I had volunteers in my thrift store do the same things. It's stealing because you didn't get a chance to properly price the items. It's one thing that yes they bought them but, they didn't buy them at the price you would have set it at. That profit margin he stole.

Therefore, “box stuffing” in a bin store is actually covered by Missouri’s shoplifting law. What he did is definitely “willful concealment” especially if you had a process of selling certain items in bins and others online (etc). Regardless. Very clearly theft just depends on the local laws on how prosecutable it was.
unfortunately Kansas is different from Missouri. Concealment is not viewed the same as shoplifting unless they leave without paying. Apparently they can conceal all they want inside the store. I can refuse service or ask anyone I want to leave of course but I can't slap them with anything except trespassing. I was constantly involved with the local police department over several instances of the box stuffers... I was always told it isn't shoplifting unless they walk out without paying and even if they do I can only persecute for the prices I charge not retail value. Once I caught someone leaving with a basket of merchandise but since it was dollar day it would have only been able to persecute for $17. I asked about this situation and I was told according to the law (where I am) that if he paid for everything before he left the store that no crime was committed. It was very frustrating. I had a lot of shoplifters and I could never really do anything about it other than make sure they never same back or filed trespassing
