      Me and another woman were fired from a large oil field company . I contacted multiple attorneys in DFW and they all wanted our case but some tried taking it as non contingency . I ruled those attorneys out and found a great one . We are almost a year in and barely getting back answers from interrogatories and soon hopefully depositions. Our case is pretty huge . We were not only retaliated against. We were being sexually harassed physically and emotionally by the CFO of company whom we worked side by side with for 1.5 years .I built the case because I recorded conversations and saved texts. The company fired us saying we conspired together to steal. I was never even questioned by the company but they fired us anyways. Our attorney is suing individuals as well as the company - also we will sue for defamation

      I was fired for allegedly stealing a cell phone they stated the phone pinged near my car but never allowed me to have my car searched or speak with the Police.

      I’m in therapy which led to my doctor putting me on medical leave I got fired from my job they said I abandoned the job and I have all my paperwork from day one till now I live in New York I’m a custodian they never wanted to see the paperwork during the hearing. Do I have a case?

    Man, I got hurt by my manager at mellow mushroom, and when I sought a lawyer they ignored me, eeoc too. I found help through my state department of labor that handled the situation and sent my complaints in. They fined the company, gave me unemployment, and got rid of the managers that physically assaulted me
    Lately it feels like lawyers don't want to help you either, even if they see it's an easy win, they still ignore people like me. This video didn't teach me much

      I agree. Lawyers can be lazy. It's not that they don't want to help you. They don't see a big enough profit. So even if you have a case, if it isn't worth pursuing they won't reach back out.

      ​@@debreonn.5097 It must be noted that taking a case on a contingency fee basis is a *huge* risk for the lawyer. The case will take a lot of work and will consume an enormous amount of the lawyer's time, it will incur significant out-of-pocket costs that the lawyer will have to pay for up front, and at the end of it all, the lawyer may end up getting little or nothing.
      Winning cases is difficult, and you can never predict -- especially at the outset -- what the results will be.
      For these reasons, contingency fee lawers have to be very picky about the cases they take on.

      Or sometimes the attorney’s feel intimidated going a company with more resources. I do understand and this is the reason to make sure you gather all your documents. You are your best defense anyway - you know your case better than the attorney you might hire. Therefore, you work that case and don’t let the attorney do so. They know the law. Unfortunately, you need the law behind you.

    Sometimes is not about money is about not be available to get another job can't used this employer as a references and you work there for 15 years. Not available to get a job will impact your family members really bad, emotionally and financially too. Employer lawyers what they do is make this case take years if is necessary, this will make really hard to get a lawyer and legal help. This why save any text messages any proof and document. Share this on social media God will put the right people to help you to move on and keep moving forward.

    Great Video! My biggest concern is clearing my professional reputation! I really love my career however after my discharge no one will hire me. This maybe a stupid question to ask... if I should win my lawsuit what will my status change from Discharged to ? Yes, the money if I win would help in many ways but my reputation is what truly matters!! I've worked very hard all these years and won many awards, achievements etc. I went from Superwomen to Cinderella within 24 hours once my complaint was filed with my previous employer. Thanks again for all your awesome videos!!!

    I was hired at a job that knew I would need accommodations, permanently:I have cerebral palsy, and I can not stand up for too long.
    They seemed very understanding, but they told me I could not work until I got the accommodation Assessment filled out by my doctor, stating that everything would be fine. Once I got it all done, I received an email saying that "they could not accommodate what I require"and I was fired. I really feel like this is extremely wrong, and I want to take it to court.

    Good evening Brannigan. I have been watching your videos religiously since a co worker of mine told me about you. They are amazing, so informative, and incredibly helpful. Thank you for doing this!!! I need to file a wrongful termination lawsuit and one of your main points was to find a really good lawyer. Any advice for how to do that? I live in Texas.
    I reported sexual harassment to my manager multiple times and nothing was done. Then during the subsequent HR investigation they found all these issues to write me up for. Just like you said. Now, over the last 2 years, they wrote me up for the smallest offenses that where occurring everywhere else in our workplace. They finally wrote me up and fired me for a complete lie. I even have a witness to the event and they didn’t care. It was also such a small thing that even if I did do it, I don’t think anyone has ever been fired for failing to talk good about another employees skills. Still- I did not do what they said at all.
    My family is going to lose our house, etc. because we cannot pay our bills without my job. I am under extreme emotional distress.
    How do I find a excellent lawyer in Texas? Thank you in advance.

