hi Carl , I am on a 482 visa and worked with one employer for 2 years. Then, I spent 2 months waiting to switch to another employer. I resigned a few days ago and recently learned that the timeframe to find a new employer has been extended to 180 days instead of 2 months. My question is: do I have the full 180 days, or should I deduct the 2 months I spent during my first employer change, even though it happened before the new law came into effect?
Hi Karl, my lawyer lodged my 186 visa on the day of my 45th birthday at 5am. Has that put my visa at risk? They were meant submit the application the day before. Thank you for all the information you provide.
If you had already turned 45 which would have been 12.00pm, then it would be too late to lodge. If your lucky DOHA may accept it but your agent will be in trouble if they dont
Thanks for your videos Karl, always very informative. Can we do anything else to bring attention to 191 visa processing or at least easy restrictions for 494 visa holders? I applied in May 24, processing times have been increasing from 2 months to 9 months and seems to be increasing again. We are stuck in the same job, same salary and quite often very poor work conditions while 482 and 186 visa are processed in couple of weeks. We have been emailing MPs, open petitions, trying to get exposure on social media but it is getting worse and worse every month. We fear an 887 sitiation for 191 visa applicants soon.... Well indeed it takes more than 17 months for 186 visas to get processed in metro. 1-3 months is for regional 186 applications. I didnt understand why you stuck with the same employer while waiting grant for 191, isnt it independent from employer?

And it keeps increasing. A very significant increase compared to early 2023. For a visa that costs ‘only’ $500, the processing time doesnt make any sense. As a 491 holder who has just lodged 191 application, Im so stressed out as it feels like Im stuck in an ‘unfair game’ as DHA keeps changing the rule of the game / moving the goalpost (by keep increasing the processing time). @esevb because we need to comply with our 494 visa conditions while awaiting for PR. So even if the application is independent, the time while awaiting for the grant is not...
From refused visas to ART lengthy reviews to Federal Court reviews to failed departure to “maybe removal”, one person can still find various ways to delay their departure, sometimes for years. I don’t know how many more staff ART would need to have to not let waiting time blowing out into decade territory, but I’m not seeing the promise of “lowering numbers” when “failed departure” has not been addressed by anyone properly at all. Let’s see if 2025 there will be some sweeping changes to this after labor is expected to lose the election.
Yes Estelle you are right the situation os getting out of hand but it natuaral for people to try and stay as long as they to can and fight to get the outcome they are looking for

That is a tough one. In the end people will have to decide it maybe better to go home and work in their occupations. In fact the future points test will probably benifit those offshore with significant work experience than those who have studied here.

Hi Carl, I hope you are doing okay. This year in May I will be eligible to apply 191, but I just saw 8579 condition it says you should not have spent 90 days per annum outside DRA, myself being primary applicant didn't spend more than 34 days per annum but secondary applicant (my wife) has spent 93 days in 2023. The first time, she spent 34 days in Feb-Mar 2023 and then 59 days Oct-Nov 2023. Will that affect the decision for 191? Thank you

Hi Karl, my partner employer wants to sponsor her under the 186 Direct entry stream. She works as a childcare worker (group leader) we were waiting for the 3 years experience to apply for the 494 as we live in Gold Coast but with the new CSOL she already has the 3 years experience as a regular childcare worker. The problem we are experiencing is that she needs a skill assessment but ACECQA is not doing skill assessment for regular childcare worker, so we are stuck with a Skill in the CSOL but no assessing authority willing to do the skill assessment. Hi Karl, how about 494 visa transition to 191 visa. Immigration website says need to stay 3 years inorder to transit to 191. However, there are some sources citing that 494 holders are eligible to apply for 191 after 2 years if we are under DAMA visa (494). Your clarification on this would be appreciated

