  • Lots of questions were raised With respect to Amber Heard’s credibility in the UK trial. Here is an analysis of the judgement and why I think some of those elements should have been taken into account against her testimony.
    This is not to say that I am right, it is not to say that the learned judge was wrong - but my opinion on parts of the judgment nonetheless.

      Long and detailed is the only way to get the full truth out, so I appreciate your content much more than I can find words for. I’m a long winded speaking (or typing) person and find much more truth in lengthy language, as it’s much easier to find it, “in between the lines” so to speak. Sadly, these situations are so brazenly disregarded by so many “in power” that it’s beyond obvious to most of us, where the truth really lies. Even without a judicial hammer slamming into one side or the other. But having these broken down by yourself and many other professionals, makes this reality of true justice so much sweeter and I’m thankful. 💜🙏🏻

      AH said in her statement that JD “kicked a chair at her” & kicked her in her back, on the plane! 😳 On the aeroplane!! Chairs on planes do not move!
      …& the judge found AH’s statements reliable?

      Did the judge consider the whole case through the lens, “Was Dan Wooton correct to believe Amber Heard?”?
      I do believe Johnny Depp more than AH, particularly on the most severe abuse claims. I think that Dan Wooton & The Sun should have called JD “an accused wife-beater” from the start but as journalists didn’t they have enough evidence (multiple sources etc) to write that article about JD keeping his role in Fantastic Beasts?

    So in short , judge wants evidence under oath but when thats submitted, he still will believe Amber’s words. Johnny never stood a chance

      I'm starting to believe this is one of those political situations where the judge was never going to side with JD. And then the appeal was never approved, which tells me that this judge has ALOT OF POLITICAL POWER. The UK, has WAY MORE EVIDENCE THAN US. And JD still lost.

      There has to be some ties the judge had like it's been rumored...I don't usually believe rumors because they are sometimes just that..rumors..but there is just way too much this judge overlooked. He could have just been biased but there has to be a reason.

      @@horrorgirl688 It was exposed that Amber and The Sun had a secretive relationship behind the scenes and Amber was introduced to this political circle that included the Judge. Dinner gatherings were held by the judge's wife even though she was not present at the gathering. The Biggest suspicion is the Judge quickly went into retirement after this UK Trial so it just looks too obvious. That's why we need to put in a petition and force the UK Parliament to investigate into this case. If the Judge is found guilty of a Biased Standpoint because of some hideous reason behind the scenes then the UK Court Ruling should be revoked/overturned in JD's favor.

    I've signed the petition that BB Barrister has started & urge everyone to sign too. I think it is only fair that the UK Courts motion to reopen this case. Johnny was not allowed a fair hearing. ⚖

    It literally sounds as if this judge started with a verdict and just dismissed unfavorable evidence as he pleased and accepted whatever evidence aligned with his already determined verdict. This case absolutely should've gone to a jury.

      I'll go so far as to question whether the judge shouldn't be removed from the judiciary, if the logic as to which type of evidence is more compelling changes based on which party would be advanced or hindered by that logic

      @@Londubh i haven't looked to confirm this, perhaps some one in the UK can, but I read a couple comments saying the judge retired after this case. If true that would be fairly telling.

    I honestly believe that unless the UK Court looks at the Judgment against DP with Dan Wootton and The Sun there will be no end to this. Thanks for clarifying. Very interesting

      @@justonecornetto80 Unfortunately for you, William Tell is right. English courts use English law -Scotland and Ireland have different legal rules and regulations. It is not nitpicking, it is a statement of fact.

Or are you suggesting that rulings made in English courts have no legal validity in those of Scotland and N.Ireland and vice versa? Also, how do you account for the existence of the UK Supreme court?
      "Mr Tell" is obviously an anti-English bigot judging by the numerous replies he's left in this comments section. My guess is that you're one as well if you think it's ok to jump on every comment made by outsiders in a pathetic attempt to give the impression that the Scottish legal system is somehow superior to the English one. I could go into the issues such as the complete lack of separation of powers between the Scottish government and the Crown office along with the blatant attempt to fit up Alex Salmond which makes the Johnny Depp ruling look perfectly reasonable but I don't want to turn this into an essay.