    I have a question! I was just terminated from my job during a workman’s comp claim, I have been communicating with my job, as well as with my work comp agency after every doctors visit, I worked 1 day, and my direct supervisor told me that the warehouse supervisor took me off the payroll without telling me, my agency, or anyone else. Am I able to build a case on this matter? I have every piece of documentation from the injury report to the last doctors note clearing me to return to work. Please help! Thank you!

    What if I got hired and worked for 3 days just for training but then got terminated because I didn't have a valid I.D , but they said they would mail my check threw mail in 24hrs but its been 2weeks & I have also contacted them left messages & send emails never replied also txt the supervisor that hired me but he is telling me is not his problem , what can I do !?     I was wrongfully terminated recently after catching Covid I was through a temp agency. I’ve worked with the temp agency as well as my employer to let them know I am out due to catching Covid; and I was informed to take ten day quarantine and return to work with a negative Covid test. The ninth day of my 10 quarantine my employer fired me due to not following the call out procedure for the days I was out of work. I know I’m protected by various workers rights as well as OSHA and potentially the ADA. I am very distraught it has not only affected me but my gf as well. I’m meeting with a lawyer tomorrow since I have lost everything. I’m losing my appartment I’m behind on bills. And it’s been so stressful for both me and my gf.

      That's terrible! I just read where a new Covid Disability Civil Rights Act has been added to the Civil Rights Bill. Google it and learn your rights, then fight back! You can file a complaint with your state's Human Rights Office. You should also look into filing a complaint with the U.S. Dept. of Justice, if you are in a protected class under the Civil Rights Act. Its a shame how we the People are being Covid crisis abused daily by companies, doctors, employers all done in the name of Covid. They need to pass a law for Covid abuse of authority. Good Luck!

      @@michaelg4044 Most lawyers take on wrongful termination cases on percentage of settlement. That means the terminated employee doesn’t have to pay anything. If the attorney doesn’t win, he doesn’t get any money. Attorneys have to make a determination up front if they have a good chance of winning because they will spend a lot of time on a case.

      Which leads me to my question. What if the Arbitrator find in your favor before the employer attempts to remedy the situation. Can I be eligible to receive lost wages if the arbitrator sided with me in this matter? My first plan was just to keep my head down and continue to do good work, but I seem to be getting the cold shoulder from many different angles. = (

      Good question. I would assume so, but I think it would depend on what your state law says on the matter.

    I was wrongfully terminated while I was out sick after having back surgery. I hired a lawyer and sued the company I was rewarded $25,000 and the attorney fee was $10,000. I felt like the lawyer rushed my case and wasn't properly compensated. Other than that the agreement was for the company to also re-hire me but they failed to do so. When I tried to contact the lawyer I was told he no longer works for the firm, someone else can take over my case. What should I do, I don't want an other lawyer from that firm. I have a feeling they are not trustworthy.

    Can you help me .. I was home for almost a week and a half taking care of my daughter that had hand foot mouth disease from the day cares I guess it’s a virus that spreads. I got terminated on a Sunday and never received a letter. He txt me about a termination without the reason. Does this look like it can be a case against him?

    Sir, I did have an important question. What happens if I get fired for retaliation, but my manager refuses to tell me why I was fired or if I am even fired at all? In other words, I was working in California and I asked for accommodation with my disability via email, which my manager never responded to. But, out of nowhere, one week later when I was at work, my manager went up to my desk and said I was no longer an employee of the company and gave me my final check. I asked why, and he told me I was laid off but did not explain why. But, when I asked for some kind of written notice via email or in person that confirmed my termination, he just denied giving me that and insisted that I leave the site and not come back. What do I do in this case?
    The CA law states that employers are required to give you a written notice if they fire or lay you off, but he did not do that. What can I do if he does not give me one? Can he get in trouble for not giving me one? Should I have refused to leave until he gave me a termination notice?

    I have an open case and opposing counsel offered $15k off the bat to close my case and we said no. We sent a deposition letter. Case has been going on for 10 months. I provided everything for my attorney and he said we’re set. They also lag on purpose. What is the potential pay for something like this? I was fired on FMLA taking care of my son that had COVID-19.

    do i have to file a complaint to the EEOC before i can get a lawyer? i believe i have a good wrongfull termination and discrimination case. I also documented and audo recorded all my phone calls so its pretty easy to prove as well. I would think a lawyer is the wasiest way to go but the EEOC website says i must first file a claim with them and get permission to use a lawyer. Is this correct?

