      I went to court the judge told me there is no ignorance of the law I was arrested once and I asked the police officer if he actually knew the law he was arresting me for he said no I don't have to know the law it's not my job to know the lost my job to arrest people and it's the court systems job to figure out whether I broke the law or not pretty convenient

      The real fact is allow these police officers really don't know about constitutional law, constitutional law keeps them from arresting people for the petty s***. The problem is taxpayers pay for these violations instead of police officers. There is billions of dollars paid out every year all over the world, most of them from police who don't know constitutional law

      You forgot their go to assertions of smelling something, hearing slurred speech, seeing bloodshot eyes, and the "stop resisting"- that one I've seen them do before there was even a chance to happen, like they knew they were going to use excessive force and have learned to just say this every time to use as a blanket cya.

      That’s an oversimplification man. It’s not just cause the shirt. It’s the fact that it’s a small town where everyone knows everyone. He’s done audits before. Cops know him by first name. Lots of variables

      @@dionreeves5716 you can’t read. I wasn’t defending anyone, I was simply pointing out to the OP that the cops weren’t called SOLELY for the reason they specified. That’s what we call hearsay and that’s also what we call bias and how rumors start, I was simply trying to open someone’s eyes to the contexts of the circumstance. I said absolutely nothing about violating rights or was right or wrong. Don’t put words in my mouth and don’t assume you know me based on a 100 word RUclips comment.

      While I agree with this in theory, it doesn't work in reality. I'm sure there could be some more substantial and definitive laws put on the books regarding qualified immunity and when and how it is allowed or denied. If it is more clear then both the citizens and the police would know EXACTLY what ramifications their actions will have on their private pocketbooks.
      The reason we can't totally get rid of qualified immunity is that no one would want to become a LEO. Whether we like them or not, they are a vital and necessary cog in the wheel of not only justice but society as well. It puts the good cops at too much of a disadvantage as they could and probably would be sued for nearly any interaction with the public whether justified or not.
      You would have people literally trying to poke and prod the police into any sort of confrontation that would allow them to be able to sue them and more easily win money from them for literally no violations or minor violations on their part. Insurance companies and/or the officers themselves would end up settling outside of court for the fear of losing in court for issues that should never have been allowed to be in a court.

      @@j.t.taylorjr.7264 Absolutely. While there are really too many laws on the books for LEOs to know them all, they should be able to know and understand what they can and cannot do in regard to the Rights and Freedoms of the citizens.
      If LEOs do something that goes against and violates our civil rights, then they have to be ready to pay the price, and part of that price should be the removal of qualified immunity. Same thing if they do something to any citizen that would be deemed "illegal" and the average citizen could be charged with a crime or sued.

      The only time they should get qualified immunity is when they saved someone's life, and accidentally hurt or injured somebody in the process.
      There might have been a time where cops were so virtuous and attempted to preserve peace and Liberty that they deserved qualified immunity, but the cops today don't deserve the time of day

      Here in Australia they don't really have it. If they make an unlawful arrest or use excessive force then they are liable just like an ordinary citizen. Unfortunately the judges just give them a slap with a wet bus ticket so the reality is that it is more about limiting their career prospects than full justice.

      @@jonahbrown4674 I'm not sure about every state but in my state in Australia there is a separate commision to handle all but the most trivial complaints about police. They are underfunded, but at least with serious cases, there is a separate government body to fight police corruption.

    This is my home county. The same cop from the video ended up shooting our towns photographer while he took pictures of a traffic stop because his “camera looked like a gun”
    The cop ended up testing positive for steroids and it also came to light that he wasn’t even certified to be carrying a gun. To this day nothing has been done about it. It’s crazy stuff man, you guys should do a story on it.

      Andy Grimm was the photographer shot, It was in New Carlisle Ohio which is Clark County Ohio. I forgot the cops name, but turns out he later popped for steroids and wasn’t even certified to carry a gun!