    As a law graduate who decided ultimately to go with another career path after considering legal practice, I can't believe I'm watching videos about case law which would have been the death of me during my student years. Thank you for the great work. I really like your channel and your analysis of this particular high profile case. It's always a huge worry to me when friends draw their conclusions about issues from media coverage alone having never considered any of the evidence. The work you're doing here is truly Socratic.

    I really get the feeling the judge decided for Amber earlier on and then tied himself into logical knots trying to justify it..
    The fact this happened in my country of birth is terrifying.

    Is it me or did the judge flat out use personal view rather than having a "Neutral" view when looking at the evidence. Judges aren't meant to use "personal view" or "personal Feeling" when dealing with cases? Is that not call for "Malfeasance in Public Office" by the judge and to scrap the decision and completely redo the UK case?

    Only part 2 of how many and already (to me) it looks like this judge already decided against JDepp before the trial started and never gave room to even consider that Depp could be in the right.
    I think a justice system that allows for this blatant disregard for evidence is an awful system.

    Ah, I didn’t realise Johnny had given his explanation in regards to “the monster”. He hasn’t been proved to be a liar so I accept his explanation. I thought he was referring to the monster so many traumatised people refer to when they become addicted to substances when dealing with their emotions. The monster in those cases are usually the monster that does so much damage to the drug users themselves, not to others.
    And yes, I believe Amber was quite violent to her own sister, probably more than once.

    About the petition - this is the way I understood it when the “BBB” explained the reasoning behind it. That AH said in the UK trial that she HAD DONATED ALL OF THE MONEY, but in the US trial she said that she PLEDGED ALL OF THE MONEY TO CHARITY, the fact that she said both of these statements “under oath” means that she perjured herself in the UK and in the UK, perjury is considered a much worse crime than in the US(!) this makes great grounds for appeal (or suing for perjury). That’s the way I understood it. So of course I signed the petition!! When you willingly lie under oath- SHE SHOULD BE PROPERLY PENALIZED FOR DOING THAT!!

    Johnny Depp used the term "The Monster" as the results of, or the grip upon him from, opiates. And I wish they had explained it as such, because anyone who has been touched by substance abuse, which is nearly every American, could understand that meaning and inference, and not then take it to encompass him as a whole whenever he and Amber argued, which is how she used it. Everything she didn't like, even when Johnny was for example leaving to protect himself from her being violent again, became "The Monster", whereas he only ever used it when referencing his opiate use. And not because he became the monster, but because the hand whose grip he was within was THE MONSTER.

    The judge seems more like a defense attorney than a neutral fact-finder in this case. At every twist and turn he finds a way to dismiss evidence that goes against Amber, worse, he doesn't even seem to acknowledge the overall pattern of dishonesty and questionable moral character. Even if you could forgive one or two small things, when you consistently have to give one side the favour of the doubt that ought to be a red flag for bias on your part or dishonesty on theirs.
    To me the audio recording of Amber admitting to hitting Depp is much stronger evidence of abuse than the Whitney video. At least as concerning as the admission itself are the other telltale signs of abuse: Amber is unrepentant, she diminishes her own guilt, she gaslights, she starts victim-blaming and shaming Depp.
    If the genders were reversed no one would have any doubts who was the abuser after hearing one party admit to violence and then blame the other for running away from the aggressor.
    I really can't see the judgement as anything but a flagrant display of "benevolent" sexism on the part of a judge who doesn't seem aware of his own biases.

    A question. Could a case of defamation be brought against Elaine Bredehoft by Johnny Depp and his lawyers for her suggestion they unduly influenced the jury, or even for suggesting the jury did not fairly reach their decision, which is actually defaming the US justice system?

