      I dont know why you are either shocked, embarrassed or surprised as a brit by the actions of brit courts as this is SOP in brit courts whenever evidence of a woman abusing her husband is presented. Why did you have to wait so long to be embarrassed? The cultural bias against men spilling into the court room is no secret, why is it that people come out now and act so shocked?

    Judge Nicol in the UK case wrote a legal book with the barrister Geoffrey Robertson who is (edit: was) married to Kathy Lette, one of Heard's biggest supporters - Amber's Angels as they call themselves. Heard attended a party at Lette's London home during the UK case. Judge Nicol's wife is friends with Lette, and Lette is also a friend of Heard's UK lawyer Jennifer Robinson. The judge worked before he retired at Doughty Street Chambers, where his colleagues included Jennifer Robinson and the barrister Helena Kennedy - another prominent Heard supporter who attended the party at Lette's house. How anyone could think the judge was not compromised in this case is beyond me.

      This is very common in the US family court system. The legislature basically allows family court lawyers to write the laws, so if you lose your job you have to pay $2000 to a lawyer to file in court to be heard by the judge to get a wavier during your period of unemployment. In Australia this is not a judicial matter but can be decided by a paper pusher after viewing the documentation of said unemployment

    My red flag is that Whitney had her back to Johnny. So just imagine you're protecting a loved one from an aggressor who is charging towards them, you believe your loved one is in danger, you put yourself between them and the aggressor ... is anyone else imagining their back would be to the loved one "aka potential victim" and their front would be facing the aggressor allowing for a clear line of sight and a better chance of being able to use your limbs to fight them off? I believe Jennifer Howell said Whitney was scared of what Amber would do to Johnny. Honestly I think that statement makes the most sense given Whitney's stance.

    • @ShinryuZensen

    • @superdave8248
      @superdave8248 2 года назад +8

      I'll be honest, I really question if all parties involved were either high or drunk as skunks when this incident occurred. Nobody questioned with this had clear memories of what happened. And to take it further, I think the two sisters had talked about this over the years and filled in the blanks of their own foggy recollections. Only in doing so, what the sisters told each other didn't jive with their own memories and they didn't realize this until they had talked it through in court testimony. Had they realized the inconsistencies they would have gotten their stories straight. But the damage was done in the UK trial. It is pretty obvious that Heard embellished the hell in that telling to get some additional publication interest in the story, and it never even dawned on her that this testimony would be questioned later and checked for validity.
      Sad thing is I think The Sun did learn a lesson with all of this. If they report similar stories in the future, it needs to be with a perpetrator and victim who are not UK citizens. Because the best way to avoid a defamation case is to not give the claimant an option to sue the "victim" with the news outlet in the same trial. The lesson that Depp and everyone else should have come to out of this is to sue the person who make the declaration first and then go after the news outlets for the defamation. But that gives the news outlets time to submit a revision to the story which then makes their damages considerably less if anything at all.

      And "it was so short after Australia that it didn't seem like a big deal" is also complete and utter bull. There's only two ways that would work: 1) it didn't seem like a big deal to her at the time so it didn't make much of an impression in her memory, which is bull because she remembers enough details about it that are WAY, WAY less relevant than him having a cast on his hand, and it seems unbelievably unlikely that you'd remember how hard the punches were but don't remember that there was a cast all the way through recounting the story over and over and over right up until cross-examination; or 2) it didn't seem like a big deal to her while writing down the incident and that's why she didn't include all the details, but it's a friggin' witness statement. You don't treat an incident like that like "not a big deal" when you're literally making it part of your allegations, and being close to Australia has no bearing on it. You describe each incident separately, and you get out the details you need to get out there, regardless of what comes before or after. If you don't include all the details in your witness statement, that would only make sense for details that don't matter like the color of the wall or when you had last watered the plants. Being punched in the face with a CAST does not meet the criteria of "unimportant details" if you ask me. Especially not when you look at other details she describes in these incidents that are more specific and less important than him having a cast on.

