    If you're dumb enough to tamper with the device they will find out, and if you're stupid enough to do it just so you can drink you deserve the " he goes with you" there's a reason he's wearing it for bond, he broke the rules it's simple.

  • @dexagalapagos
    @dexagalapagos День назад +4

    Yeah cause technology never glitches out. 25 hours sounds like a device issue, not someone sitting there messing with it. Wild you can go to jail for something like a failing sensor.

    • @SeanPat1001
      @SeanPat1001 День назад +1

      I’m pretty sure they checked the device to make sure there wasn’t a technical failure before making the report. These devices monitor continuously and have a time base. If there’s an interruption in the monitoring it will be in the record.
      If you have a cell phone, you can go into settings and see just how much your cell phone monitors. For example mine will tell me how much I have moved throughout the day and give me the number of miles I have walked. I’m sure these security devices are at least as sophisticated as a cell phone.

    • @fwheels7776

      I assume once the 25 hours were up it found it or it wasn't a solid 25 hours. I would assume a piece of paper between him and the sensor

    Logical argument....If the device was not contacting the skin for 25 hours, how could it record a positive alcohol reading within those 25 hours? Something technical is wrong with either the device, or the testimony of the Probation Office, the guys lawyer should have been smart enough to make this argument and the Judge in his infinite wisdom should have caught it too. If you can explain how both facts could be true, I'd like to hear it.

    Judge: It lost contact with his skin for 25 hours and he says he never tampered with it, and it detected alcohol during that time. What do you say?
    Defense Counsel has options:
    1. I reccomend the Court Admonish him.
    2. Since the device's records claim it was not in contact with my client's skin for 25 hours, then there is no way it could have detected alcohol in his system during that time period. I recommend my client be outfitted with a replacement device and any further actions regarding this matter be postponed while an investigation of the original device is conducted to inspect for tampering or a fault within the device.
    Defense's Counsel chooses option 1.
    Me: Sigh.

    This was a bad call, the story about the monitor makes no sense. How could it detect alcohol if its not in contact with the skin? And 25 hrs of tampering? Sounds like a glitch, ive seen this judge before but why was he acting like scarface?

    • @thatguyrich9822
      @thatguyrich9822 2 дня назад +4

      If consumed in large amounts, alcohol will stay in your system, and continue to be detected well after 24 hours. It's likely the suspect removed the monitor, went on a drinking binge, then reapplied the monitor after he thought it wouldn't be able to detect the alcohol he consumed.
