My only wonder is, and this stems from me not seeing the other stream where the mayor did what he did - but did he really do it because it was something he was passionate about or did he do it out of damage control? If he did it to do right then absolute kudos.
What really irritates me is when the cops always seem to "arrest" someone for doing something that was constitutionally protected, but later on lower the charges to something minor because they need to justify why they arrested the individual and they know if they keep the original charge they're gonna get sued.
Also, the more minor charges are often not worth defending in court, and are so broadly defined it's hard to defend against them anyway. Never forget that the origin of Qualified Immunity came from a couple of cops who thought that some priests entering a coffee shop to order lunch was disorderly conduct (Pierson v. Ray).
Yes, and remember cops do not have to tell you what you are being arrested or detained for. It is completely irrelevant what they say or do not say as it is the actual charge which is important and this can be completely different as we see here.
Haha it would "really irritate" you a lot more if it actually happened to you. I was charged with consumption of marijuana just so they could drop it later because the officer said he smelled it. I didn't smoke weed at the time. But I am black, and this was at CSU in Fort Collins, CO, and Fort Collins is known throughout the state as a pretty rcist town.
@@Dev-In-Denver123 There was another video of cops arresting people for DUI because it was their "opinion" that the driver had been smoking week. I think the cop had something like 70+ arrests and most of them came back with negative blood results, but the cops came up with excuses saying it was already out of their system by the time they took the test. It's all BS and cops need to be held accountable for false arrests.
Also look to the DA on those sort of things. People often overlook just how incredibly awful DAs are.
Long Island Audit deserves a A+, he explained multiple times he was there to do a freedom of information request.
I watch all his videos. He's by far the most knowledgeable and respectful at the same time that I've seen.
I understand the sentiment, but ATA generally only gives that grade when the person in question both acts responsibly, and gets all their statements about the matter of law right.
While Long Island Audit definitely acted responsibly and got most of his statements about the law right, he didn’t appear to understand the difference between a public area (like a street or park) and a limited public area (like a government office that allows visitors). While on the street, there are very few limitations to the first amendment, and a law broadly limiting recording would be unconstitutional, a city hall is not a street, so it is possible that if a law restricted recording there, it could be ruled constitutional.
Of course, as it happened, there doesn’t appear to be a law restricting that, but the distinction between an entirely constitutionally protected activity and one that merely isn’t illegal is important.
While I cannot be certain that this is why ATA did not give him a perfect grade, I do think it’s likely that this (or perhaps another similar detail) could be why.
@@haph2087 The problem with your statement is that most public buildings have explicitly marked restricted areas, which Mr Reyes respects and never tries to enter. All of his recordings take place in publicly accessible areas inside these public buildings.
If a public building has an area where privacy is necessary, it is up to them to mark that area as such. And it needs to be marked explicitly and highly viewable. Not inconspicuous.Public lobbies are not those aresas. Its called a lobby for a reason.
It seems this channel didn't give him an A+ because he didn't evoke his right to remain silent. He didn't need to. Far as I know this case got dropped by Berwyn.
@@carltonbanks5470 I’d like to repeat my distinction between “constitutionally protected” and “not illegal”. It is possible that ATA was also concerned about self-incrimination, as you mentioned, I do not know.
They still tried to prosecute him and only dropped it after the judge denied their request to exclude ALL video evidence & allowed news in the court room.
Absurd and corrupt.
They arrest him under an incorrect statute, and then reduce charges to disorderly conduct rather than dropping them completely. This is how disorderly conduct is used as a catch-all charge.

If you replay the video, you'll see that at 7:33, the charge should have been "Trespassing" (as explained by ATA).

Absolutely, there's no other reason for it to exist, it's just intentionally vague to be used at officer discretion. There are already legitimate charges that can be applied to "disorderly conduct". Inciting violence, assault/battery, inducing panic, etc. are all specific charges that could be properly applied when charging someone with disordlery conduct. But they don't want to do that because those are more specific and easier to prove when they're bullshit.
AKA "Contempt of cop". It's as garbage as "contempt of court". AKA you got on the nerve of a government official, and that is illegal. Somehow.

That shit should be expressly illegal. You either lawfully detain someone, or you don't. If the guy started running, he'd be chased and charged as if he'd been detained. If you can't leave a conversation, you're not just talking. Causing a reasonable fear of bodily harm to someone for 'fleeing' from a 'conversation', without colour of right presented by lawful detainment, is essentially kidnapping.

