    Great video, thankyou. All the regulations and taxes, the average contractor AND the employee take home very low pay. When I worked for a company, 14 of the 16 employees were on government assistance / ebt. We're talking about skilled artisans (who have families to provide for) making 13-16 dollars an hour, which is the norm here in Tennessee. The only 2 who weren't were myself and another fellow- he now works for me and we make a great team making very good money.

    If I am a writer for an English education company where I write lessons that are posted online, can the company post the lessons I created on their website before paying me? Neither of us specified this in the contract.

    Hello, is it legal for a company to ask their employees for the personal insurance declaration page? I do not use my vehicle for business trips except from office home. Why would they need it?

    I have an LLC and i am hiring an Independent Contractor in another state but they will be using my business name in that state. Do I have to register as a Foreign LLC in that state because I am hiring this Independent Contractor? I used all your information from this video to create the Independent Contract Agreement. I stipulated that they will be responsible for all state law requirements which I placed in the agreement.
    Can you please advise

    Your video is amazing! I am working with a company as an independent contractor, and in my contract it is mentioned that I cannot work with the competitor. Can you please tell me is this appropriate?

      It COMPLETELY depends on the nature of your work, where you're located, and the language of the non-compete. You should consult with a lawyer who is licensed in your state.

    Can the employer ask for a Non Compete Agreement ? I've only heard of non disclosure agreements signed between companies.

      Sure, they can ask for it. Doesn't mean you have to sign it or that it would be enforceable.

    SUMMARY:
    What services are they performing?
    How much are you paying them?
    When are you paying them?
    Whose paying for expenses (ie. web hosting fees, licensing fees for Adobe)
    Who owns what? Careful note: by default, the contractor owns what they made (ie. website designer owns your website). Unless you state it in the contract (ie. "work for hire") that you own what the contractor creates
    Non-disclosure, confidentiality clauses (ie. if they exposed to our finances, person info)
    Term & termination of contract (how long contract is going to be effective - indefinite?), under what circumstances can you terminate the agreement (ie. if you don’t like their work, if you don’t pay them on time)
    Indemnification: will protect our party if the other party does something wrong and vice versa
    Clarify independent contractor: does not get benefits, taxes withheld, paid sick leave or vacation pay

    Thanks for the video. I have a question regarding a small claims case where someone was hired as a independent contractor but there was no contractor agreement. I am suing someone who has not payed me for my work. However, there is evidence through text, email about our agreements. What laws are there to protect my rights here in California? Thanks.

    Hi, I have a legal question related to independent contractors that I'm hoping you can answer in a video! Are YoutTube partners, who make money off of RUclips and give RUclips a cut of their profits, independent contractors or freelancers? They don't get officially "hired" by RUclips or negotiate a contract, but YT does do a portfolio check of each potential partner's videos before making them partner, and they also have a Partner contract which lists the promises made to each YT partner. Considering this, how should we label YT partner as workers, and what rights do they have? Does it depend on the state? I've read that in New York they recently unveiled a law that gives freelancers more guaranteed rights. Do you advocate for the expansion of freelancers rights?

    As a independent contractor can the company your contracted too, can they take out for lunch, when doing the work by hours?

      Independent contractors are not entitled to meal or rest breaks or any sort of paid lunch or paid time off. If you're not working because you're taking a lunch break, you typically aren't entitled to be paid for that time.

    I have a question.
    I worked already as an independent (no contract nor anything whatsoever/not an employee).
    I have been working weekends only for about two months now and no problems.
    Now, employer is asking for my SSN and is telling me my last check for work already done wont be given until I give my SSN, is this even legal?, I dont feel like just giving my social to just a person (is not even a company), Am I in the wrong?, I will give it but I dont like his/her way and it doesnt sound even legal to me, that this person does not pay me or “kidnaps” my pay until I give what he/she wants...
    Any thoughts?

      They can't really withhold your pay because of it, but they should be asking you to complete a W-9 form. That will give them your name and SSN for tax reporting purposes.

      If you are IC I would register as a llc or sole proprietor. For tax purpose and I would apply for tax id or use your ssn complete a W9 form..
