    Even if a duty of care fails on FJR do we still continue to apply negligence?, how do we go about illustrating to the examiner effectively that it will fail but that we are continuing with breach and damages anyway

      Good question! Yes, even if you think it fails on F,J,R, you should apply the other elements to show you know the law. I would say something like: F,J,R is a question of fact in every case, so it is important to consider the likely success of the remaining elements of the tort, in the event that the judge finds that it was F,J,R.

      @@thelawteacher5724 thank you for the reply! I’m resitting law as I was one mark off an A last year and it was the negligence question on my paper 2 that let me down. Also my paper 3 Human rights too do you do any work on it?, would be a great help!
