I see that this video has left my normal circles and not my usual audience so hello y’all! To clarify some information about the legal issues in terms of the idle animation. I said in the video that Oumi’s original response has been deleted, likely meaning that she would not pursue legal action especially since 1) The idle animation is not as similar to her original viral video from 2020, 2) The original video was edited to fit the leaked idle animation, 3) legal copyright law is extremely complicated in the US to begin with and I bring up the dismissed Fortnite dance cases as examples about this. The point of highlighting what had happened is to bring awareness that the animations were in fact inspired by an incredibly talented artist and to trace down where the inspiration came from. There’s a reason why I put sources in the description. The reason I cite compensation from Hoyoverse is mainly because generally, you should give credit where credit is due. Oumi definitely put jam skating back into the public eye after 2020 and she should certainly be given way more credit especially if her videos were used as a type of art practice. The Hoyo team does a fairly good job when it comes to boosting other creators for their work when they either create something about their games or are inspired by them, especially in their HoyoFairs and fan features, so why shouldn’t she get the same treatment? There’s literally no reason to dogpile her especially when all she was saying in her video was that she would take things to court IF it was actually copied. Neither Oumi nor Hoyoverse did anything wrong in this case. If anything this is more a fault of leakers taking information that was not supposed to be seen to the public and it causing a whole slew of issues later down the line. Anyway I hope that clears things up! If anyone continues trying to be racist or just down-right shitty in the comments, you can politely leave or I can remove your comments myself :)
She already said that she didn't own the move which would have been made her lose the case. Specially a move that's incredibly common for skaters, she is a shame for all skaters trying to act as if that move was hers and since the moves were still slightly different from her idle the motion tracking option for suing also wouldn't apply.
Suing based on that move is like people trying to sue others for doing the skateboard Ollie or the bicycle stunt move whereby they spin the front wheel of the bicycle horizontally etc
personally, i dont think there is no need for a compensation since it's not even a full on copy of her actual dance routine that she created with inspiration from common moves in roller skating. If it was her full routine then yes she should deserve credit because it's her routine but if it's just a dance move that has been common for how many years now then it does not deserve credit specifically for her because she said it herself "i don't own the dance move". This just strengthens Shaoji's take on leakers. They cause unnecessary conflict because they leave things without context like editing the dancer's video to make it look like it was her full routine when it was just a common roller skating dance move.

Yeah she had no way to win the lawsuit and shes not the only skater to use thst move. And designers using dances or moves from Real life is very common and you want that in games. Otherwise you wont have those cultural hits. But it really doesnt help that people who are just angry at hoyo are spreading misinformation. The skater is going in a losing battle if she decide to continue suing mihoyo. First, her dance steps are not under any copyright and/or trademark which she already admitted that herself. Applying a copyright for dance steps is very hard as far as I know, heck even more popular ones like moon walk were not copyrighted. Next, Xilonen is still in beta and mihoyo can safely say "any changes can be made in production stage". Lastly, like you said there's a difference between her dance steps and Xilonen's idle animation. Facing a losing case is hard enough but to go against a multi-billion dollar company? Yeah no chance at all.

I agree. I find it trivial to give credit for something like that. A character dancing on roller blades isn't something unique to the point that its copyrightable. It's just another idea Hoyoverse uses to keep standstill idle animations interesting.

As you said in the US and 99% of other countries i am aware of do not have copyright law pertaining to any kind of movement like a dance move since that would open people to being able to copyright things like how they swing a baseball bat or a particular way they throw a football. Such things are beyond reasonable to copyright. Second, as it pertains to her getting money for them referencing her, that is also not a valid case since taking reference from someone is not illegal. Only if they 1 for 1 put the skater herself into the game could she sue for using her image without concent. While the idea of them paying her for using her as a reference sounds nice to people who dont understand precedent what you need to consider is the same ruling if precedent is set could pertain to any other similar case. Someone could put a basketball in their game, and a basketball manufacturer could ask for compensation, along those lines. That is why the term "dangerous precedent" exists.

Hoyoverse as a company works very closely with a lot of creators and artists from their respective countries to either commission them to make art on their own channels or create a project for them.
