Would you call this STEALING? Lots of people are saying its stealing BUT he was paying for the merchandise... he just wasnt getting the items in a fair way. It was going to sell to SOMEONE but he just guaranteed it would be him. 😤

“Theft by deception occurs when someone intentionally obtains property, services, or money through lies or misleading statements. This often involves misrepresenting facts or failing to correct a false belief, all with the intent to wrongfully gain something of value. The key is the use of dishonesty to induce the victim to part with their property. Laws on this vary by jurisdict

State laws vary. In Missouri “shoplifting” includes “willful concealment”. Whether on their person or otherwise; concealing an item is thought to be done with the sole purpose of depriving one of their property. Therefore, “box stuffing” in a bin store is actually covered by Missouri’s shoplifting law. What he did is definitely “willful concealment” especially if you had a process of selling certain items in bins and others online (etc). Regardless. Very clearly theft just depends on the local laws on how prosecutable it was.

    • @LindeyGlenn

unfortunately Kansas is different from Missouri. Concealment is not viewed the same as shoplifting unless they leave without paying. Apparently they can conceal all they want inside the store. I can refuse service or ask anyone I want to leave of course but I can't slap them with anything except trespassing. I was constantly involved with the local police department over several instances of the box stuffers... I was always told it isn't shoplifting unless they walk out without paying and even if they do I can only persecute for the prices I charge not retail value. Once I caught someone leaving with a basket of merchandise but since it was dollar day it would have only been able to persecute for $17. I asked about this situation and I was told according to the law (where I am) that if he paid for everything before he left the store that no crime was committed. It was very frustrating. I had a lot of shoplifters and I could never really do anything about it other than make sure they never same back or filed trespassing
