  • When Tracie and Myles Albert purchased a beautiful four bedroom house in Riverside, California they never realized that at the end of escrow the seller would suddenly refuse to give up the keys and leave.

    For anyone selling their home, put in your contract that seller must vacate BEFORE close of escrow. Be sure to check before money is transferred. This is common place in Florida, while in California the seller usually has 3-5 days to move after COE. Protect yourself and good luck!

      That language is in the Georgia contract. You can agree to possession at closing, 3-5 days after closing or a lease lack with a specific vacate date. The closing is always at an attorneys office not a title company closing and keys are transferred even if the buyers allow the seller to stay a few days after closing. I had a situation similar to this a few years ago. I was the buyers agent. The seller was having to do a short sale which was difficult enough but on the day of closing the seller was supposed to be out by 5pm that day. We got to the house and she still did not have anything removed. There a few people there with trucks but they were not really moving things out. Threats were made against me to the point of someone having to step in and hold the aggressor back from hitting me. At that point, I called the police and told them I called the police. I had the police stay there until everything was moved out and the home inspected for any damage. I was able to show the settlement statement from the closing, introduce the new owner to the police, show the utilities were already in the new owners name and show them the person who threaten me. Needless to say, that lit a fire under them all and they got out of there within the hour.

      In CA and all other states, there's a final inspection that needs to be signed off before money is settled. These buyers must have given him the benefit of the doubt, gave him more time, and got burned big time. Never sign off until the house is vacant.

      Exactly! It's not an "eviction" - he's not a tenant! If he won't leave, he should give the money back.
      Also, I can't believe he never ever ever goes out of the house at all. They could get private investigator to see when he leaves the house, they swoop in and change the locks, if he tries to set foot back on the property he's arrested. Maybe put up a nice solid locked fence, too.

    Turn off the water main, and the gas main. Put locks on them. Pull the power meter. I never in my life would have sold my house and not leave. A 30,000 tax lien on the property means he was going to lose it. They saved his butt, and he planned this all along.

      A 30,000 tax lien on the property means IRS has 10 years to act on the lien (collect the owed money) or the lien expires after 10 years and is removed from the title automatically.

There is a case in SF California a family hired a live in babysitter. They fired her but they are not allowed to evict her bring to court and they loss. Only option to sold their house.

She had a tenant single mother with two kids. She stopped paying rent. She filed for eviction and judge advised only option sold her house and she did. Do you’re own research as well.     Recently, we were house hunting and found a nice home to look at in our preferred neighborhood. The pictures online represented the property as vacant - move-in ready. We went to look at the home, and came to find out that the seller had tenants in it - with a dog. The seller claimed the tenants would be out by the end of the month. Needless to say, we walked. Especially with the rent moratorium, there was no way we were deliberately going to risk ending up with a non-paying tenant.

    I think the realtor and the title place should be investigated. If he didn't deliver the house and keys. The money shouldn't have transferred to him. Plain and simple you guys should start suing all the previous owner, the agent, the title company for cost, rent, and damages. Hire a good real estate attorney.

      @@snoopers360 it is delivered by doing the last walk through of the house to ensure it has everything stipulated in the contact, some people include appliances, blinds etc, empty and ready for the new owner to take possession of the property and the deed. And so that the funds can be delivered to the bank or prior owner. Both realtor and title company failed to do this before transferring deed and funds. Hence, they should be held liable as well.

    One of my homeboys dealt with this in 2018. Previous owner F'd up though since these dudes are cool AF, but gang related, though they are not into messing with anybody that doesn't deserve it. Homeboy moved in, and brought his brothers, cousins and some friends along, total of 13-15 dudes and after a few hours, old owners moved out asap! Lmao! Sh*t was funny.

The Broker was supposed to have the title company do a Title Chain to see if there were any defects on the property as soon as he got the buyers under contract. The Broker didn’t disclose in a timely fashion but I’m sure he put pressure on the buyers to “hurry and pay it so we can close on the property,Mr. such and such has to be going by...” They signed that contract under duress based on the prompting of both the seller and the Broker. Sounds like a cause for voidable(not void)contract

    This is why you do a walk-through before closing to make sure the previous owner is out and immediately have the locks changed when you buy a house. Still, laws allowing this are just insane.

    The last time i bought the house, the owner didn’t move out until 3 days after closing escrow. And I was already pissed. I was about to hire a moving company to come in and dump everything. Good thing they move out on the 4th day.
    No real reason, they just took their time moving out.

