Here is a section from the USCCA policy that illustrates a problem.
    1. Primary Insurance
This insurance is primary except when paragraph 2. below applies. If this insurance is primary, our obligations are not affected unless any of the other insurance is also primary. Then, we will share with all that other insurance by the method described in paragraph 2.c.
    below.
    2. Excess Insurance
    a. This insurance is excess over any other valid and collectible insurance purchased by the “insured”, whether primary, excess, contingent or on any other basis, that applies to an “occurrence” or “covered legal liability” to which this insurance also applies;
    b. When this insurance is excess, we will have no duty under this Coverage to defend the “insured” against any "claim" or suit if any other insurer has a duty to defend the “insured” against that "claim" or suit. If no other insurer defends, we will undertake to do so, but we will be entitled to the “insured's” rights against all those other insurers.
    WHAT DOES THIS MEAN?
"Primary insurance" defines which company pays first, and has the duty to defend, if something happens.
"Excess insurance" only pays when the primary insurance pays out their entire policy limits.
That is, if you have a homeowners policy with 100,000 dollar limits, that will usually be "primary." If you have any other insurance, that insurance won't pay anything until your homeowners company has paid 100 grand.
In Paragraph 1, they say that they are the primary insurance, except as stated in Paragraph 2. That is, they promise to pay first. EXCEPT AS STATED IN PARAGRAPH 2.
Paragraph 2a says that they are "excess" if you have any of the other common insurance coverages, at all. It specifically states that they are last in line behind every other coverage that might be applied.
Paragraph 2b says they have no duty to do anything until your homeowners insurance has already exhausted all of their coverage.
That is, if they are ever called to pay anything, they will be last in line. They have no duty to do ANYTHING until every insurance before them is exhausted.
All you are really paying for is an increase in policy limits on your current homeowners, renters, or car insurance coverage - with more exclusions and limitations.
All such policies will probably have very similar wording. Don't believe me. Take the policy and look for "Primary Insurance". It will be in every policy. The paragraphs may even be the same exact wording.
And then, you would go into the other issues and exclusions.
See the video by Marc Victor. His comments would apply to most, if not all, such policies with different wording. He doesn't even get into the stuff about who is actually going to pay.
Don't believe me. Please. Go ask your own agent to review this coverage and tell you who would pay what if something bad happened.

  • @icarusproject
    @icarusproject Год назад +23

I looked over the cost vs. expected value of the benefit, and it's just not worth it for me.
The odds of being involved in a shooting are just so exceedingly low and USCCA is NOT cheap. It costs nearly half as much as my car insurance - and in my car, I face high danger and high liability every day.
I have known several law enforcement officers. They go into danger every single day and face situations where shootings are the most likely to happen - and most of them are involved in one or less shootings over their entire career. And that's when a person intentionally puts themselves in harm's way every single day as their job. What about your average, every-day person?
If you took the USCCA fee of $20 per month and invested it over a 30-year career in an index fund, at a 10% interest rate, you would have ~$30,000 in that same time - which is probably enough money to cover you if something were to happen - and you get to keep the money if something doesn't.
When you go to cancel, USCCA forces you to call them and hear a sales pitch before you can cancel. This is not something that legitimate insurance companies do. It's something sales organizations do.
I'm not saying their product doesn't have SOME value. I think the biggest benefit is peace of mind. Like all insurance companies, they make their sales by appealing to fear. And yes, if something happened, it would be great to have the coverage. But you have to carefully think through the actual odds of that and whether the cost is really worth it.
When people sell insurance, they always frame your thinking around the worst case scenario. But the worst case scenario rarely, if ever happens. And when it does, the insurance company fights to pay as little as they can anyways - and you are often still left holding a lot of the bag.

Under Section I - Coverage A - Claim Expenses and Damages
    Item #2 Subsection B - Exclusions - Criminal Acts:
This policy does not apply to and provides no insurance for: “Any criminal act by any “insured”, including any injury or damage caused by or during any criminal act of any “insured.”
What this means is, if the shooting is not found to be a self-defense shooting, you are most likely going to be charged with a crime. If that happens, USCCA is not required to cover you. Most people think they are purchasing coverage from USCCA in the event they must use their firearm, but there is no coverage if you are found not to be acting in self-defense. So, if you think that you are purchasing the USCCA Plan because you want coverage if you are charged with a crime, they’re specifically telling you right in their contract, there is no coverage for a criminal act

Here is a review by a lawyer ruclips.net/video/gbEbOJMdK30/видео.html
The policy is a lawyer's lesson in how not to pay.
Even if they did pay anything, they would be last in line after you have exhausted your policy limits on any other liability insurance you may have, such as your homeowners.
Those critiques would be standard over pretty much any policy of this type.
Everyone would be better off to just ask their homeowners, renters, or auto insurance agent for an umbrella GL policy. Same price, far more coverage.