      No, usually people hire a lawyer first. When I take cases that require a right-to-sue from the DFEH or EEOC, I usually contact the agency on my client's behalf and fill out all the paperwork. But, if you can't find a lawyer, or your statute of limitations is coming up, then it is fine for people to go to EEOC or DFEH first. Either way satisfies the legal requirement, I just prefer that a lawyer contact the agency rather than the client so the claims on the right-to-sue are correct. Lots of people screw up their right to sue letter.

      Good question but it's impossible to answer without knowing every detail of your case. And even if I did, I can't answer with any certainty because each case is a negotiation with the company and its lawyers. Negotiations are not something that are predictable enough where someone can say "the value doubles if you've also got retaliation." There are so many variables that change all the time it's really impossible to say.

    I was wrongfully terminated for a work related injury( hernia ) . I had reported this injury to my boss & without hesitation he said he will contest it and denied me medical attn.i had asked to go to a clinic with there referral . I was denied again.and told me to come back with a doctors letter as I did and he ignored the light duty status and had me Jackhammer two driveway and dig down four feet through hard pan soil every Monday for several weeks. I then felt the tear again and reported my condition again. He then told me to take time off untill I come back with a doctors note.as my testicals were swollen to the side of softballs I wasnt comming back untill I had a sergery as I couldn't sit any longer. I had hired a work comp. Atterney the state fund sent me to a medical clinic to be examined. And then found the private employer did not have insurance. After 9 more months I was told o was going to sergery .in the near future and until then the boss mailed me a letter said I would be fired if I didnt come back with a doctors letter in the next two weeks. I sent this discrimination to my atterney. .and Carl was warned.i I was out of work for nine months without a new y income my senior citizen lover was stressing out as I was due to the hardship for loosing my job, then my truck was stolen, my roommate being bi polar 1 then told me to leave her Mobil home as she also stolen my clothes a d tools backed by a restraining order to protect her of her own crimes. So the mental stress is just gotten heavier as I was out in the cold Jan 1st in 30 degrres.i was so cold I couldn't sit to sleep as I called my lawer a d said If I seud this company for a million dallars it wouldn't be enough for what there putting me through.i then had sergery and 8 weeks recovery and 5 doctors notes mailed for my return to my job it was now twelve weeks as they figured they had to give my job back to get me off the insurance payroll and then fired me 5 times in a six week period as I asked about my senority and job I had as he fired me for that. He stalked me, threatened to fire me daily,slander,harrassedme. Trying to get me to quit but fired me for using the rest room. That was the last day I worked. I was denied unemployment as I had 4.5 years here. I had wrote the owner of this and he said the manage ment does not intend to bring me back as the manager resigned. It's now 15 months and the insurance co wants to end this ledigation with 5 grand and I wasted 6 months waiting on fair housing & unemployment. Just to tell me it's out of there jurastiction.     I feel i was wrongful terminated. They never even told me I was terminated. I had a note for a mental illness and they didn't care to look at it. But just a few days before this happened, I put a complaint in for my how GM treated me, other things. But we have a no retaliation policy and no one investigated it at all. Am I just upset or do I have a case??

    So on September 25th I was wrongful terminated because they told me that Someone stoled 10,000$ worth of speakers from the job and they told me they saw me on camera helping the guy steal the speakers. They tried to get me to confess but I had no idea that all of this was happening in the first place so because they didn’t believe me they terminated me I’ve been looking for hire a lawyer to sue that company for wrongful termination

    I was getting harassed and discriminated against. Before getting fired I went to my supervisor about the lead and how I been having issues with him. Right after I spoke to her she about him. He waited til we was in the elevator together and started antagonizing me. I kept cool until we got in the office he started antagonizing me again. I told him repeatedly to leave me alone and if he felt some way you could've said it when we was in the elevator. After the incident they did investigation I was terminated from job the reason was I had curse at the lead.... I'm not getting no unemployment I have a appeal hearing Tuesday and I know they going to try to use old writes so I won't get no benefits. I got hurt on the job and I was denied workers comp i didn't fight them back. I dealt with knee injury on my own. I kept going to my doctor's appointment. My Dr told me I might have to go on FMLA I was denied that too. I been working for them for 2 years and 6 months..

      It doesn't cost money to file a complaint against your employer with the EEOC. If you are in a protected class you can also file a free complaint with the Office of Human Rights and the U.S. Dept. Of Justice. Good Luck!

