      You're absolutely right. I used to own a shop, and one day I phoned the police to report a man using fake bank notes. Within 15 minutes they phoned me back to tell me the guy had been found and arrested. If you get robbed or scammed as a private citizen though? Forget it, they don't want to know. They just "make a report" then it sits in some database for all eternity.

      You're quite entitled to tell them to piss off, they are just civilians and have no right to question you.
      I did this job many years ago and we were told by our bosses that we have no powers, other than that of any other member of the public.
      I've worked with people who let the job go to their heads.

      A citizen's arrest is an arrest made by a person who is not acting as a sworn law-enforcement official. ... This legislation states "any person" has these powers, and does not state that they need to be a British citizen.
      It's only wikipedia tho'..

      I believe it was Yardley Ski who when confronted by the Police didn't say a single word. The Police ended up leaving & saying 'bye then' without any further hassling as they had nothing to go on from Yardley Ski.

    I love the way the PCSO is trying to sound as though he has authority, whilst knowing he can do nothing in this ridiculous situation. PCSOs are not attested constables, and therefore do not have the same powers as a police officer. Basically, they are walking or cycling security guards and are primarily used as a neighbourhood watch patrol.
    As for the female security guard, she needs to grow up.

    I noticed that as soon as AB had explained himself, the PCSO immediately began moving the goal posts. You can tell he'd made his mind up to side with the 'ladies' from the get-go. It should be simple; is it legal to film in a public space? Yes? Then be on your way and have a nice day.

      Absolutely all the fafing around it was quite simple was the guy who was stopped in a public space? If the answer is yes then no offence is committed as ' there is no expectation of privacy in a public space'
      It's basic knowledge anyone involved in security should know this.

      Cctv has a purpose and has a limited life span under data protection law, even in a public space, your image is protected and not for self gain like this person of suspicious behavior.

    Years ago I went to my local Sainsbury's, which I visited several times a week for many years. I never once had a security guard follow or approach me. One Sunday morning I went to get something for breakfast. I had my tracksuit on ....it was Sunday. I had no pockets and because it was light grey flannel there was no way I could conceal anything. This pea brained, power tripping security guard followed me all around the store. Didn't even bother to be discrete. Followed me up and down every aisle about three feet behind. I made him walk the whole store. When I paid at the check out he looked really pissed off and even followed me to the exit. I guess he thought he was intimidating me #NOT! As I walked out with the prat right behind me I heard someone call my name. Across the road was my brother in-law in uniform with three or four other coppers and a police van. I went over and we started chatting. I looked back and pointed at pea brain. He looked decidedly uneasy perhaps even 'intimidated' and made a hasty retreat. Made my whole day and the numpty would avoid me like the plague after that. Thing is had seen me in the shop many times and usually it would be after work so I would be in a suit. Some people are just plain dumb and you can't fix stupid.

      That happens mostly because there are a lot of thieves in the stores on a daily basis and the security probably gets instructed to be much more awared and careful, or even sometimes gets financially "punished" if many things have been stolen for shorter periods of time, but still, they are doing it all wrong, because they are not able to classify individuals and just act on general basis, which is yet their imaginitive projection, and they manifest it wrongly.

    We did some busking just inside the door of the shopping mall for a laugh. It took 5 mins for the jobs worth to turn up. His phone rang so we carried on playing. His phone call lasted 10 mins and we made another £10. 🤣🤣🤣

    Just goes to show there are good and bad in every bunch. I was taking photos in Bicester village and a plain clothes security guy asked me what I was doing. We chatted, I showed him my website and Instagram. He politely asked me not to post any pics of him. Didn’t demand anything and wasn’t in the slightest bit rude. Just a nice guy with a reasonable request.

      @@steveforster3420 I don't know what the reference to heartbeat is, I assume it is a TV thing. Cops do tend to know the laws, that doesn't mean they know every law and it doesn't mean they follow the law but, when directly challenged on the law they will radio and get clarification if they don't know it. If they don't do that and you stand your ground not only will they lose any court case for "misleading" about the law but get a bollocking from the judge.