Hi Karl, I lodged my 190 visa in Dec 2023 when the processing time was 8 months. It has now stretched to 19 months which is mentally exhausting for many of us making such a big move with families. DOHA delays are causing immense mental stress especially as life changes like marriage/divorce can alter points. There is also a complete lack of transparency with non-priority occupation grants sometimes being issued to Jan 2024 applicants while the previous backlog is already waiting. Can you please bring attention to this issue?
Hi karl. Thanks a lot for the video. I lodged in June 23 my 190 visa and since then timelined keep increasing dramatically. I don't know what is happening seriously. Now on 15th Jan 2024 they have increased the timelines again. This is the 5th time since my lodgement that the timeline is changed. They have the quota so what is holding them to give the grant. I am really Stressed out 😢😢..

ive been with my employer from january 2023 up to present (exactly 2years) under employer sponsor 482 visa . i still have 18 months left in my visa but im sure im eligible for trt 186.. the problem is my employer doesnt want to sponsor anymore since theyr a but dodgy and i reported my manager to HR and theyr not happy about it, i guess my question is there any other option to go for 186 or Pr visa without my employer . hope to hear from u. thanks
@ i know i have other options like going for 491 and 190, but i guess its impossible to go for trt 186 without my managers approval. the good thing is i still have 18 months left on my visa

I just wanted to ask about my case: my partner and I are on the former 482 temporary sponsorship visa (granted in August 2024) and she already meets all the requirements for applying for the 186 direct entry visa, includin the positive skills assessment and 4.5+ years of work recognized in ger field. We just didn't applied for the 186 visa at that time cause her skills assessment took longer to be approved. Could you let us know if we alao can apply for the 186 direct entry visa before the two years even if we are on the moment the former 482 visa? Hi Karl, as you planning on releasing a more detailed video about the 482 visa, could you explain how it works with changing sponsors? Is it gonna be possible to add the 2 years full-time employment together from different employers, or does it need to be for 1 employer only? Also, once your new employer nominates you, will you get a new visa granted for 2 years or will you remain on the same visa?
The 482 visa time for the TRT stream can now be added with multiple sponsors. When a new employer sponsores you there is no need to apply for a new visa if your current one still has alot of time left.
@ailsaustralia Thanks for the info! What about the time while transitioning between sponsors? As I would need 2 years of full time employment (added between sponsors) to apply for the TRT stream. But if I need a few weeks time between finding a sponsor or getting the nomination process started, then those weeks I would miss on my 2 years of full time employment. Is there a way to avoid this?

Hi Karl,Happy New Year! Sorry for insisting on this topic, but I believe this document creates a lot of confusion for those on the 491 visa and want to apply to the 191. I was wondering if the document disclosed in August 2023, titled "Requirements of Condition 8579 in relation to Skilled Work Regional (Provisional) visa (subclass 491), Reference: FA 23/07/00752," might alter the criteria regarding the residency requirement while on the 491 visa to qualify for the 191 visa. (This document can be found in the official Immigration Department by searching through google). This document does not mention any difference when states you have to stay in a DRA(Designated Regional Area) during 3 years to comply the 8579. As well, it mentions some scrutiny for those who stay more than 3 months outside within a year. Those really create confusion in many people in some facebook groups. Thank you!

Hi Karl, Retail / Hospital pharmacist is on the CSOL do international pharmacists with provisional AHPRA registration qualify for the 186DE if the meet all other criteria except not having general AHPRA registration?
Yes, but good luck finding a employer that will sponsor you, it seems employers prefer to hire pharmacists from western countries. Theres seems to be a mass abundance of applications from people from India, Sri Lanka, Bangladesh, Egypt, UAE, Phillipines from my personal experience.
I can only imagine that the ARt mbr copied and paste the decision due to the hectic amount of cases they’ve got atm and the pressure from above to complete them

Hi! Thanks for your help. I’m 45 years old and I currently hold the 482 Visa. Can I extend or apply for the same Visa again? That’s what the lawyer of the Childcare centre told me but I can’t trust him because he didn’t tell me that I could have applied to the 186 Visa direct entry instead of the 482. I let him know that my goal was to obtain my PR, that’s what I was offered, sponsorship and then PR but he gave me and the centre misleading and inaccurate information. Now I know it’s too late for the PR 😢. I’ve been in Australia for more than 8 years and the nightmare of the Visas never ends.😢 Thanks.
Sounds like a nightmare indeed. Now you are 45 you cannot use DE 186 unless you are under the labour agreement stream. For the 482 visa there is no age limit though so you can them as many times as you can.