      @@roxstarchef6682 Unfortunately, there is a lot of legal misinformation out there right now. In short - Vaccine mandates are completely legal. There is no legally recognized exemption to the vaccine for religion. While some employers are granting exemptions anyway, they are not legally required to do so. Therefore, if you get fired for refusing to get the vaccine, it is highly unlikely that you'll have a legal claim for wrongful termination.

      Yes! I worked for the Federal government and they will find a way to get rid of you. I had a medical problem and they denied my accommodation request for days off without pay because I ran out of sick time. I had one month left of my 1 yr probation before I would be eligible for FMLA. They will use your coworkers and other supervisors and sometimes “customers” and “stakeholders” to play along in documenting your behavior to manufacture evidence to get rid of you. Setting up scenarios to see how you react. BASICALLY SEIZING THE OPPORTUNITY TO EXPLOIT YOU IF YOU HAVE A BAD DAY AND MESS UP,

I was initially brought in to sign a write up containing two statements from me that were twisted out of context and inaccurate, then an accusation which was inaccurate, and then I was accused of insubordination for speaking out about something that was going on in a team meeting that affected all of us. It was very strange bc they gathered all of this “evidence” within seven days and it was supposed to be a first written warning. So I went to HR to request accommodations for my disability since the change in demands was having an impact on me. I was fired. I would have been eligible for FMLA in January. They said I had too much anxiety to work there which is an ADA violation. The write up was not only inaccurate but it was a first warning. I was fired for asking for accommodations and refusing to sign their version of events.

    I believe I was passed over for a raise, and eventually targeted by management at my job because of my disability. After hurting my back doing work I shouldn't have been doing I started saying no to work that wasn't my job to do. When raises were given, I wasn't given one, after months of asking, then I was targeted by management in front of my peers to trigger me, so they can fire me. When I finally was bothered enough by the comments, touching, and being publicly put on display in front of my peers, I became mad and shouted at the manager. They told me to leave and fired me the next morning. I have combat related PTSD, anxiety, depression and arthritis in my spine. I told glen, the operations manager, during my job interview, 8 months ago. I told the owner, sammy, after that, and told him I didn't like that treatment.

    If your boss was reprimanded for having inappropriate conversations about you (agenda to get rid of you) and it’s on record prior to the termination (in addition to an internal racial discrimination investigation and claims filed to EEOC prior to the termination) will this help the case? What if you were fired 3 days after the investigation closed due to “job performance.”

And even though I’m afraid at times and may even lose, I’d rather go down fighting on the right side of justice and at least say I fought a good fight. If I win that’s great but if I lose the way that I see it there are some battles (and evil people) God may want to take on Himself. If that happens, I will gladly lay down my sword and give this to Him. My husband says it’s better to try then living the rest of your life wondering what if. No matter how this goes down, I know I’m divinely protected. I urge you to do the same and fight for yourself too. It’s the only way to send a message to these employers that there are consequences when they do this to the working man ( and woman). I’m not just fighting for myself but others just like us. I wish you the best in whatever you choose to do. God has you. 🙏🏾

    How much do you get in a law suit if lawyers and employer use your witness help against a firm to be part of thousands of witness you don't lose anything. Or have to show up to court but if they win you win a percentage how much would a witness like that get in a discrimination case if the case is worth 2 million the one employee ex worker is suying for 2 million. There are alot more people that are the same type of witness whats the average percentage of pay in a case like this? Does anybody know?

    My Son got fired from Bit-coin corp, He told me there was family members working together and plotted against him according to the false accusatory story and excuses from human recourses received from the other employees , As far that I know its illegal to have employee families working together in one site , There is mother and Son and others with the same last name, plus they fabricated exaggerated lies , plus some employees dont know their work but got away with a resume , and Who knows how many lies are in those records to enabled them to get the job.       Unfortunately, this is very common. The company is legally allowed to fire an employee accused of harassment - even if there is substantial doubt on the veracity of the accuser. Your legal option in this scenario would be to file a defamation case, but those are really difficult in employment law. The better option usually, is to try to get your job back outside of the legal system. Sorry, I wish I had better info for you here...

    Say I have a growth on my jawline and my doctor's suspect it could be cancer, and even if it isn't, I have to have surgical removal soon. I schedule the operation, and I'm fired for missing work due to the operation and it's recovery. Is this considered wrongful termination? It's immoral, but I imagine there are some companies who would try that.

      It depends on your state's laws. In CA, if the company is firing you because of a protected disability, then the law is broken.