    I'm just curious to know if AH and her team (sister, friends, lawyers and expert witnesses) will ever be charged for perjury in both the UK and US? She's now in Today ranting on how unfair it is cos Johnny is the star and so on. It looks like the US judgment that favoured JD doesn't seem to stop her or her team from defaming him post-trial. They're even attacking the jurors, judge and social medias. She actually got off pretty easy for that 6 years of lies that could have put JD behind bars forever. Looking at how unfair the UK judgment or the judge was, or what's happening now, is there no justice at all for victims (regardless their gender)?

    • @UnbreakableMJ0
      @UnbreakableMJ0 2 года назад

      One thing I know for certain is there is justice. Always.
      No chance of perjury in the US because JD did not file a criminal case, it's a civil case. He just wanted his life back and the clearing of his name, especially for his family.
      As for the UK case, there's much to say. JD tried to stop a tabloid paper from defaming him, not Amber Turd. But since she's trying to claim that case as her own, many of us feel strongly that something gotta be done.
      One thing for sure, the US case is one example of justice served, fairly and precisely to the letter.

Okay.. how did he do that with a part cast on his right arm splaying his fingers out, 2 splinted together for support and ONE FINGER HAS A K-WIRE INSIDE IT WHILE BONES MEND? If there is any type of review into the UK trial, you need to get the doctor who put the k-wire and cast on him to the UK to testify as to what date the cast and pin was put into him, and what date they were removed - have the person who removed them testify to that date and compare it to the date the Judge had of the stairs incident. Then questions need to be asked about why these details were not considered relevant. Also hitting her not long after the internal fixation would HURT LIKE HELL.

However, it really does not sit right with me that the judge can be categorically BIASED on several occasions. In favour ofc, to AH and camp on behalf of the NGN and Dan Wootan from the Sun. I think that it is highly unethical to make such a damning ruling then retiring not long after. Essentially making it difficult to assess his competence and potential bias during this case. The cast isn't strictly a hard cast - the back of the hand and the palmate pad for the fingers are a hard cast to immobilise the fingers, but they are only bound together, to allow swelling to occur and be relieved at the side of the fingers.
    If Johnny had struck anyone hard with that cast he would have injured his finger again - as the cast isn't rigidly bound between the dorsal and palmate plates, and could move/flex/transfer impact to the fingers.
    With the alternative a full, rigid cast the two surfaces are rigidly joined and linked - and the forces are 'grounded' around the hand.
    The testimony was that the cast was an 'open' style one, with the relieved sides. No way did he strike "repeatedly and hard" or grab and pull people with such a cast on while still recovering from the surgery and post-surgery infection.

I have heard it and am sure heard by many. Discussion about increasing her dose of Seroquel - she was held back going to the hospital with him. I am sure that the conversation about that is something Dr Kipper and nurse would prefer not to be involved with. It speaks of stay away because you have done enough. When someone has a cast on they are more aware of their injury because it has actual weight - so pain and the unfamiliar but significant awareness of pain and its cause and your desire to mend tells your mind and body to NOT use an injured part and actually makes you less inclined to get into any physical confrontation simply to avoid more injury. It has become clearer and clearer over so much time she loved to goad and taunt him. She recorded certain things and has no true connect with how she reports it. I have followed this whole mess. It was potentially perjury even without the UK statements, and with your analysis too, it seems to just go even further down that rabbit hole.... I cannot comment on what UK judges should do. But I do wonder if combined, this event alone could be enough to have the whole UK case opened, as it has so many discrepancies between AH and WH between both USA and UK.
      Of course, time can cause memory to deteriorate, but this seems far too into being non credible, imo (and my opinion alone: this isn't my field, and anything I say here is personal thoughts, not to be taken as representative of any legal body in the UK).

