- Alright so This video is going to be a little bit of a different. I normally don’t talk about any problems going on on RUclips and if there is drama I try to stay completely away from it. But this is different, This is a situation that I feel like I need to address because, one it’s crazy and two it could potentially affect even this channel. Dragonball super was crap and he criticized it , this is why they are trying to make his job harder .
If you ask me RUclips really needs to step up and do something about this because with this, it defeats the purpose of even having an online platform when making videos I'm having a community some communication would help

Damn, 3 hours to reclaim a vid. So, basically, it will take over 18 days to obtain the vids? Damn, “big winner” to Susan of RUclips who nominated herself the “freedom of speech” award. 🤦♂️ No wonder we hate her guts and Google’s, but anyway, NGL, other than just Toei, I hope Japanese companies just chill out and understand that IP appraisal is not “theft”.

I really like Mark's videos but, tbh, I'm not as convinced as most people are that _all_ his videos, without _any_ doubt, fall under fair use. Will be interesting to see how this unfolds, but I think there's a chance some videos will not return. Some of his videos (GT Black Star Dragon Ball review, DB Tien Saga review, DB Super Broly review) have been gone since August and still haven't returned. From what I understood, if the copyright claims are not legit, the videos will return after two months and some few days. The fact that four months later they still haven't returned makes me think Mark may have lost his appeal and that they were thus legitimate takedowns. This would mean that Mark did in fact commit copyright infringement or was at least unable to show he did not.
Some people say that when a video is transformative or a review then you're good to go. I just looked up Google's page on fair use and it doesn't say it _exactly_ like that though. It says that being transformative and being a review increases the chances of your video being legit, but doesn't guarantee it. It also says that if you monetize your video your chances decrease. And you're less likely to get a legit copyright claim if you use non-fictitious work, rather than fictitious work (which Mark uses).
I also noticed it says you can get a copyright claim for using just few seconds of copyrighted material. I guess in practice this is basically a big caveat to the "transformative" rule. The fair use page gives an example of a little portion of a song being used in a video that can lead to a copyright claim. Mark did just that with his GT review, sharing a portion of the opening song (music + video) for no reason other than to say he likes it (which I doubt counts as a "review" on the song). The GT video still isn't back after four months. Perhaps he did commit copyright infringement here?
Anyway... just my thoughts. I do hope he gets them back, but with so many videos taken down I think there's a chance not all will come back.
Great point man. In general, the whole fair use thing is kinda in a grey area. It not super clear and of course is up to the original owner. Let’s just hope he gets more videos back.

@@DragonBallCode well photos are still technically their property. So they weren't exactly wrong there either. I also saw another video where he drew things also licensed by Toei and those videos got taken down too. I'm not defending them in anyway whatsoever but come on! These content "creators" are using their property. What did they expect?
