96 public videos, 4 of them fully eligible for monetisation, 1 partially eligible, and 91 not eligible at all. 91!
Btw those 91 still have adverts on them so they're still earning money, it's just going to some random dude, who probably does'nt even know i exist. Wonderful. How motivating!

1. Is the composition. I can freely pick a Sonata from Mozart and start playing it on the piano, record it and upload it. The song is public domain and it is not under copyright law.
2. The performance of a song. If I upload someone else playing that exact same Sonata from Mozart THEY own the copyright because they were the one performing it.
And I presume that is exactly what happened here.
Just had a thought, musical copyright lasts 70 years after the artist's death. Charles Penrose, the author of the Laughing Policeman, died on November 17, 1952. The original outro can come back after November 17, 2022.

The song itself might be in the public domain, but a company can own the recording. This means even for classical music you have to record it yourself or find a free use copy. If a orchestra performed it on radio or for a movie's film score, the rights to the recording belong to the studios even though they will sound 99.98% identical.

It doesn’t necessarily get you demonetized, it just cuts off a certain amount of dough you would make with each swear

The solution is to have a monthly subscription service that content creators can pay for which allows them to use so many seconds of copyrighted content for a monthly fee, somewhat like Spotify Premium for content creators. This way, the record companies are happy because they get paid each month to license out their content and the creators are happy because they can continue to monotize their videos without fear of copyright strikes.

Strictly speaking though, the use of the song in the outro isn't fair use by U.S. law. If not only because he is using it in monetized creation. While it is totally fucked that he is losing 100% of his income, it is technically not fair use and is *technically* illegal. But still, just a nonsensical way of handling it on RUclips's part... Sounds WAY better to only take X percent of income where X% is the ratio of claimed copyrighted content to original content. But then it because a LOT of work on RUclips's part, so it won't happen that way..
