I was the first to purchase a flat in 2015.Bandar West.. the builder registered and formed the society on 21st june 2018.he has till date not given my Membership and share certificates. Even after an order from the Registrar on the 22nd Feb.2020 to issue. Has NOT till date. What should I do next.please advise. Thank you
Many buy stilt and open parkings and claim as their own private space. But at the same time the maintenance of these spaces are borne from the societies common funds. This seems to be not fair .
Sir we have 5 members in our society. Two car parking is available in two sides of the building with two gates on both side. One gate is locked by a flat owner and using for personal use and he is parking an suv vehicle and 2 two wheelers also he has placed some cupboards on that side for not using for even a two wheeler parking for others. Other four flat owners are feeling difficulties. They are parking around 8 two wheelers and passage for entrance using the other gate. We bought this flat on 2013. Two parking owners saying that they both own car parking and they will not alow to park a two wheeler on their parking. We dont have much space for parking in a single gate and unable to take the vechile outside. When we ask them one person is speaking bad words aganist us and other saying that they gave extra money to the builder and not allowing to park even a two wheeler and covered parking is mentioned in their sale deed. Kindly assit in this matter

Respected sir i have one query regarding open space parking,i have my own stack height parking, but my car is big and it doesnt fit on it .even this situation i parked my car on it with my own risk. One day i parked my car on society's open space and generally those dont have their own car parking, they parked their vehicle there.That one day when i parked my car on open space society took objection and told me to park on my own space,But my question is ,The open space is not anyones private space,if people who dont have their car parking and they can park their vehicle on open space then why it is restricted for other? In committee,most of the people they dont have car parking and they are making all rules in their own favour.Please guide me,whati can do

Our society was formed in 2007. In the first AGM called by builder, the members passed the by-laws which clearly says that members can have parking if purchased from builder. Only unsold parking can be alloted by the society by drawing lots. Can the residents who don't have parking move the court in 2021 and challenge the by-laws of 2007?

Sir i own a shop and our society is going for redevelopment. Builder has agreed parking space for residential flats. Is there any provision in DCPR that shop owners can also get parking space.
Our tower in thane has 155 flats out of which builder has given only 23 parkings for 2bhk flats (600sq ft). Rest all flats are studio of (289 sq ft). In this case is building has done wrong for all 132 studio flats by not giving even Open parking space ?

I am having the same problem in my Housing Society builder has allowed parking spaces by asking only some selfish members in Society. They got spacious parking and remained members got very small space. Society never alloted any parking space they just following the parking allotments which are allotted by builder and their men's. They don't want to redistribute the parking space which is common for all. They are saying this is permanently allotted parking by builder and we don't want to change this allotment. This is injustice to all members in the society.
What to do now?
Sir, I am flat owner, I do not have car, can I give car parking place to keep her car , as they are staying in a house without car parking place, please reply me, as other flat owners creating problems.
Sir, I have purchased a flat in 2017 , in Hyderabad. I have last person purchased all flats were sold out, so remained car parking given me, my parking area is small than other parking areas, So my adjacent parking area person parking car in my parking place (little encroach ) I unable to parking my car , so what should I do , we not yet formed society.

Respected sir, i purchased a flat in 2005 in our apartment total 20 double bedroom and 10 single bedroom builder allotted parking only to double bedroom flat owners, not provided parking space to single bedroom flat owners, now all single bedroom flat owners facing car parking issue. Supreme court given judgement in 2010 but we purchased in 2005. this judgement useful to us also what is the solution.

Its a shame on law, still its confused judgements are given.. Judiciary doesn't now whats the ground reality ? If law is too be followed it will arson and chaos.

Sir, specially in Mumbai and subarbuns. Municipality doesn't allow to park the vehicles on road. Therefore new construction parking must be made compulsory .Now a days all most all members own the vehicle.
Sir I purchase stilt parking from builder & parking are sharing with other person. Now problem is other person cover more are parking and they claim that this parking are belongs to him now what to do sir I don't know about any law
My problem is different and neglected . Ours is a CIDCO developed society of 96 flats since 1995 . Common space is used for car parking without any logic or rules . Cars come and go even in midnight . Especially ground floor flats are victims to noise ,smoke pollution. Cars are parked just beneath the bedroom windows, kitchen . Simple suggestion to park Cars with frontside towards building so that smoke gets away and not inside bedroom is overlooked. Even society agm the motion to this effect is passed . What is the solution ?

Under which clause RTO is asking for NOC from Society for parking. RTO is asking for such NOC and Society is unwilling to give it saying there is no such rule.
Builder occupied 1/4th of parking space. He constructed rooms initially in the year 1993 saying that for association office purpose. But always kept under lock. Since 30 years no association is formed. Builder lives on Top floor. He is only maintaining building. He never submits any accounts. Builder’s family troubles owners who question. How to proceed?

Whether society can allott open area of the common area in the stilt can allott as two wheeler parking by putting tin shed with the society's funds. Even after there is a objection by some members. By saying mejority members have taken decision in the general body. we have four sides open erea about 10 sft each side. That few society members wants take that place as two wheelers parking.

Sir, I stay in a newly constructed apartment society in nashik. Society consists of 172 flats with 88 covered parking and 84 hydraulic parking. Those who are alloted covered parking say since there is no expense on covered parking they shall not contribute towards maintainance of hydraulic parking which is roughly ₹5lakhs per annum.. Whereas those who are alloted hydraulic parking insist that every member should bear the expenses. What is the legal status ?

If all members have been provided parking space in the society, All of them are bound to pay irrespective of whether in mechanical or covered or not.
Everything is going smooth on builder allocated or sold parking. Law maker judgement giver dosent know this.? Interpreting on on own whims and fancies.

Why don't u mention this clearly that only owners having cars are allowed and eligible to have a car parking And not all members, since ppl here think that all are eligible, also the builder has said 50-50 in the agreement, what happens here. Are bikes permitted to be parked in stilt parking.
Dear Mam,
Every Member of the Society has equal rights to park their Two Wheeler or Four Wheeler in the Stilt or Open Parking area. The members having their own vehicle are eligible for getting parking spaces( 1 Four Wheeler and 1 Two Wheeler only). No one can claim ownership in the parking spaces. Builders have no any right to allot or sell any parking in the Society.
I recently purchased a flat in cooperative housing society in delhi, for the last one month i am trying to get permission to renovate my flat, but they are not giving me the permission stating that they dont want labour to come into the society in this CORONA time, they are saying that they are not allowing any new work to start, they have allowed only those work to resume which were started before lockdown.
Do i really need their permission to renovate my own house ? Govt has also eased out the lockdown.
Conversation is going through orally, i gave them wriiten letter but they did not gave me any acknowledgement.
Committee members are retired old age people, when i share my problems with them, they dont like it, they think that i am arguing with them. As new member to the apartment i dont want to get into an arguement, they told me to wait till jily 31, i bought it on june 15.
What are my options if they dont allow me even after 31st july. ???