    "You're not allowed to film in a public area" is quoted so many times by people, not knowing that it is totally legal. Unless you are stalking a person and filming them in particular, which again has to be proven

    what the auditor might have forgotten is that the shopping precinct is almost certainly private property that allows public access, and as such may have restrictions on the taking of pictures and videos.

    We had the same thing happen in Newbury with security idiots. We had a new shopping centre open and the edge of it goes by the side of a public footpath. So one day the BBC turn up and started to film a historic old house also alongside the footpath. The tv crew were on the footpath filming when a power-hungry security man turned up and told them to stop filming, even thou the crew were stood on public ground and they told the guard this he still threaten them.

      Why are some people so hostile towards PCSO's? They are cheaper to employ and therefore it is affordable to have them patrolling our streets. It isn't cost effective to have warranted officers wandering around these days unfortunately. Dixon of Dock Green style policing is a distant memory, but many people still want foot patrols.

    On public land you can photograph or film anyone/anything, it`s the law. Without that law councils, police , homeowners etc would not be able to use CCTV cameras.

      The "UK is covered in cameras" myth is just that, a myth. It is no better or worse than any other similar country, from the USA to France or Germany. The story started based on one single deeply flawed report that looked at two streets in London and then extrapolated that to cover the entire UK. And even then the vast majority of the cameras they counted were not state, government or council cameras but those belonging to private businesses and private citizens, with many of those being in non public areas like retail warehouses, loading docks etc.

      I take it you don't have an SIA licence, their powers are exactly the same powers as any other pedestrian. they have Zero Authority over any other human but do have the ability (just like anyone else) to use reasonable force to prevent a crime and can (again like anyone else) perform a citizens arrest, their SIA raining is so the do not overstep the mark and find themselves in Civil or Criminal court.

    If he is in the street hes perfectly entitled to take video ..when these cop reality shows are shown on tv you hear the cops say all the time that the camera crew are entitled to film in a public place...they can't have it both ways

      Police dog was giving his opinion and failed in concluding there was no crime committed. His performance was poor and time wasting and therefore a waste of tax payers money. He was not aggressive or pushy, so maybe he could work in a reception for an example, not police.

      its now illegal to offend they made a new law that trumps all other laws its a very wide blanket law that police can use with no evidence whatsoever to throw you in jail.

      Most have a sign near them stating cctv is in use. They should have anyway. If one finds a cctv camera offensive, 1, you really have problems and 2, shop elsewhere.

    I once went to Birmingham and was outside the bullring shopping centre, and started to take a few photos of the surrounding area, and some nob security guard came upto me and said I could not take any pictures in this area as it was classed as private properly,
    I simply replied well if this is classed as private properly, then surely we are all trespassing and I believe taking photos in a public place isn’t a crime
    He looked liked he wanted to kill me, but knew he was powerless to stop me so I continued to take a few more photos where he could still see me just to piss him off 😂
    Just simply ignore them, they have no powers to do anything and as we’ve seen, even the police can’t do anything, pathetic in this day and age, someone is suspicious if they simply take a photo in a public place, oh the hilarity 😂

    Dumb cop doesn't seem to know that as long as you are on PUBLIC right of way, you can photograph or film ANYTHING or ANYONE. You don't need permission and someone being upset about it doesn't trump your rights.
    Unfortunately too many people seem to wanna bend over and take it from so-called authority, and allow their rights to be breached.

    Stop right there, PCSO's are not officers of the law, just because their job title has the word "officer" in it does not mean that they hold rank or position of authority.
    If I work as a binman, but my job is described as a refuse engineer, I cannot claim to have any engineering expertise or training.
    Ask these Mr Benn's to quote you the law or get you a real police officer to deal with you, they have no power to detain you above that possessed by any member of the public.