The part that pisses me off is the officers’ instinctual behavior to *immediately* lie about wrongdoing. He literally knew he was on camera, grabbed the guys arm, and then immediately says “I didn’t do that.”
It’s like you obviously know you’re being recorded, yet feel the need to lie? It’s like what’s even going through their mind? They don’t even process anything and just instinctively lie
I'm ashamed that I went to the police academy with other Berwyn cops. The tyranny that goes on there is unbelievable. I hope Sean gets a huge lawsuit payout for that arrest.
I agree that all charges must be dropped andthat there should be nothing on his file about this incident, but why is it that every lawsuit should end up in paying the victim? I understand the legal fees, and time loss, and obviously if there's some injury. Dont get me wrong they should be accountable for things like this, the problem is that it is usally pay out by the city and not the cops, although the city gave them the authority... but i dont know, sometimes to me this settlemen agrees are just huge amounts of money that I dont understand

That is why the people should demand better police services or have their public agencies and people trained on constitutional rights because taxpayers are the ones paying for their mistakes. If a man is violated of his rights he should be compensated. Legal representation is also expensive and time consuming.
@@santiagooehlerShould always be able to sue when your liberties are taken away from you. Plus it becomes a much bigger story which last longer and drags out reminding the citizens often as opposed to just the once. Much harsher punishments come to those that take said liberties away when money is involved. A suspension is like a kid getting detention but if you cost your city x amount of $ then it’s like getting kick outta school while knowing you’re gonna go home to pick your own switch. If these lawsuits keep coming then we’re closer to some reform and a more through hiring processes for officers. Hence why their coverups usually work. Citizens shouldn’t have to know their rights, though they should, but officer should definitely know them and abide by ‘em. Those officers that beat Roddy King won their first case, not the civil case and when they lost it then I believe they got some jail/prison time.
I used live in nearby Cicero, and the cops there are just as bad, if not WORSE than Berwyn. My family and I had nothing but bad experiences with those 2 departments. I know this will sound bold, but honestly I'm more concerned about dealing with cops in that area than even the street gangs. The PD's in those 2 towns could be abolished tomorrow for all I care. Sometimes reform is not an option, and Berwyn and Cicero PDs are Exhibit A.
@@santiagooehler the reason why lawsuits end in payments is because that's basically the only material way courts can simultaneously grant punishment to the wrongdoer and relief to the victim.

Reyes is the Best. He never loses his cool, is always respectful, and he knows his stuff. He definitely should be commended for his efforts to educate people and raise awareness of people’s rights.
Yeah Sean is absolutely the best, for all the reasons you mentioned and more. He is the only auditor I watch, the rest of them don't give a shit about the Constitution they just want to act like idiots and yell at cops
Imagine if everyone in there had seen the guy recording, shrugged and said “heh…he has the right”, and just ignored him? It’ll be a major step in the right direction when cops actually learn the laws they’re supposed to be enforcing.
Especially when everyone is being recorded everywhere we go even on highways...big brother been watching citizens for years.

The major problem here is that when the city or cops are sued in a federal court, it's the taxpayer that ultimately pays for these subhumans' actions. This needs to be changed so that these crooks have personal financial vested interest in being constitutional, and not the people.
Definitely agreed. The same goes for judges, prosecutors, and every other "government" official, employee, etc. Violating the rights of the people needs to be taken a lot more seriously for the crime it truly is.

They are so ignorant about the Constitution that they forbid recording in public property in a public area without permission. This is incredible.
Maybe that is why most vets who serve their communities with honor. They made an oath when they served in the military to uphold the constitution. And not just when they leave, but throughout their life.
Also most of those vets die on patrol. But you see all of these old geezers who've been sitting behind a desk who've never thought about people rights.
Not to say there aren't vets who go curropt with power. I remember seeing as vid of a vet who had stolen 100k by cops who "acted like vets" to get on the guys good side.

I love watching Long Island audits videos. This particular video sheds light on some serious corruption within this town. I hope justice is served accordingly!
Notice the pattern, every auditor gets unlawfully arrested and harassed when they just start off but once they are well known and have a large following all of that immediately stops. Every officer who ignores the laws and falsely incriminate those very lawful acts should be fired and not be allowed to enforce those laws they clearly cant comprehend.
Well, Amagansett press was arrested a month ago and he has a large following, in my opinion he is a very good Auditor - for a long time now.

That is NOT a pattern of what you think it is. The only pattern there is to it, is that the vast majority of PUBLISHED videos show problematic situations.
You simply cannot do such statistical analysis you just did unless you have ALL of the relevant statistics. Your first statement is a textbook example of cherry picking logical fallacy. While your second sentence, an opinion, is something that probably most of the people can stand behind, it really doesn't alleviate the ridiculousness of the first statement.

The difference between organized crime and the police is organized crime is held to account, the police commit crimes days with out prosecution. These police broke the law and there will be no punishment.