      Not at this point. Part of defamation is proving damages, and no-one who already believes Johnny is going to start doubting him now regardless of what Bredehoft says. Ditto with studio execs, they're not suddenly going to listen to Amber's clown show lawyers, they are either going to hire Johnny or they're not.
      It would be a different case if, for example, a studio was willing to hire Johnny when the verdict came in, and then backtracked after Bredehoft started spouting off in interviews. Damages could be proven in such a case, but only people who already inclined to believe Amber are going to give a hoot what she or her lawyers say now.

      People would have to actually take a jot of notice of her rubbish first…during the case and now after she has so made a fool of herself I don’t think anyone will except the diehard AH supporters. I’m hoping she gets into trouble for stating the whole trial was basically rigged and the judge incompetent though, professionally.

    It should be a basic principal in UK Law that where there is NO Jury involved that a single Judge overseeing should be reviewed and demonstrates that they have no personal or financial interests associated with the case and is in agreement with both parties involved....this is common sense!! The oversight and regulation of the UK judges and barristers is abysmal and archaic in comparison w any other modern profession of similar standing in UK...they are closer to British MPs...even the US system has better regulation

    Thank you for explaining this to us. We in the United States could not understand how the UK verdict could happen. I have watched That Umbrella Guy since his coverage of this began..and when I saw the evidence I just was literally baffled by the UK verdict. She is so combative in court, which is completely opposite to here because I believe she knew that would never work here. I am thankful our appeal system is set as it is because we don't always get it correct. A lot of innocent people are in jail for things because of coincidence or corrupt officers. The appeal system sometimes allows for corrections to this. If you deserve your verdict so be it but we don't always get it correct as I am sure is the same in your countries. We appreciate your breakdown of this system and your opinions.

    I'm curious if there is a difference in the weighing of evidence, when the question is whether it was reasonable for the tabloid to believe that Amber Heard was telling the truth. Thanks for the interesting and insightful commentary.

    Thank you for presenting an insightful and professional opinion. I’ve never really been in support of cameras in court but having seen much of the depp/heard trial publicised I now feel that the same option should be available for the U.K. courts, my reasoning being that Judge Penny seemed to conduct the US trial in a fair and balanced manner where the rule of law was applied equally to both defendant and plaintiff whereas it seems that the British Judge acted with prejudice and did not apply the rule of law equally to plaintiff and defendant - I find it astounding that he would treat text messages as having more weight in the law over two witness testimonies given under oath, and I wonder if he would have shown such bias had the proceedings been televised.

    THANK YOU for continuing to analyze the UK judge’s explanation of how he scrutinized the limited amount of testimony & evidence presented in the UK trial. It’s SO obvious that the UK judge was EXTREMELY BIASED as he blatantly discounted firsthand statements under oath by witnesses which SHOULD have been regarded as “credible” as numerous witnesses provided “evidence” (actual testimony, video, emails, checks, audio recordings, etc.) to the court substantiating their claims which were in direct “conflict” with Amber’s testimony!! Each of the claims of these witnesses had merit on their own, but the cumulative number of inconsistencies between the witness statements and statements made by Amber, SHOULD have raised some huge RED FLAGS as to the propensity that Amber was the one LYING and their statements SHOULD have been the ones given MORE weight as to being credible!! The UK judge’s son worked for Murdoch AND Murdoch’s son was on Elon Musk’s (Amber’s boyfriend at that time) Tesla Board of Directors which is a CLEAR and DIRECT “conflict of interest!!” The UK judge should reprimanded, sanctioned or face some other SERIOUS repercussions for NOT recusing himself from this very high profile case AND an appeal should be offered to Mr. Depp as this judge clearly should NEVER have been allowed to preside over this case!! #JUSTICEFORJOHNNY #MENTOO

    As a Canadian I realize it's not my place to have an opinion, but this has been confusing. We tend to respect the findings of both UK and US courts. There have been other legal contradictions in other cases yet not on this visible a public stage. Some kind of clarification is needed to maintain trust in the sanctity of both judiciary systems.