      As long as I been dealing with real estate I have only seen this happen once and it was because the old owners new place wasn’t available for a few days ..the new owners were pissed and the law got involved
      So the police told the new owners to walk through the house and take pictures of everything so if anything was damaged they could sue later
      I don’t understand why their aren’t any laws to protect the new homeowners
      I also did a loan for a couple who allowed the old owners to stay in the property for 6 months but they paid for it

      i seen another video on this story and i think his family comes and goes but that guy never leaves the house. i think the true owners should also sue whomever interpreted that new covid/landlord/tenant law incorrectly. it doesnt apply to them. the previous owner needs to vacate the property ASAP!

    If anyone knows Tracie and Myles Albert, please pass this message on to them:
    They *need to act fast* - there is actually a clause in US real estate law called "adverse possession" or squatters rights which means if he succeeds in staying in that house for 7 years he will LEGALLY OWN the house.
    The clock is ticking for them to take action, and 2 years out of the 7 has already passed. If they are not careful they won't even be the legal owners of the house in a few years time. I suggest they read up carefully on "adverse possession" - especially the criteria needed for this to take place.
    *Here's a summary of the criteria needed for a squatter to legally become the owner of the house through "adverse possession"*
    1. Continuous--The squatter must stay in the place continuously
    2. Hostile--The squatter must defend the property against the wishes of the owners o_o This law is seriously messed up
    3. Open and Notorious--The squatter must be squatting openly to the knowledge of everyone
    4. Exclusive--The squatter must be the only party living there, the rightful owner must not also be living there or doing domestic activity there
    ^Please read this carefully. It's clear this is exactly what the squatter is hoping to achieve - he even stopped Tracie from watering the lawn because that may potentially violate criteria #4.
    I suggest they MOVE INTO THE HOUSE IMMEDIATELY. Hire a locksmith and a bodyguard and move into the home immediately. This would prevent the squatter from owning the property as it would break clause #4. If the squatter starts getting violent, call the police and report it as assault.

    "Break" into your home, make sure you are legally armed and have at least 1-2 others with you (armed as well) and get that p.o.s. outta YOUR HOME!! If they call the cops show them your paperwork showing you're the rightful owner and file breaking & entering charges on the p.o.s. Soon as they drive away towards the jail...haul ass to remove any of their possessions from YOUR HOME!
    Either that or file charges because they robbed over $500,000.00 from you and your family.
    People like this need to be held accountable for their grimey, thieving, p.o.s. actions/behaviors. How dare they think what they have done is "ok"

    Always always always put in the purchase contract that seller moved BEFORE escrow closes, no move, no escrow closing. Cant trust anybody nowadays. After this happens, all bets are off and cant blame the buyer if he uses extreme measures to get this sob out.

      Why would the seller move before the deal closes? Why would anyone would go for that.
      Although me personally I preferred vacant houses for just these reasons.
      Have a locksmith standing by to change the locks The day it records?

      My husband and I couldn't move out the day escrow signed because we needed to close on our current house, use those proceeds as a down payment on our next house which took a few weeks. We signed a contract saying we would be out in 30 days. The owners did this couple dirty.

    They need to take them to court this has nothing to do with rent or mortgage forbearance. There need to be more regulations on this kind of transactions. Everyone got paid ...but the buyer is screwed its not right. They should have their names and puctures on social media see how they like that

      This unfortunately falls under evictions as when a borrower stops paying and gets foreclosed, a bank also has to file an eviction to get the person out if thry don't leave voulantarily.

      @@tourmii Whenever you have someone in possession of a property that they once had a legal right to possess but no longer do you have to file an eviction to get them out. That's why this is an eviction case.
      Eviction is not just a landlord tenant thing. It occurs after someone has taken unlawful possession, and they won't leave voluntarily. For example, if you left on a 3 month vacation to return and find that squatters have taken up in your home and actually assumed possession, by fulling moving in and establishing residency. If you tried to throw them out, it would be you going to jail, not them. You would have to go to court and file to evict them.

      @@IdealUser It should have been addressed years ago but anytime a new law is proposed it goes through an incredible amount of bureaucratic review, proposals, changes, amendments, etc. and then must be voted into law by state lawmakers, which means it is scheduled behind many other voting issues and business already scheduled beforehand. In present times progress of any kind has been additionally slowed by Covid-19.

Of course the police will laugh at the home buyer and say it's a civil matter so they can't get involved and everyone should call a lawyer.. Once in, call a dozen of your best motorcycle friends from the local bar to socialize with everyone.