This government has prioritised regional visas and even 2024 November people are getting pr. This is so unfair we are so desperated now. We can't even get a credit card or buy a house. I think those appeals will not finalised anyway, those onshore will continue finishing their degrees under bridging visa but it will be interesting to find out what will they do after their case become irrelevant after their graduation😅even getting tourist visa from another country can be challanging in some cases because of unfair visa refusal and not getting decision from aat. About 186 visa there is a huuuge unfair situation going on, they call it prioritisation but its more like discrimination. There are metro applicants waiting more than 17 months whereas regional applications gets processed in 3 months even 1 month in some cases. Last year in april the department stated in an email that they the allocated quota has exhausted and they will resume processing on new financial year. And this year they keep giving grants to new applicants on reginal area which causes keep feeding the pipeline. I understand they are doing that because of low rental vacancies in big cities but there are big problems with that; 1-I saw a lot of facebook posts people asking if they can leave their employer after receiving grant even saw someone asking if they can work with someoneelse after they arrive australia. Offshore regional applicants get processed earlier but they keep adding up population of metro cities. 2-I am 186trt applicant applied on dec 2023, at the time i applied the requirement to apply trt was still 3 years, soon there will be more applicants applying trt because they reduced it to 2 years. And with current regional arrangements it will keep feeding the pipeline. I feels like it will never end. 3-Everytime they open a file from metro they re ask updated documents including medical assesment, i’m single its ok but families already have cost of living burden in big cities they also payin more for schools, their children cant attend good schools as they are not pr there are heaps of disadvantages of staying in bridging visa for 17 months. For myself i just pray that my landlord would renew contract because i know its not possible to rent somewhere else in bridging visa. I have to apply another bridging visa everytime i need to go overseas and if something urgent happens with my family in overseas i will pay again for bridging b and have worry waiting approval of it and its so annoying. I could earn more, but I have to stay dependant to my employer and i dont have much negotiation power, i cant change jobs its all burden. I seriously dont understand, i applied 482 as a software engineer during covid when borders were closed, my occupation was on pmsol and my visa approved in 1 day, everyone was leaving, the market was tight and salaries went up really high in tech, they were desperetely needing those people at that time and now they apply the same approach they do to those waiting for parent visas. I might be closer to the end of pipeline but i’m not sure of that. For new applicants i seriously wish good luck. I dont recommend to apply 186 from metro at all.
For 482 visa holders, to apply for 186. We need to have a work experience of 3 years while holding 482 visa. If you h e a previous work experience it doesn’t matter. If you check eligibility for 186 visa. It Cleary states 3 years of work experience required holding 482 visa. Not sure why on this video Karl said it eligible while answering that question. !!! Wrong Information !!!

@ Student visas reached a high of 713,144 as of February 2024 - easily exceeding the pre-COVID peak of 633,816 as of September 2019. I don’t understand your point…?

I am still on a bridging visa but to complete three years of experience I would have them in July this year. I could apply for the 186 visa directly once I have these three years of experience. If you have the full skill assessment then when the 3 years tickes over you can use the DE stream of the 186 visa. YOu don't have to wait to use the TRT stream

hi Carl , I am on a 482 visa and worked with one employer for 2 years. Then, I spent 2 months waiting to switch to another employer. I resigned a few days ago and recently learned that the timeframe to find a new employer has been extended to 180 days instead of 2 months.
My question is: do I have the full 180 days, or should I deduct the 2 months I spent during my first employer change, even though it happened before the new law came into effect?
Hi Karl, my lawyer lodged my 186 visa on the day of my 45th birthday at 5am. Has that put my visa at risk? They were meant submit the application the day before. Thank you for all the information you provide.
If you had already turned 45 which would have been 12.00pm, then it would be too late to lodge. If your lucky DOHA may accept it but your agent will be in trouble if they dont

I applied in May 24, processing times have been increasing from 2 months to 9 months and seems to be increasing again.
We are stuck in the same job, same salary and quite often very poor work conditions while 482 and 186 visa are processed in couple of weeks.
We have been emailing MPs, open petitions, trying to get exposure on social media but it is getting worse and worse every month.
We fear an 887 sitiation for 191 visa applicants soon.... I would love to hear your insights about what else could be done.

