As a CPA I have asked people who receive 1099's if they are really an employee or independent contractor. This is true of house keepers, live in nanny's, or others. The main question I ask is "how important is this job to you?" and "do you want to pay the employers portion of the taxes for them?" I knew there was a way to pass the taxes back to the employer by completing specific IRS tax forms.
If I’m an employee and I’m being misclassified as an Independent Contractor and I’m given a 1099 come tax season will I get in trouble? Or, am I just responsible to pay my taxes that I owed the government that wasn’t taken out of my pay throughout the year? Including Self employment tax. I’m a Truck Driver and a lot of small companies are doing this.

Or could you still use the independent contractor status from an IRS standpoint?
You can still call it an independent contractor because that’s what taxi cabs that’s what they do they provide the equipment but the driver is steel independent contractor

They train them:they have managers they work with;many of these independent contractors have been working with them for upwards of 7 years;they cant work with any other companies ,yet , the company feels they are protected because this company doesnt set there schedules. Are they correct?
No that’s an employer type of relationship that’s not an independent contractor type of relationship they are doing it wrong and if the IRS hears about it they could be in a world of trouble
It depends! To the employer, the worker, via the staffing agency, is usually a contractor. The employer pays the agency, agency pays worker. To the agency, the worker really could be either. It depends 🤷🏻♀️

If you absolutely zero income to report and no expenses that you want to deduct, then no. But I'm assuming you've had at least a few expenses (like registering the LLC), and those are deductible, so you may want to file a Schedule C for that purpose alone even if you had no income. Hi Aiden, If I want to hire an "assistant" starting at only roughly 5 hours per week, with potential and probability of increasing that and/or hiring an additional "assistant" where the "assistant" chooses when they are available to provide the services, however they probably will not provide the services to others because they do not have time as a stay-at-home mom, can I consider her a "contractor"? She would provide both household help (so I can work on biz to make more money!) and she would also do some tasks for the business. I would rather not have to deal with "payroll" taxes etc. I would rather be able to pay for the help I need in a contracting basis, though it may be fairly regular in nature. We have created an invoice for her to "invoice" me. Thanks, Amy

It COMPLETELY depends on the details. Nothing wrong with dog groomers being independent contractors as long as they are actually being treated as independent contractors. The specific job/industry has very little to do with it.

How about majority of the work? A worker that does mostly contractor type of work, like 95% of the time. Can I just label them as a contractor?