    I went through 6 years of severe domestic abuse and violence from a dangerous ex-partner after a severe injury in 6 years I and the children were moved to safety and he was a monster and had done the same in the past with 2 others but after 14 years of battle, I am now finally free but lost everything in the process along the way. I now live on the road and work as I go. This case is like being in a circus and I felt it was a joke as real domestic cases 9 times out of 10 are left unresolved and if you have a disability it is your fault even if it is not your fault. I was left with a guy who is still out there with a restraining order that means nothing. I am still looking over my shoulder and fearful he is back. In this case, I have not seen any of this from heard but with depp I did but he a very good at hiding his feelings. I learned to hide behind a mask and smile my way through which I saw in depp but not in heard. I survived severe violence and abuse but I did not get justice which has left me with years of a lot of emotional and physical recovery with no rights and no help unless I have money as I do not and broke after 14 years it has left me broke and scarred. I live on the road to try and make a living with whatever work I can find but I still find a way with my dog to make each day count and smile.

    I’m following carefully your personal analysis of the judgement. I’m am shocked by what appears to be the lack of the judge’s insight and scrutiny of the evidence put before him, whether by intent or by desire! I have great sympathy with you and your colleagues as, unfortunately, this judgement is certainly not an example to the World of our wonderful justice system. In fact an embarrassment.
    My mother always said “you know where you are with a thief but never with a liar”!!

    Firstly thank you for making these in depth videos and for the petition as this is something I feel extremely strong about this. I have a question that I am not sure if it has already been asked or if you have already covered it. In the UK trial it is reported by some media outlets that Amber Heard stated to the UK court in some form (statement ?) , that she HAD donated the FULL amount that she received from Johnny Depp to the charities she cliamed. Indeed I believe there are videos of televised appearences on talk shows during which she repeated the same on youtube. Does this mean she commited Perjury? As I understand it even lieing in a statement is Perjury , and if this is the case, why is nothing being done to bring her to account?

    This judge has made the UK legal system look like a joke. It reassures me that they are atypical.
    Atypical though they may be, they expose a serious flaw within the UK legal system. I hope it gets fixed before more miscarriages of justice happen.

    I’m from Quebec Canada and I love your videos!! It’s so informative and it just shows how Johnny really deserve real Justices. It puts the light on all the lies Amber says, scream for 6years now, and how wrong she is, when she says how powerful Johnny is and everyone is ready to side by his side for that reason!     The Judge seems to have an underlying bias towards Amber Heard and against Johnny Depp throughout. However, presumably this has not been enough to force a re-trial, as other judges refused leave to appeal. I think that the strongest point raised is in Part 1, where the audio tape was not allowed any weight in the trial. Surely that was legally inappropriate , as supression of evidence, and should be sufficient for the case to be reopened.

    Judge goes the under oath reasoning quite often, but seems to apply it only if it benefits AH. As if all the other witnesses and evidence were not under oath.

    Thank you I was trying to research it what happened in the UK ...my main concern is the 12 counts of the 14 ....how many of them counts have been dealt with in Virginia every count must be cross examined other wise there is no point and an appeal will end up opening the old wounds up for no particular reason with incurring legal fees

    The actual producer of that reality show with Whitney has come forward to say they were only filming "B roll" when that conversation happened, which torpedos Whitney's claim of the producer trying to create drama where there wasn't any bc B roll is background video, which is played against other sound (For the opening, under shows theme music, etc)

    Being that the evidence is out there now, not just seen by one solitary judge in secret..... the evidence makes it look like it is easy to trick a U.K. court. I really think that if the U.K. doesn't have another magistrate look over the evidence again and at the very least charge Amber with perjury, then it seriously undermines the whole system. If the trial hadn't been broadcast, so that the while world could see the evidence, then they could claim the U.S. court was the one in error....but having the world able to see the evidence, makes the first judge look corrupt or foolish, and by extension hurts U.K. judicial reputation.
