      That statute refers to private conversations with the expectation of privacy. Since there is no expectation of privacy in a public building there is no violation. It doesn't matter if you recorded conversations via video recording or audio recording. You can do either lawfully. At least that's how I read the statute.

    Who gave those public tyrants the idea to cite a law that pertains to the surreptitious recording in a private setting and apply it to an overt, lawful act in public settings? Whoever made that decision and/or advised it, should pay the lawsuit personally - no publicly paid insurance. The cops involved in LIA's arrest need their pensions take to pay the violation of rights, as well. And, they all need to be fired.

      He can sue them personally as atleast 4 clearly established constitutional rights were violated per scotus case law but he's getting 6 figures minimum in settlement alone from the department/city and I really hope he sues the treasonous cowards personally including the false reporters to take money from their families and make them pay personally the way they do to everyone else, and I pray to God true heroes liberate America from them all so they can't oppress any other innocent people!

      She did fine. She only seems angelic because most public servants are so dreadful. We’ve become so accustomed to insolence and sloth and incompetence out of them, that when one actually does do their job competently, it’s a total shock.
      Now, just imagine a world where all government employees simply did their job like she did. We would just take it for granted. It would be unremarkable.
      Well dammit, it _should_ be unremarkable. We _should_ be able to expect this level of customer service from public servants.
      And dammit, we _should_ be able to expect our cops to be smart enough to read a statute and figure out, “Hey, this doesn’t even apply to this situation…”

      I'm not defending those two or the actions they took, but I would rather a cop question what they think they know then to blindly follow, even if after the fact they misinterpret. Give them any praise when possible, in hopes they may grow from it

    City Administrator: We make laws by hanging signs. That's how it works here. Not anymore mam! Looks like the only ones that don't want to be recorded is the public servants. The young officer's neck is stiffening bc he knows he is now part of a giant mess. You can see his stress.

    To that young officer. This is what people try to explain when being told “it’s just a few bad apples”. No, it’s more than just a few if you stand there watching citizens being violated by one of your own and do nothing. You are part of the problem & are just as equally at fault. Do better.     This case was DISMISSED by the state once the judge granted the recording of the trail. A win for us, we the people 🇺🇸

      Judges must allow recording public proceedings unless they can show cause, i.e., a risk to one party outweighs the public's right to know.
      The judge didn't grant anything. He couldn't stop it.

      The problem is thus Circuit has ruled (poorly in my opinion) in ACLU v Alverez about video recording public officials and only NARROWLY ruled that the ACLU's program can video cops. It hasn't had a challenge it broaden it yet to all citizens.

      My department literally sits down for 12 weeks out of their 50 week training and watches first amendment audits etc. the last time an officer violated the constitution he was put on unpaid leave for 90 days and Ultimately fired and he got sued after

      I wonder if the City Administrator full well knew that the signs she referenced and were posted all over the place were completely unconstitutional, but because she’d gotten away with violating the Constitutional rights of the general public, and more importantly, the rights of the citizens of Berwyn, who pay her salary, that she could just go on doing whatever she felt like doing, and if she was ever challenged, she’d just call her husband Sargent Joseph Green of the Berwyn Police department, and have him send some of his fellow police buddies to do whatever she wanted, like illegally arresting Long Island Audit.
      The Berwyn Police department needs to be held accountable for their behavior and actions. Detective Monaco should be immediately terminated for assaulting a private citizen, thinking that this was acceptable behavior, and then never apologizing when he was called out.
      The young officer should also be terminated for not protecting and standing up for the victim of the assault. He did absolutely nothing while he was being paid to Protect and Serve. And lastly, the Sargent in uniform should also be immediately relieved of his duties, since he is asleep at the wheel when it came to knowing what constitutional rights are and laws. His having to constantly make phone calls to get directions on what he should be doing. If this Sargent had half of a brain, it would be lonesome.

      Apparently the SC elected to not review a case, in a particular jurisdiction, that will now allow reasonable force usage to prevent 1st amendment rights in those situations where police have the right to detain, arrest and confiscate material, in that actions are illegal to film the police while performing police brutalities.

    When you ask if you are detained, and they don't answer, you can reasonably assume that you can't leave under duress, and are indeed unlawfully detained. You should try to claim all of that time before you were arrested too.

      Question:
      Why did Sean show fear of being arrested when they asked him if he’s done with his business inside, and Sean replied “yes - I did my FOIA request; I’m bot goin’ back in there!” - yet Sean never finished exploring the building at all for the full audit. In fact, he was blocked from going further upstairs when he was led outside…
      They successfully intimidated him from finishing the audit, because Sean figured if he doesn’t go back in, they won’t arrest him. I thought that was weak, tbh. He knew that wiretapping law was being misapplied here.
      Glad the mayor took the signs down though. Good stuff.

      The statute exists but cannot be used for the purposes they are using it for. Illinois Supreme Court, under no uncertain terms, ruled using it that way was unconstitutional, twice in 2014.
      People v. Melongo, 2014 IL 114852. And also in People v. Clark, 2014 IL 115776.

      i am afraid you are wrong that is why there is qualified immunity to protect the police from making a mistake you would have to prove they both new the law and wilfully ignored it. and by the way I am totally against qualified immunity for the reason it is direct conflict of the U.S. Constitution, if all men are created equal in the eyes of the law then no one gets a free past and they who enforce law should be held to a higher standard and even to prove assault again you would have to prove intent I love Sean's work but the law states clearly if you do not follow the instructions of the police officer then they can forcibly remove you even if it was unlawful you would have to prove that in the court room and before you state that you have the right to resist unlawful arrest again you do but moving you along by physically touching you would not be considered assault by the police if they were acting in good faith that is why it is very hard to win these types of cases because it is heavily stacked against the individual. I have been saying for years the auditors are going after the wrong people go after the law makers and the superiors that is the only way to get real change.

    The young cop was really stressed out over this, he knew what was going on was wrong and I believe he wanted to do something but couldn't bring himself to take that chance, knowing he would be fired, THAT is the problem with policing senior offices NOT knowing the law and passing bad habits on to the junior officers

      When I had my SSgt (NCO) board in the Air Force, I made it a point to tell the board that I would hold my airmen AND my seniors accountable. The NCOs on the board did NOT like that I saw fit to hold superiors accountable.     This was an extremely accurate example of how LEO’s not only do not understand the law, they will make up charges based on feelings and disregard the rights of anyone who dares to exercise a fundamentally sound understanding of the very laws they disregard.

    Yes, because when I want to have a private conversation, I'll definitely have it in an indoor, public space where strangers are walking around while under the gov't's surveillance cameras. If gov't officials use their authority to hinder or merely waste a citizen's time with an arrest as a punitive tactic, then they should be terminated. End of story. LEOs know that an arrest by itself is akin to a scarlet letter, and, psychologically, an instantly satisfying, retaliatory punishment for contempt of cop. Unlawful arrest should be something that has a punishment that's so bad for a LEO that they wouldn't even entertain the idea of retaliation.

If what they’re doing is legal according to your state laws, any fight you take on with them will end up in court and likely ruled in their favor leaving you to appeal and challenge the constitutionality of the law in question which will require a lawyer and can drag out for a long time, meaning the cost to pursue it will be extensive for you. Hood you have the financial means to fight the power.

      Wise but not smart enough to get legal counsel for his court proceedings and now he's going to be charged with a total different charge for disobedience for a legal court order , and Yes they are putting the warrant together now and his property is going to be ceased and they are going to put cash bail so high he will sit in jail until trial and that could have been avoided if he didn't do what he was told not to do