    Dolly Parton had a line in the movie "9 to 5" that I think applies here: "I think we should hire a couple of wranglers to go upstairs and beat the s**t out of him." The owner is within his rights to have the doors removed (he cannot be arrested for that.) Then, the "wranglers" carrying chains, crowbars, and some metal bats move in and "persuade" the scammer to leave. They don't have to physically harm the guy. But they can absolute remove the door to every room in the house with the owner's permission. Once he is out, you take all the guy's stuff out of the house and leave it for garbage collection. Hell, I bet the "wranglers" would do this just for a few rounds of beers. If the occupant attempts to call the cops, he'll have no leverage with them because he isn't the owner.

    naturally the sheriffs can't go in and remove him for trespass despite this not being a rental situation. so put security guards up, tell anyone bringing deliveries to get off the property because they're trespassing OR take delivery at the sidewalk AND/OR begin constantly knocking on your door/playing a single song on loop. Starve them out and drive them up the wall w/the music

      @@calidreams5379 The original owner legally has tenancy rights per California law. If you've consistently occupied a property for more than 30 days you have legal tenancy rights and the only way to be legally removed is an eviction which, due to Covid, cannot be done. The sherriff's are powerless in this situation and the owners have to be careful not the break the law themselves. Believe it or not, the OG owner technically has the legal right to do the shitty thing he's doing.

    So i had that problem once and for $2000.00 Vito and Guido Recovery Service. had them removed in 30 min. They even left a lot of their nice furniture and things they couldn't collect in 30 min. Remember people ,possession is 90% of the law.

      @@jaketapper8910 they aren’t even legally considered squatters. Did you listen to the facts of the story at all? Legally they’re trespassers. They sold the home. They aren’t tenants, they aren’t squatters who have a legally colorable claim to be there (which is what defines a squatter-someone asserting a colorable claim to possess the property, whether via adverse possession-which never works due to the duration required generally 7-10 years of open, notorious, continuous occupation- or usually claiming they have a fake lease. These people are trespassing on property they ceased to own when the sale closed. But because the city is in a bigger mess than usual, they can’t get anyone to move on the bill of detainer to physically remove them yet. So no, an eviction isn’t required because they’re not tenants or squatters, not even under CA’s ridiculous laws. I’m well versed in landlord tenant and property law in Las Vegas and we do a lot of cross jurisdictional legal practice so I’m quite certain of this.

      We purchased a house like that 20 years ago and we were ready to goto the notary for signature but the tenant renting the place wouldn't let the utility people hook our phone line and then started negotiating to have 20,000$ cash...so we were lucky enough to have had that alarm before signing. We had to put everything in storage and had a house built in 8 weeks. Some people just look for opportunities to steal from others

      You can sue the owner's realtor, because you would need the permission to do a final walk through with your realtor before the actual closing. And the person that contacts from the buyers side is their realtor and is through and to the sellers realtor. You have to know when the current occupants will leave since the house IS NOT VACANT, a date must be stated and if not during that time period... the rent amounts or penalties should have been placed for the condition of the sell. And this walk through is usually done a day or two before exchanging the keys through the realtors before the close of escrow. He failed to perform his full duties for that most important part of the transaction.
      Also the escrow company needed to confirm that the CURRENT occupants had actually moved out and keys exchanged before the check was issued.
      Both of them failed and even if the buyer's realtor was totally new at this and might have been his first closing.
      Remember that the escrow company actually has a down payment from the buyers, which the check had already cleared from their bank and seating in the escrow's account along with the mortgage company's loan money. But the only thing a buyer has is the seller's word.
      And as the new owners, they should have called the department of water and power (DWP) to request change of ownership at the close of escrow. Water and power can shut off the power and water if the new owners requested it then. DWP isn't aware of the old occupants still living there once the request was done with a Proof of legal ownership change which was with their escrow documents. It's a sad terrible situation for the buyers.

    I bought my home and had a rentback contract. the sellers tried to stay after the 30 days we gave them. I acted quickly. the sellers started to tell their realtor that they needed more time, they got 575,000 at close so we knew this was a scam. the sellers were approached to remind them of contract, they started acting like they had no idea what we were talking about. they said - O the people we are buying from have not bought a house so they need more time-- Bullshit!!!!!!!!!!!!!!!!!!!!! they even tried to offer money - they would have been a rental contract and they would have been able to stay .. renters rights and moratorium . So i contacted my lawyer, We went after them for breech of contact...since they were still there on the 1st the judge gave us 5800.00 and damages + lawyers fees .. we had rented out our condo and were loosing money... he said this was an attempt to stay due to the fact that the received soo much from sale. judge said - in what way are u being disenfranchised u have 575,000 cash. then he added on an additional 2200.00 he was made he said they were running a scam.

    I am a Broker in California. The agent made a key mistake. You don't close escrow until you confirm the home is vacated. Period. You do a VP "Verification of Property", Why would the buyer move ahead when clearly the seller hasn't left. The only good news here is 1. You might have an E&O claim against the realtor for failure to protect the buyer with fiduciary responsibility, and 2. You will be able to sue the seller for per diem at market rent per day + damages based on the condition you purchased it in. Since you gave them 500k+ Odds are you could collect a portion of that!