    The lower courts that delayed this case are corrupt. I'm proud of this guy for sticking with it after hitting years of road blocks. It's really exposing the corruption of our failing justic... I mean court system.

Judges who's campaigns are financed by police unions, are going to side with police in court. Stop electing crooked judges. That's how you fix it.

      Judges & prosecutors are just as bad as the cops. A judge convicted me of DUI even though I passed the breath test with ALL ZEROS. No blood test. No evidence at all. Same judge was related to my parents neighbors & was always making up BS about me. He once accused me of something that isn't even illegal!!!! But told my mom when I was a teenager that he was gonna put me in jail for 6 months anyway. But He didn't. Another time he gave me the max fine for underage drinking, plus 3 days in jail. They put all the local court cases in our local newspaper, & I've never seen anyone get the max fine for underage drinking, & NEVER EVER seen anyone go to jail for it. Only me. People usually just get a $50 fine & nothing else. My fine was like $200 I think, plus the 3 days in jail. Crazy. He was a total scumbag. He's burning in hell now if such a place exists.

      I'm a retired attorney so I don't know these recent cases, but when I was in law school there was a famous case from the 1970s in which someone wore a jacket that had "F^^^ the Draft" written on it when he entered the courthouse. He was arrested and charged with public indecency. SCOTUS ruled that although the public and police may not like what is said or written, regardless the 1st Amendment absolutely protects this speech, especially if you disagree with it. This police department is incredible and even worse is that the government attorney pursued the case and that the lower courts threw out this case. If you want another case on limits on free speech, look up case of the owner of Hustler versus Jerry Fallwell.

    The fact that the department still defends their actions is troubling to me and indicates as an entire department, they are unqualified to do their jobs. This seems to be a case for the Justice Dept. to step in and take over the department, since the department has chosen to admit that they are either unaware of the constitution or unwilling to support it. They have admitted guilt to the public.

    The 6th Circuit opinion is Wood V Eubanks. A quick search shows that Mr. Wood recovered about 30k in attorneys' fees and got a settlement of $155k total. Article was written Feb 24 2023, but I don't know the name of the main case which was settled, or when it was settled.

    The cops should be criminally charged and easily sentenced to many, many years in prison for things like assault, battery, kidnapping/abduction, unlawful restraint/false imprisonment, theft/mugging/larceny/etc.
    The judges who tried to help the cops get away with their crimes should be facing criminal charges too for both civil rights violations and aiding and abetting.

I reminded him that there are over 1 million full time police LEO in the U.S. and since the educational requirements is at minimum only a GED, were they all going to try to get that one job out there that only requires a GED? They will not quit. They could never find a job with the same high Benefits Pkgs. and pay with their lower Educational backgrounds.

    3 courts heard all arguments and only 1 took into consideration all facts and circumstances revolving around this incident. Fair and equal, or justly corrupt? You take what you will from having 2 different courts attempt to summarize punishment enforced on those who willingly conduct themselves as tyrants, only to have 1 man never back down and prove just how deep their tarnished code runs.

    They had a perfect opportunity to talk to him and try to understand why he feels this way towards police and have a civil discussion but instead they did everything to further solidify why he hates the police. The lack of self awareness in some officers is shocking.

      I think he proved a valid point by wearing the shirt. They responded exactly the way most ppl think they would. It's 2022 and ALL qualified immunity needs revoked. Their lack of knowledge of the law is what scares me.. They didn't even know if they swore to uphold the CONSTITUTION!! More training and require college degrees, higher wages, less problems for society. It should be a profession to be proud of, but all the high school drop outs that are power hungry creates the problems. You can't be a social worker without education, you have to do 180 hours of training to do nails, but throw anyone out there to serve and protect? Wtf?

    "Freedom of speech" isn't just "You're free to say what we want you to say." As long as he isn't directly inciting a riot, those police officers were NOT upholding the Constitution of the United States. In fact, they were doing the exact opposite. Freedom of speech means that people will often say things that you don't want to hear. THAT'S THE WHOLE POINT!!!