Well indeed it takes more than 17 months for 186 visas to get processed in metro.
1-3 months is for regional 186 applications.

As a 491 holder who has just lodged 191 application, Im so stressed out as it feels like Im stuck in an ‘unfair game’ as DHA keeps changing the rule of the game / moving the goalpost (by keep increasing the processing time). In addition, not having a PR holds me back in terms of career progression as there are jobs out there requiring PR visa.

Yes things seem to be getting worse for the 191 and time to raise another petition.
From refused visas to ART lengthy reviews to Federal Court reviews to failed departure to “maybe removal”, one person can still find various ways to delay their departure, sometimes for years. I don’t know how many more staff ART would need to have to not let waiting time blowing out into decade territory, but I’m not seeing the promise of “lowering numbers” when “failed departure” has not been addressed by anyone properly at all.
Let’s see if 2025 there will be some sweeping changes to this after labor is expected to lose the election.

I’m finding it quite challenging to secure sponsorship under the 482 visa, and with my ACS assessment expiring in March, I’m concerned about my chances of obtaining permanent residency. Additionally, I’ve been struggling to find a company willing to sponsor me, as many have rejected my profile, stating they are only considering PR holders or citizens. This situation feels somewhat discouraging. It would be greatly appreciated if you could address these issues in your next video.
That is a tough one. In the end people will have to decide it maybe better to go home and work in their occupations. In fact the future points test will probably benifit those offshore with significant work experience than those who have studied here.
Hoping you would shed some light on delayed visa processing times. I have lodged 190 in June 2023 and after waiting well over 18 and a half months, I still wait in uncertainty about future of my family. If you could please share these concerns with the authorities.

This year in May I will be eligible to apply 191, but I just saw 8579 condition it says you should not have spent 90 days per annum outside DRA, myself being primary applicant didn't spend more than 34 days per annum but secondary applicant (my wife) has spent 93 days in 2023. The first time, she spent 34 days in Feb-Mar 2023 and then 59 days Oct-Nov 2023. Will that affect the decision for 191?

Hi Karl, my partner employer wants to sponsor her under the 186 Direct entry stream.
She works as a childcare worker (group leader) we were waiting for the 3 years experience to apply for the 494 as we live in Gold Coast but with the new CSOL she already has the 3 years experience as a regular childcare worker.
The problem we are experiencing is that she needs a skill assessment but ACECQA is not doing skill assessment for regular childcare worker, so we are stuck with a Skill in the CSOL but no assessing authority willing to do the skill assessment.
Do you have any information in regard to this topic?

Hi Karl, how about 494 visa transition to 191 visa. Immigration website says need to stay 3 years inorder to transit to 191. However, there are some sources citing that 494 holders are eligible to apply for 191 after 2 years if we are under DAMA visa (494). Your clarification on this would be appreciated
Unfortunately there is no difference for the DAMA areas and the 3 years is required for the regional stream of the 191 visa

Hi Karl, I lodged my 190 visa in Dec 2023 when the processing time was 8 months. It has now stretched to 19 months which is mentally exhausting for many of us making such a big move with families. DOHA delays are causing immense mental stress especially as life changes like marriage/divorce can alter points. There is also a complete lack of transparency with non-priority occupation grants sometimes being issued to Jan 2024 applicants while the previous backlog is already waiting. Can you please bring attention to this issue?

