    But this isn't it true for a Canadian who usually doesnt need or have a visa. If they do that and then try to go back to their own country, the border patrol agents can deny reentry into the USA.

      That was 11 years ago and I had to pay another $600 for my green last year.

    The 90 days isn’t a strict rule. It’s just a common benchmark used when trying to determine if there was “intent to immigrate” when entering as a tourist. So someone marrying on day 80 might be presumed to have had intent to immigrate and might have to provide additional proof etc and could be denied. But someone marrying I dunno 100 days after but that already had a venue booked or had sent invitations prior to entering (although not sure how the officer would find out, the couple would have to be pretty dumb to make this information available to USCIS), while outside the 90 days had the intent to immigrate when entering as a short term visitor (B1/B2).

    So would it be better to have my girl apply for visa before getting married? Or just get married while she’s here on tourist visa and apply? Want to do it the simplest way possible.