      Not in Virginia and not an attorney. But this is a civil case not a criminal one. In this case a DA would have to push back hard on the perjury. But I think that would require a second trial as this would be a new charge or in this case a single criminal charge. So in this situation, you would need to have a Virginia DA charge Heard with perjury in a civil case that they don't even have any coverage over. It might get thrown out by the judge before it even saw the light of day. A civil case is outside of the realm of a DA privledge to prosecute and if the prosecutor isn't a invested party, then the charges get dropped.
      Probably the only person in this case who could file for perjury would be either Depp's legal team or the judge. But in order to do that, you would have to take into account the UK trial testimony and evidence which was outside the realm of scope for this case. So just like the DA in the previous statement is outside of scope for the perjury, so to would be the judge and Depp's legal team. They could only claim perjury if there was submitted evidence to conflict with the given testimony.
      Further, although it is pretty obvious that the testimony in the UK trial conflicts with the evidence in the US trial, the two countries have different legal systems. And the evidence for one would likely not be a submittal to the other.

I believe it would be possible to hit somebody with the plaster part of it and cause some damage if you put a lot of force into it and hit them in the head - but I am almost certain it would also break the plaster in it on impact too and there was no evidence his cast ever got broken, let alone got broken by punching someone. When someone makes so many false allegations, they often can't remember the exact details of what they had previously said. If an actual event is fresh in the mind, what they say will be more consistent. My Amber made one of many false allegations to police and the media. An example was when she said to police that, in response, to her lies in the News of the World, I'd sent an angry message to her phone. It was her mother's phone and I knew it was her mother's phone. She had no phone of her own. The court, of course, believed her. Six months later, I picked up my case bundle from my solicitor and discover that he'd been keeping cuttings about the case. One was an interview she'd given a women's magazine that included new allegations she'd never mentioned before. But also, she tripped up by stating, quite clearly, that the phone was her mother's. She's now a solicitor herself. Figure that one out.

      Yes! Exactly! Many people ignore this valid point, though it's probably not the best point to argue (if I were a lawyer), but here we go: a couple of fingers were in plaster, and it would easily break as the doctor testimony in the US, right? So first, if I'd hit someone with that hand, it would cause me some pain. Secondly, it will either break or it was hard enough not to break, right? Finally, if it was hard then obviously there is good damage done to that person and would clearly show, or in case it was soft and got broken, you'd point that out. I'd say that person hit me to the point his plaster broke.

I know you don't wanna get into "conspiracy theories" but by the sounds of it you don't need to, it sounds like regardless that his son was linked to Dan Wootton and Rupert Murdoch and the Judge himself was linked to The Sun's barrister and that Amber went to a dinner party with Injustice Nicol's wife during the trial whilst the country was in lockdown, forget all that but it still sounds like he broke every rule in the book to find in favour of The Sun. Also, I did ask you on a stream but didn't get an answer, please could you explain how Dan Wootton managed to get away with not even attending his own court case? He never had to explain why he wrote it, why he believed it to be true, where he got the information from, who he got the photoshopped photographs from, surely this is not normal that he was just allowed to write it and not be called in to explain anything.

      The UK judgement is made by one single person, who has a way better understanding of the law than a jury does, higher average intelligence, better access to evidence, but - unlike a jury - doesn't need to convince several other people that their interpretation is right. A diligent judge who wants to be just is always superior to a jury.
      The jury got it right, the judge did not.
      BBB, being a barrister in the UK - and probably wanting to keep things that way - would offend the wrong king of people if he publicly accused the judge of not being diligent and lacking the intention to be just. So, being English, he used more words to say exactly the same.

AH and her sister, sat and listened to evidence prior to their testimony. Allegedly, AH and her sister were using their phones in court. So many inconsistencies in the UK trial. JD would have sustained injuries to his pinned finger. JD is also right-handed and could not grab or make a clenched fist to punch with a finger in a splinter cast. I hope this case is looked at again with costs not being met by JD. Imo, an unsafe judgement was made.

For example, I would have used prior testimony to impeach both WHE and AH, which they did not go hard on. More, I do not understand why JD's team did not subpoena witnesses, rather than use video deps. Howell needed to be there, so that all of her testimony could have been included.

She would have significant head, face, and body injuries from repeated blows, head banging, and violent cavity searches. Thank you for laying this out so clearly.