Now on 15th Jan 2024 they have increased the timelines again. This is the 5th time since my lodgement that the timeline is changed. They have the quota so what is holding them to give the grant. My agent is considering to apply for 186 instead of 482, but i did few gaps from moving to different employers and working casual with agencies but with fulltime schedule.
The DE stream just requires 3 years of work experience and makes no mention of casual or part time distinctions

I just wanted to ask about my case: my partner and I are on the former 482 temporary sponsorship visa (granted in August 2024) and she already meets all the requirements for applying for the 186 direct entry visa, includin the positive skills assessment and 4.5+ years of work recognized in ger field. We just didn't applied for the 186 visa at that time cause her skills assessment took longer to be approved.
Could you let us know if we alao can apply for the 186 direct entry visa before the two years even if we are on the moment the former 482 visa? Her profession is still on the Core Skills Occupation List.

No that is not genuine. We have multiple people granted who spent years outside of Australia but still got there 191 visa granted

The 482 visa time for the TRT stream can now be added with multiple sponsors. When a new employer sponsores you there is no need to apply for a new visa if your current one still has alot of time left.

Sorry for insisting on this topic, but I believe this document creates a lot of confusion for those on the 491 visa and want to apply to the 191. I was wondering if the document disclosed in August 2023, titled "Requirements of Condition 8579 in relation to Skilled Work Regional (Provisional) visa (subclass 491), Reference: FA 23/07/00752," might alter the criteria regarding the residency requirement while on the 491 visa to qualify for the 191 visa. (This document can be found in the official Immigration Department by searching through google).
This document does not mention any difference when states you have to stay in a DRA(Designated Regional Area) during 3 years to comply the 8579. As well, it mentions some scrutiny for those who stay more than 3 months outside within a year. Those really create confusion in many people in some facebook groups.

You have to be employed on on the 482 visa for the employer that is going to sponsor you under the TRT stream

Yes, but good luck finding a employer that will sponsor you, it seems employers prefer to hire pharmacists from western countries. Theres seems to be a mass abundance of applications from people from India, Sri Lanka, Bangladesh, Egypt, UAE, Phillipines from my personal experience.
You need a full skill assessment for DE 186. You could use the 482 get registration then do DE
I can only imagine that the ARt mbr copied and paste the decision due to the hectic amount of cases they’ve got atm and the pressure from above to complete them
Possibly but that doesn't change the fact that if they do shortcuts like this it costs the taxpayers much more in the long run

You can spend as much time as you wish overseas and it does not affect the 191 application.

Hi Karl, I got my JRFA outcome (chef and cook) on 30th January 2024. My 482 medium stream visa already lodged but it is still pending. So, by the time completing 2 years on 482 visa my JRFA will expire . So, will I be able to apply 186 TRT without skill assessment? or any other option to skip the skill assessment?

Now on 15th Jan 2024 they have increased the timelines again. This is the 5th time since my lodgement that the timeline is changed. They have the quota so what is holding them to give the grant. I am really Stressed out 😢😢..
We will beifly mention the processing delays this week but there is little anyone can do due to the planning level restrictions. Just keep hanging in there and get on with your life

Can I extend or apply for the same Visa again?
That’s what the lawyer of the Childcare centre told me but I can’t trust him because he didn’t tell me that I could have applied to the 186 Visa direct entry instead of the 482. I let him know that my goal was to obtain my PR, that’s what I was offered, sponsorship and then PR but he gave me and the centre misleading and inaccurate information. Now I know it’s too late for the PR 😢. I’ve been in Australia for more than 8 years and the nightmare of the Visas never ends.😢

Sounds like a nightmare indeed. Now you are 45 you cannot use DE 186 unless you are under the labour agreement stream. For the 482 visa there is no age limit though so you can them as many times as you can.
Hi Karl, I worked on 482 visa with the first employer for 1 year 4 months and 1 year with my current employer. Can I apply for 186 Direct entry now or should I wait to complete 2 years to apply for 186 TRT stream?

No need to wait for the 186 DE stream as long as your occupation is on the CSOL!

