    Hey Jeff. Unique circumstances here. I’m a lawyer, and I took on a huge case on a contingency I thought was worth millions. The case lasted 6 years and I lost. I have a tremendous body of work from the case but basically lost every penny litigating it. The next 3 years, was the pandemic and I did have a small amount of work periodically during that time. If I write solo practitioner, or self employed on my resume, do you think that is a misrepresentation? I don’t have the income to back it up, just the work, and maybe some references. I just started applying to jobs to get my career back on track. Thanks in advance.

    • @jeffmagnuson
      @jeffmagnuson  7 месяцев назад +2

      Hi John - Thank you for sharing this and I'm sorry for the outcome of the case. Bottom line: If you worked for yourself, then it is not a misrepresentation. You don't need the income to back anything up. Your personal finances are confidential and are not to be shared with anyone. Let them think you did really well or comfortably well during that period even though the case didn't go your way. And if your actual income over the last 3 years has been less than you wanted, they'll never know. Your story is that you're ready to get back into a firm to put your skills and experience to work. You're interested in whatever firm you will interview with...you're not trying to 'run away' from the solo business. It's all about how you frame your motivations. I'd be happy to speak with you further if you'd like through a free consultation. I hope that all makes sense.

Your salary history and your personal tax forms are none of their business. There is zero reason for them to have those documents. If they don't 'believe' that you are/were self-employed, just move on. They're way out of line asking for that verification.

    I’m just a ball of confused right now because some are saying past employments do show up in a background check and some are saying only criminal doings show up😭
    Basically, I was doing paid training from July to October (my last day was in September but they sent me a form that says “As of October 4th, you have been discharged” cause I didn’t pass the training/didn’t reach the score I needed to pass). It was 8 online training sessions and 4 field training sessions in total, but the thing is, they assigned me an employee ID number even as a trainee. I don’t want to include it in my resume, but I’m afraid it’s gonna show up in a background check. Can’t companies use our SSN to find past employment, even if we don’t include it in our resume?

    • @jeffmagnuson
      @jeffmagnuson  11 месяцев назад

      I'm sorry this happened to you. There are ways for companies to find past employment...unless it's off-the-books work. Honestly, there is no point in putting it on your resume as you were only a trainee. If a company should ask (they may never ask), simply say that I was just a trainee and there is no experience to list. Your resume is not a legal document and it's purpose is to allow potential employers to see if you're a good fit. A few months of training (even if you passed) wouldn't be impactful.

    • @kindree5414
      @kindree5414 11 месяцев назад

      @@jeffmagnuson Thank you so much for your reply! I also wanted to ask:
      1. I was looking at library jobs but only ended up finding extra help/temporary jobs in my county’s offical job listing site (and sometimes those kind of jobs are listed on a the government jobs website as well) and one of the questions they ask is “Were you ever rejected during a probationary period or forced to resign or fired from any employment?” Is a trainee period the same thing as a probationary period?
      2. So, moving forward I have made the decision to not include the training on my resume, but if the place I am applying to has instructions to add a resume and to manually fill out work experience, do you think I can leave out the trainee period in the manually filling out section as well? I saw this when I was applying for a temporary administrative assistant pool job opening at my university.

    • @jeffmagnuson
      @jeffmagnuson  11 месяцев назад

      @@kindree5414 For job applications, this is where it gets a little gray as these are not marketing documents and very often have statements that ask you to sign and verify that everything is accurate. I would to be fully accurate here and if there is room to explain that it was just a training (and the role was not for you), you can, at least, explain the situation.
      You can always not list it, but the issue becomes if an employer finds out after the fact, or during a background search, then they potentially feel misled and let you go. Every company is different, of course, which is what makes this not an easy answer.
      Also, I would also say that yes, training and probationary periods are very close.
