I need some detection towards information. I am working on a fact pattern assignment that might involve contributory/comparative negligence and non economic damages cap. I live in Hawaii and unfortunately on westlaw many opinions are out of plan. I am aware of the Contributory Negligence Act of 1945 but is there any other history that might guide me? In the fact pattern the estate is asking for 10 million dollars.

Hi Priyanka. Negligence is only fulfilled when the requisite criteria are met. For instance, once it is established that a duty of care is owed to the victim, the Court must determine on a balance of probabilities if the defendant has breached the said duty which ultimately (subject to anything intervening) caused the harm. Can a contract between a shipowner and the shipper of goods on his/her ship be worded to say that the shipowner if not responsible, or does not have a duty of care for the goods while they are onboard his ship and thus cannot be negligent
Hi. Yes and no. The shipowners ability to indemnify himself from liability for negligence will depend on a number of factors including the nature of the contract, what’s considered legitimate in the industry, the ‘imbalance’ between the parties etc. So, the ‘ability’ to word it versus it’s effectiveness to be relied on are at times, mutually exclusive.

Health Club. For health and safety, the pool, when Aqua Aerobics is taking place,will only permit 29 people.Once the figure of 29 is reached, the remaining members, are placed upon a waiting list. Upon arrival, those booked, are given wrist bands and their names, from a register, noted. . Their duty of care is therefore fulfilled.
Along come four members, who have not booked, have no wrist bands, yet still enter the pool which is now overcrowded. The instructor becomes aware of this, yet permits the class to proceed.
Needless to say, a member, whilst the class was in full force, inadvertently, kicked another member to her face. and, in doing so loosened her front tooth implant.
Who is culpable? The Club or the Instructor please?
Hi Myfanwy. That's an interesting question. There are a number of aspects to unpack in it. Firstly, it is important to establish the status of the 'members' that entered without authorization. They may fall within the category of trespassers, in which case, their claim may have to satisfy a stricter set of guidelines (lookup Occupier's Liability). Secondly, whether it is only the instructor or vicariously the Club which is liable would depend on the instructor's actions. For instance, in Rose v Plenty, it was suggested that if the employee (even with prohibition from the employer) acts in a manner which benefits the employer, the latter must be held accountable. So, whether allowing 4 members to remain sans-protocol amounts to the exception in Rose v Plenty, must be considered. If you'd to 'dive' deeper, drop me an email: shaveen@outlook.com

Just to clarify in classes, are rescuers proffesionals such as counsellors and psychiatrists?
Hi Mellyssa. It depends on the type of rescuer. For instance, if it's a firefighter, then yes. However, much like in Chadwick vs. British Railways, if it was a bystander who 'volunteered' to help, then technically no. Having said that, the Law tends to look favorably at granting relief for such parties in considering the selfless nature of the act as well as to foster the same habit among others.

What about occupiers? Do they owe a duty to entrants?
Jazz Shephan under the Occupiers liability act 1957, occupiers owe a duty to keep their visitors (people with permission to be there) safe. Under Occupiers liability act 1984 it covers the need to alert trespassers of the danger and keep them safe although it's held to a lesser standard than the 1957 act. :)