Officer, “ Do you have a journalist card?” It’s more commonly referred to as a birth certificate.
I would give Mr. Reyes an a plus. He told them what he needed to get his point across. He is a great auditor.
He definitely has great skills there's no doubt and he's gotten much better over time but writing that apology letter was a really bad look for an auditor. Especially one as well spoken and knowledgeable about the law as he is and was at the time.

Long Island Audit is the most professional auditor I have seen! Regardless of what anyone he has encountered might say, he has never baited a cop. They always initiate the encounter! LIA is always as calm as he is in this video. He is a top notched auditor!

When they arrest someone for one alleged offense, but then at the station they change the offense to some blanket misdemeanor like "disorderly conduct" or "disturbing the peace" or "loitering" you know they are full of BS. It's very clearly a retaliatory charge.
There was that case between animal rights activists and county police, where the police charged the activists with disorderly conduct while trying to prevent the activists from exercising their 1st amendment rights. A judge agreed that the police violated the activist's 1st Amendment rights, and they would later settle for cash outside of court.
A month later, the county decided to amend their original disorderly conduct charge to now include criminal trespassing, citing that they simply forgot to do so previously due to a "clerical error." The activist in question was convicted of both counts by a Utah judge (unlike the 1st amendment case, there was no jury) and ordered to pay an $850 fine. He plans to appeal.
The fact that the police can just tack on additional charges MONTHS after an incident without providing any new evidence and WIN is absolutely unbelievable.
I fuckin love this channel. I'm Canadian, and after finding this channel over the past few days, I know 100x more about American law than I do in Canada, and it has prompted me to further research the rights and responsibilities as a Canadian citizen. @audittheaudit do you have or know a reputable Canadian newtork that presents law in such an in depth and valuable manner such as yours, because this is truly amazing work you all do, as well as all of the independent Auditors like the gentleman in this video. we have pretty similar laws but worded differently like "freedom of speech" is "freedom of expression" for example, "expression" which is explained as "the freedom to seek, receive and impart information and ideas of all kinds, regardless of borders, whether orally, in writing or in print, by way of art, or in another way chosen by him or her."
Good job Mayor, but its kind of scary how little the older (55 plus) veteran police officers knew about the law and the one grabbing the arm of the guy for video taping should be reprimanded perhaps prosecuted. I hope the journalist fights this in court. The staff inside city hall was clearly lying and had been doing this for probably many years. This stinks of hiding something.
The other cop that watched the officer grab his arm should be charged as an accomplice since they watched and did nothing.

Monaco grabs Mr. Reyes' arm, the uniformed officer is not going to be charged as an accomplice because management will claim that the officer did not have direct input into the decision Det. Monaco took to grab Mr. Reyes' arm. If however, the uniform officer is ordered to make a report of the incident by a superior officer, and the officer decides to falsify a Police Report by claiming that he never saw Det. Monaco grab Mr. Reyes' arm, the uniform officer can be charged with violation of departmental policy for falsifying a Police Report.

All police do this sadly they have almost no clue the laws they swore to uphold i am sure some do but it isn't many.

People get very bold and physically threatening and/or violent when they know that rhe persons they attack cannot defend themselves or fight back. It is disgusting. Changes are desperately required for OUR safety.
I’m surprised that it’s almost 2022, there are thousands of videos on this matter but most police officer or public servants have not learned their lessons. That leaves me to wonder what happened when no cameras were around. They should consider using some of these videos for training and it will eliminate the disconnect and save some cities lots of money.

They haven't learned there lesson because there hasn't been any real consequences. There have only been a very small select cases that have been very over the top that cops have lost qualified immunity. Until citizens are able to start taking personal assets from these people, they aren't going to stop.

As a dude that lives in Hickory, North Carolina I must say. My mayor Hank Guess a 30 year police veteran and then school bus driver (was my bus driver) is one of the greatest and most honest men I’ve ever met. He will chat with anyone he meets in public despite their status in the community and leave them feeling loved and cared for.
Long Island audit is my favorite audit channel. Hands down always respectful well educated, he seems to genuinely want to teach.
The detective needs to go back to school and so does the city admin to understand the definition of public servant.

You misspelled "fired". The academy teaches cops that everyone is a liar and out to get them. Their whole training needs to be reevaluated and revamped.
How the officers slowly move him out of the room down the stairs, then outside is a perfect example of how police take control of you and how they detain individuals. Also how the officer decided to continue misusing what they managed to convince the civilian in any way they can just to get their way. They keep stepping intil they get what they want. The government always does this. Take all they can and give nothing back.
That was a great de-escalation tactic in my opinion.

