't been for you covering her. I really enjoy her content, and I've never been under any assumption it was the property of anyone else's but hers.
Thank you for replying as graciously as you did, and drawing a line in the sand. I'm not sure why Vonda would waste money on hiring an attorney to send letters like this, when a simple representative sending a DM or letter to ask, would have sufficed. I can only assume she got talked into it as some sort of package management deal. She doesn't strike me the type to have a single malicious bone in her body; yet surely, she's not a woman who will tolerate being walked over, and I'm certain many other channels have attempted to profit from her work by reuploading her content and trying to claim it monetarily.
I WOULD LOVE TO SEE YOU BOTH IN THE SAME ROOM! What and absolute force and humor you two would create. Maybe you can go over some cases together and give your opinions. One from the side of a judge, the other from a lawyer. OMG that would ROCK!
I'm not a fan of those TV courtrooms, since I find them quite exploitative, but I definitely think that having a judge and a lawyer looking at court cases would be interesting content.

Exactly! I mean how does Tom resemble a black woman? Clearly he is using video of another creator and it is very clear whose it is. The argument they make is really kind of embarrassing when you consider it has been sent to another attorney. And honestly, if you want to throw shade at least spell the person's name right. As a researcher, I am sometimes worried that we are getting closer to an age, in which we will be afraid to even cite somebody's work, because even proper citation in quotation marks with properly formatted reference to the cited work will not be considered sufficient enough one day. I am seeing academics being cancelled and ousted for "plagiarism", because the citation style they used 15 years ago is not considered enough today. Somee publishing houses have already set limits on how many characters can you cite from somebody else's work, even when it is properly referenced. Copyright law is getting out of control

I have ignored every C&D letter ever. Have yet to get a legitimate one. Have yet to have anyone follow up.

I never expected for this kind of development to happen but at the same time I am intrigued with this kind of juicy content.

Considering what Sargon of Akkad did with Akilah Obviously's video and it being declared "obvious Fair Use", ""Judge"" Vonda has no chance of winning. At least you can sue for legal expenses and get a huge payday for yourself.
""Judge"" Vonda may have deserved the courtesy before, but no longer. She has proven herself to be of low character and not deserving of courtesy. She deserves the bare minimum required by law.

Attorneys, like many people, are allowed to take non monetary payment. A lawyer representing a small family restaraunt can accept 6 months where their meals are free upon showing a card or something instead of cash payment
@@table2187 Not sure on this spec case, but at least in the case of Attorney Tom, a personal injury lawyer, it sounds like the max amount he can take cannot be more than 33.33% of a claim.
Found thru the HG organization; "While the maximum set amount that a lawyer may take does not usually exist in a dollar amount, it does generate various values through a set percentage. In most cases that progress through the civil courts, the lawyer may take at the most up to 33.33 percent of the total of any settlement for a personal injury claim. The lawyer could take less, and he or she often does when the amount pays for everything and what the two parties agreed to before proceeding through the claim in the courtroom. This legal agreement may hold the legal professional to a much lower percentage for higher compensation claims.
No matter when the claim settles or how much, the legal representative usually cannot take more than the 33.33 percent of compensation awards. However, most of the fees and expense the lawyer will acquire through the completed case are in the fine print of a legal agreement between client and lawyer. Contingency fees, deposits and other costs are usually in these documents as well." and
"It is possible for certain situations to increase the amount the lawyer will take from the settlement. These circumstances generally apply to the times when the settlement occurs after the filing of the lawsuit. The legal professional may need to help with adjustments after the defending party ignores or completely lacks taking the demand letter seriously. The state often permits the lawyer to take as much as 40 percent of the compensation awards when the settlement occurs after the lawsuit files in the state of residence. Additional costs may still tack onto the total before the lawyer takes his or her cut."
Presumably that 40% number cud be the number reached for a cap that a lawyer can ask for in any case, not just personal injury cases. But ianal and i wudnt be shocked at all if theres no cap; even if that means someone doesnt make anythin off of a lawsuit.

Seems unnecessary and shortsighted - I only ever found that divorce court RUclips channel because of your reaction video. Really seems shortsighted business-wise… why would you send a cease and desist to free advertisement?
Wow! You are such a hero. How dares a copyright holder ask for accreditation on a piece of content built on her creation and how dares a copyright holder, who specializes in legal procedures, ask a content creator, who specializes in legal matters and is an attorney, to use a lawyer to ask for said accreditation? To me, this is your grandstanding. Could she have contacted you directly and asked to be credited? Sure but considering the world you both work in, it makes sense to keep things within that area, besides, it's not up to you to decide whether that content falls under fair use, you might think it does while she might think it doesn't. It's for a court to determine.
Her marketing team is a genius. They knew this would expose them to an audience of people that enjoy legal stuff.

True, but the "All publicity is good publicity " isn't always true. People who actually enjoy legal stuff ( Tom's target audience ) will find her actions ridiculous and will be less inclined to check it out because most law nerds are not interested in " dumpster fires" which is the usual pull that bad pr can produce. I could be wrong, but that's my immediate analysis

As a growing channel I feel its so easy to get coerced by big organisations. My university is threatening to kick me off my course for posting videos including their logo when comparing different university students. It obviously falls under fair use but I don't think I can fight a whole university so have just blurred them out.
She is not a judge. She is playing a part that she dreams of being one day.
Wow. Judges should not act so petty. I have always expected better behavior from them given their position ov power.

I found Judge Vonda B through your original react video. I have since subscribed to her channel and regularly watched and interacted with her content. “Support Court” sounds ungrateful for the additional views, traffic, and attention that your channel’s video gave to the channel. Good for you for standing up for content creators clearly working within fair use.
So is the cease and desist still meaningful if they spell your name wrong?
He answered another comment on this; prty much yeah, it most likely wudnt be a problem here, as regardless of the typo there was an intent and good faith effort made to contact him and its clear he was contacted.
If the typo were more egregious like Mr. Krabapple instd of Mr. Kherker, then maybe it mite be different tho. But given it also uses an alias of his that is spelled correctly, Attorney Tom, i believe that alias wud be properly identifyin him enuf even if the legal name of his is incorrect.
Notably on the small typo case tho, the supreme court case of Dred Scott v Sandford has a typo in it cuz someone mispelled the lastname of Sanford and it just cudnt be changed at that point and thus all the case law had to refer to him by such. Tho that wud only happen here if this got followed up with a lawsuit and they still mispelled his name; but that still wudnt be cause to dismiss the whole case.