    This is currently happening to my neighbors son. My neighbors son is living with him along with his wife and two kids. It’s been over 9 months now and still going through the eviction process. This is why California is such a joke to live here anymore. The people that don’t pay taxes and don’t work have more rights then the normal working citizen does. Two years and I’m outta here ✌️

    If it is the Buyer's home and lost $500K deposited into the previous owner's account, time to make the current illegal tenants inaccessible to their (Buyer's) home. Start by being creative. Slabs of concrete blocking doors, broken machinery in front of the garage doors, and so on. Removing the AC Unit would be my first step. They need to make sure Squatter Rights do not come into play as well.

      California would do that. They seem to have crazy real estate laws there. Always do the final walk through the night before closing or the morning of closing. If the sellers are not fully out of the house, delay closing. You can sign all the papers but don’t transfer the money until you have possession.

    Sounds like a it was all planned out as intentional FRAUD to me! He cannot get away with this. Wow these days does not surprise me considering all of the squatting going on. Not that many are vacationing but for those that are be aware a squatter might move in once they notice that the house has no occupants at the moment.

      it's worse than that! If the squatter stays there for 7 years he will become the legal owner of the house thanks to a law called "adverse possession" or squatters rights

      @@crystalDM96 Yes and same is true even for property lines as well. If not noticed by the city/County that the property resides for 7 years then the person can claim it to be theirs legally. I think that if there has been litigation or effort to get a squatter out within those 7 years then those adverse posession rights do not apply.

      ​@@bamby5211 It is really shocking and I hope the couple does something about this. They've already let the guy stay there for 2 years out of the 7. Imo they should get a locksmith and a bodyguard (plus a whole hoard of people) and enter the house at night. Get the locksmith to change all the locks in the house and then move in. If the squatter gets violent, call the police for assault. The sooner they do this the better - if they don't do this within the next 4 years they won't even own the house lmao

    Id sue him for 10 times the money for that house, fraud, tresspassing, damaging of goods(the lawn and posdibly the house), if not for money then atleast 20 years in jail

    The realtor who assisted in the home sale looks shady as hell, I wouldn't be surprised if he was working with the home owner. When you buy a home, at least here in Cali, the escrow company conducts a title search which should've uncovered the $300k tax lien. During the final walk through, prior to closing, they should've seen that the home buyer wasn't packed/dragging their feet, and could've gotten an extension (which would've delayed the closing and transferring of money to the owner.

      I too suspect there is more to the sensational story. He could be a desperate but financially inapt homeowner that was duped by the real estate agent to sell the house to pay off the tax lien. I would like to know the fair market value of the property as that will tell us a lot of what likely transpired. Predatory real estate purchases are very common and often the victims are minority, elderly, and mentally handicapped.

    Some people are too nice. If i was the buyer amd owned it 100 % and someone was refusing to leave.. id give them 24 hours to leave on there own or me and 5 of my friends are gonna throw you out and then if you decide to come back on to my property youre gonna get shot

    The couple who bought it was clearly inexperienced and naive. They should have been able to hold the land title even before they made full payment. And should have never settled until they had physical possession of the property and changed the locks. You do not purchase a house like youre buying a burger, with cash. Should you NEED to pay in cash, you better have three lawyers beside you when you sign.

      In the eyes of the court that would be assault among a lot of other charges. You and your friends would be sitting in the jail house and the courts would side with them. It’s crazy but there’s a reason those ppl aren’t in their house. It’s not a case of them being afraid. It’s a case of the cops and the courts telling them to leave him alone or go to jail.

      It wasn’t during the pandemic. The sale was final Jan 31, 2020 the realtor said. The pandemic didn’t start hitting the fan in the us until March 2020.

    Absolutely horrible! California has been descending into a lawless state where criminals are excused and protected, and hardworking, tax paying people are scorned. The laws protect two entities; the top one percent elites (Gavin Newsom, DiFi, etc) and of course, the average criminals. Homeowners, working families, tax payers are all referred to as the “privileged class” now. And they have no friends at the Capitol in Sacramento. The laws don’t protect them, they just have to hope the odds won’t catch up with them and lose everything they worked their entire lives for when these criminals decide to take it.
    And people wonder why so many tax payers are leaving this state!

    Yeah. There's way more to this story. When you did final walkthrough before signing the closing, no one noticed that all his stuff was still there? That's why there's a final walkthrough to make sure the person is out of the house AND that they didn't trash the place. And keys should have been turned over at signing before money was transferred. Forget the eviction process- something broke down in the homebuying process imo.

    I'm terrified that I'm about to have a follow up to this story. I'm also in Riverside. My wife and I just closed on a house. All parties have been paid. Seller is refusing to leave, claiming they can't find a moving company to help them. They made $130k profit on the deal. I'm guessing for even a small portion of that, you could find plenty of trucks.
    For now though, we're screwed. We have to vacate our place in the next 48 hrs and have no where to go.