We are waiting for our 186 visa to be finalised from 2023 November. Is there a possibility to finalise metro 186 visa in 2025? This government has prioritised regional visas and even 2024 November people are getting pr. This is so unfair we are so desperated now. We can't even get a credit card or buy a house. Hope this will not get worse after election.
Unfortunately non priority 186 applications are taking 12-18mths, so if you are lucky maybe this year. Hope it is soon for you.

I received my 482 in Aug 2023, but I will be completing 3 years with my current employer in early March. Will I be eligible to apply for the 186 TRT/DE stream without completing the 2 years on 482?
The DE stream has requirements but if you meet them you can apply anytime

I think those appeals will not finalised anyway, those onshore will continue finishing their degrees under bridging visa but it will be interesting to find out what will they do after their case become irrelevant after their graduation😅even getting tourist visa from another country can be challanging in some cases because of unfair visa refusal and not getting decision from aat.
About 186 visa there is a huuuge unfair situation going on, they call it prioritisation but its more like discrimination. There are metro applicants waiting more than 17 months whereas regional applications gets processed in 3 months even 1 month in some cases. Last year in april the department stated in an email that they the allocated quota has exhausted and they will resume processing on new financial year. And this year they keep giving grants to new applicants on reginal area which causes keep feeding the pipeline. I understand they are doing that because of low rental vacancies in big cities but there are big problems with that;
1-I saw a lot of facebook posts people asking if they can leave their employer after receiving grant even saw someone asking if they can work with someoneelse after they arrive australia. Offshore regional applicants get processed earlier but they keep adding up population of metro cities.
2-I am 186trt applicant applied on dec 2023, at the time i applied the requirement to apply trt was still 3 years, soon there will be more applicants applying trt because they reduced it to 2 years. And with current regional arrangements it will keep feeding the pipeline. I feels like it will never end.
3-Everytime they open a file from metro they re ask updated documents including medical assesment, i’m single its ok but families already have cost of living burden in big cities they also payin more for schools, their children cant attend good schools as they are not pr there are heaps of disadvantages of staying in bridging visa for 17 months. For myself i just pray that my landlord would renew contract because i know its not possible to rent somewhere else in bridging visa. I have to apply another bridging visa everytime i need to go overseas and if something urgent happens with my family in overseas i will pay again for bridging b and have worry waiting approval of it and its so annoying. I could earn more, but I have to stay dependant to my employer and i dont have much negotiation power, i cant change jobs its all burden.
I seriously dont understand, i applied 482 as a software engineer during covid when borders were closed, my occupation was on pmsol and my visa approved in 1 day, everyone was leaving, the market was tight and salaries went up really high in tech, they were desperetely needing those people at that time and now they apply the same approach they do to those waiting for parent visas.
I might be closer to the end of pipeline but i’m not sure of that.
For new applicants i seriously wish good luck. I dont recommend to apply 186 from metro at all.

For 482 visa holders, to apply for 186. We need to have a work experience of 3 years while holding 482 visa. If you h e a previous work experience it doesn’t matter. If you check eligibility for 186 visa. It Cleary states 3 years of work experience required holding 482 visa. Not sure why on this video Karl said it eligible while answering that question. !!! Wrong Information !!!

No there is no requirment to do so. When you lodge the application for her visa that will be enough notification

How long will it take for 189 visa PR to be granted if I have submitted everything on January 2, 2025. My occupation is Civil Engineering Draftsperson completed from Western Australia 🦘🌏. I think construction industry is in priority list. Thank you.
At the moment construction has yet to be prioritsed for the skilled visas so it may take a while

That is always a complicated question but they may want you on a 482 visa first and then go to 186

@ Student visas reached a high of 713,144 as of February 2024 - easily exceeding the pre-COVID peak of 633,816 as of September 2019.

I applied in October 2024 for my 482 visa and already had two years of experience working as a Mechanic, full time. I am still on a bridging visa but to complete three years of experience I would have them in July this year. I could apply for the 186 visa directly once I have these three years of experience.
I will not be obliged to wait 2 more years with my 482 visa?.

If you have the full skill assessment then when the 3 years tickes over you can use the DE stream of the 186 visa. YOu don't have to wait to use the TRT stream