12:25 - The cop saying, he did not, is a peek into what cops have always done prior to video cameras. They are so used to lying and have not adjusted to the fact that their lies are now caught on video. it just comes natural to them to lie or deny anything that is not in their favor.

The funny part is, white shirt supervisor wasn't even on the scene when that occurred. He just instantly dismissed it. He could have said "He did? Why did he do that? You don't know? Can you e-mail me that footage?" even that could have deescalated the situation.
This whole thing could have been allayed quite easily. "Hi yes, I see your sign out there barring eavesdropping, but I think that it is worded incorrectly. Could you clarify the sign please?" then pull up the statute, and explain to them that you are not surreptitiously recording private conversations, and normal video audio recording within the building doesn't qualify as eavesdropping. If they still have a problem with it, and are sticking to their guns then you take the evidence you have, and take them to court.
At that point you have shown that their posted notice was improper, they were shown what the statue said and what it prohibited, and still refused to take down or amend the improper notice or even consult with legal council regarding the statute and their own posted notice. At that point they backed themselves into a corner.

Someone once said "If it's take you longer to become a barber than to be a police officer something is wrong". Just think about all the professions that require years of college for one specific field. These cops have to be therapists, soldiers, etc every single day with nothing required to be so. You don't even have to be a security guard or anything lol.

This is the most common theme on all these videos. In all of these if they just said "help yourself and enjoy your day" the auditors would just go away or eventually commit a real crime. Their egos just can never allow this though.

I had a similar encounter with copying public records that began at the Whitley County KY Clerk's Office 10 years ago. They refused to allow me to use my hand scanner to copy marriage licenses for my ancestry research. They threatened to have me arrested for questioning their rule. I filed a complaint with the KY AG which ruled in my favor. That pissed the clerk who convinced the legislature to pass a law forbidding the recording of public documents. However, the law was written into the tax law section which is seperate from the Sunshine Act which covered public records. So I challenged the Pulaski County Clerk with that argument and their county attorney conceded. I realized that it would take far too much time to litigate the issue one county at a time. So I found a loose thread in the new statute language that stated the clerk's could not ban hand written copies. So after Laurel County denied my request for making my own copies I filed a complaint with the U.S. Justice Dep claiming my physical and cognitive issues prevented my from sufficiently making hand written copies. Under the ADA I have an equal right to make copies at no cost as a person who can make hand written copies. Thus, my hand scanner is to me like a wheelchair is to someone who needs assistance in walking. The Justice Department agreed and gave its oppinion in my favor. Now, in KY anyone with writing disabilities can freely make free copies with their own imaging devices.
LIA has a fantastic auditing style. He's always so calm and speaks clearly, precisely. I also love the fact that he challenges this crap on the spot and letting everyone there know when they're violating rights, ALL without raising his voice or swearing at anyone. Really makes the already dubious "Disorderly Conduct" arrests that he's had seem even more absurd.
I agree him and Open Government Investigations are my favorite auditors for these exact reasons.

I agree. There are too many auditors who go out well meaning, but are at times even less educated than the state officials and police they are attempting to shed light on. It’s why I appreciate audit the audit so much.
I know it’s an unpopular opinion, but I actually appreciate the intended establishment of police. I truly think there is a place for community workers of all levels that help resolve violent or stressful situations (which is why I’m such a supporter of non-emergency police as they traditionally have more conflict resolution training than other offices) or being the working arm of the judicial system for those that actively harm others. Examples would be drunk driving or domestic abuse among others. But especially after watching ATA’s videos I’ve come to see the kinds of abuse that are used by officers to incriminate citizens. It’s unconscionable and inexcusable that the office put in place to assist and protect their communities have warped into them thinking they are judge and jury for individual interactions.
I hope more potential auditors watch more audit the audit and activity research their state and county laws before putting themselves in these positions so they can more effectively shine light on corruption and discrepancies in the police’s actions and their actual authority that they should be following by law.

While I agree with your sentiment, making statements that blanket can be dangerous as well. City Hall often does deal with people's private personal information and does need the ability to conduct some business in private. There will always be areas/times where it is justifiable to limit access/recording, but not in public areas.

Officers discussing files. There is a reason for schedulling interviews and documentary filming. That man filming is about as much a journalist as I am a career pole dancer. That guy is by far the very best auditor on RUclips . If you haven’t seen him go watch. He is very active, extremely knowledgeable and very polite and professional . He follows through and always files a complaint and has multiple lawsuits pending .

Sean should get an A++ on all of his audits. While he could use his right to remain silent that is not his goal. His goal is to educate and you can do that just standing there. He has peaceful conversations for the most part and only chooses to invoke the 5th when it is necessary. Imo he is one of the best.