    • @cliffordschaffer5289
      @cliffordschaffer5289 Год назад +6

Just to be clear, all coverage would stop on any of these policies if there is any crime charged against any member of your family.
For example: Your kid deliberately breaks the neighbor's window. The neighbor comes at you with an axe and you shoot him in legitimate self-defense. You are not charged.
No coverage because your kid is charged with vandalism.
Suppose it is discovered that your kid did it by accident and vandalism charges are dropped.
      Coverage is not reinstated.

      Ask USCCA a simple question:
How much did they pay out in claims last year?
According to their advertising, they collect at least half a billion dollars per year in premium. A legitimate insurance company would be paying out about 67 cents of every dollar in claims. They should be paying out hundreds of millions per year for bail and self-defense lawyers. Read the news. That isn't even possible.
I can't find any evidence that any of them have ever paid anything.

      Texas Prosecuter here🙋‍♂️
It’s failed once under my prosecution and I’ve also heard of it failing the other two times in our region when it was used. It’s too easy for us as prosecutors to convince a jury that your sole intent was to hopefully kill someone one day which is WHY you obtained that level of protection to begin with. Aside from the fact that 77% of people that actually use their guns in so-called “self-defense” are indeed convicted to begin with, if you have USCCA as a level of protection it reinforces our angle of attack to prove or at least convince a jury of criminal culpability. In other words we will convince the jury that you wanted to shoot and kill someone one day which is why you got that to begin with hopefully get off. I’ve never seen or even heard a defense attorney capable of arguing against it.
Also on a sidenote we do not attack people that use blatant rational levels of force to thwart an actual attack, the actual statistical number of people who overstep their boundaries and go beyond the scope of reasonableness in self-defense is indeed at a rate of 77% and that is actual post conviction rates. That’s the chance you have to go to prison if you pull your gun in the state of Texas. The national average is slightly higher.

"the insurance company cannot and will not provide coverage for criminal acts and the recovery and recoupment provision gives the insurance company the ability to recoup amounts paid in the event an insured was convicted of a criminal act.
I think all responsibly armed Americans would agree that if what was initially presented as a lawful act of self-defense turned out to be a black and white first-degree murder, the insurance company should be able to recoup payments."
So it seems you could be correct since if you are convicted, the implication is that you committed a crime and were not justified...could you imagine if that were not the case though? Honestly I wouldn't expect them to cover criminals. It's really no different than your home insurance not covering you if you intentionally burn your house down.
I do understand the concern of being wrongly convicted though! Good thing they have great lawyers!!!

    • @cliffordschaffer5289
      @cliffordschaffer5289 Год назад +3

@@PilotPatriot NOBODY will provide insurance coverage for criminal defense. NOBODY. Against the law to offer it.
Coverage stops the minute that any criminal charge is filed against anyone in your family. You have legitimate self-defense against the neighbor after he got mad because your kid broke his window.
The vandalism charge for the broken window ends all coverage immediately.
And, if that exclusion didn't get you, there are more.
Funny thing. I read the USCCA policy. One clause says that their insurance is "primary" (they pay first) except in the cases listed below.
The cases listed below eliminate any real chance that they will ever be primary.
The whole policy is like that.

@@PilotPatriot First, let me clearly define the assumption that you’re making here. Your assumption is that you will only be found guilty if you’ve actually committed a crime. And, that you would only plead guilty to a lesser crime if you believed that you were guilty. I’m not sure that you understand how the legal system works. Innocent people are found guilty and guilty people are found innocent more often than you may think. In my line of work, I have been a party to enough civil cases to know that you can have done absolutely nothing wrong, and it’s still to your advantage to take the settlement.
I would also point out that this has actually happened to USCCA members. Ask Kayla Giles. Her USCCA appointed attorney still maintains that it was an open and shut case of self-defense, even after the USCCA dropped her coverage.
I’m bringing this up because I know a lot of people (myself included) were under the impression that if, by definition of the law, you were involved in a self-defense shooting, you were covered, regardless of the circumstances. The USCCA is not clear (some would say, honest) with potential customers about what their coverage is and is not. It’s also interesting how the USCCA’s own video debunking the claims I’ve outlined here hedges every counter point with words like “very likely” and “probably” to the argument.
To be clear, I think the USCCA training is decent for an online course. But their self defense coverage isn’t worth the paper it’s printed on. That’s my 2 cents. You can take it or leave it for what it’s worth.

    2) Where i live simply discharging a firearm is a felony aka you are already guilty of a crime. So, USSCA can just drop me? It's worth noting where I live four-legged threats are the primary concern (such as a loose pit bull).

Yes, and INSURANCE company supplying the funds - when it is ILLEGAL for any Insurance company to pay out funds for an illegal activity...always go for a self defense club - funded by an INSURANCE company. I would suggest someone or group such as "attorneys on retainer." Which are legal and able in all 50 States; no restrictions as to which State; and will ALWAYS help you - for any self defense incident where you were charged with a crime. A Self Defense Law Firm on retainer.

    USCCA Pros And Cons
    Great Training
    Highest Daily Per Diem
    Can Pick Your Own Attorney
Might Have to Pay Everything Back
    Highest Cost
    Capped Coverage
US Law Shield Pros And Cons
    Lowest Price Around
    Unlimited Criminal Defense
    Unlimited Civil Defense
    Bail Coverage is Extra Add-On
    Can’t Pick Your Own Lawyer
    No “Per Diem” Amount

Your facts are incorrect! USCCA defense coverage is also Unlimited!
Also No per diem, And US Law says they cover "Civil litigation" that doesn't account for settlements which most civil cases end in...USCCA cover civil liability including settlements. Also covers lost wages, incidental expenses, bio hazard cleanup, 1 million dollar bond, etc. All at no additional cost. And yes they offer alot of ongoing training that you won't get anywhere else because you cant defend yourself in court if you don't first successfully defend yourself!
The "you might have to pay it back" thing is totally false as well.
Both companies seem to be ever evolving and getting better and better coverage which is probably why we both are mistaken about the coverage of the other company.

The same issues would apply to any other similar policy on the market.

Of course if you are criminal looking for a service to help you get away with out right assault or murder...they wont cover you ....duh, but if it's self defense they will fight to make sure that is proven.

@@PilotPatriot "will your regular umbrella policy cover damages in civil cases,"
YES. For far greater damages, in far more circumstances, at a lower cost. See your agent.
      " lost wages,"
I used to sell disability insurance. Count on winning the lottery before you collect from that.
      " bio hazard cleanup?"
If it is your liability, then sure.
" Or train you to be ready to defend your life so you can live to defend yourself in court?"
You can get that for free rather than paying to go to an organization created by the insurance company to sell their insurance.
" It's more expensive but worth it in my opinion."
Which particular part is worth it that you couldn't get for less, with better coverage, elsewhere?
" I urge everyone too look into it and decide what they think is best, Main thing is just to have SOME coverage!!!"
If you have homeowners or renters then you already have coverage for anything they can cover. Furthermore, your homeowners or renters insurance would be "primary" so these people wouldn't pay anything until all your other insurance had paid out their maximum limits, anyway.
So, even if every part of their story was true, and you qualified 100 percent, they would still be last in line with the checks.
If it worries you, it would be cheaper to get a standard umbrella GL for less and watch self-defense videos for free. There are lots of them.

    • @cliffordschaffer5289
      @cliffordschaffer5289 Год назад

@@PilotPatriot To be perfectly accurate, liability for biohazard cleanup would be limited to things like cleaning up the blood from gunshots.
It would not include dumping barrels of toxic waste. If anyone told you that the company would pay for that, based on those kinds of premiums, then they have misled you.
Furthermore, if you did something to release toxic waste that would be a violation of the toxic waste law, then no coverage at all, for anything.
And that would be true of ANY insurance. If you want real coverage for biohazard other than incidental stuff then you need a special form and you are not going to get it in a package like these.

I gave you a thumbs down since you’re pro USCCA!
So I don’t know who you’re talking to, but I’ve had three years of training and I feel that’s enough, no matter what you feel or say! I do go to the gun range to keep acclimated! But I definitely don’t need training. I’m a small arms technician without gunsmith tools. I restore small arms. I’m a decorated Vietnam veteran of the United States Marine Corps. Besides my on the job training in Vietnam. And one of your brothers instructor Mike insulted me by calling me a white boy and said I should keep up with my training.
I wish he was in front of me when he called me a white boy!!! Because I would’ve rearranged his jaw so that he could never say those two words again!
I called the USCCA and asked them to revoke his instructor license! They said no, so I left them! Racism and insults do not belong in the forte of weapons instructors !!!!
